I've bought a piece of land close to Mararba, Karu LGA in Nasarawa State and the former owner has surrendered to me his original R of O.
How do I change the title to my name ? Do I really need a C of O? The land is situated .

Pls what's the difference between the 2 ? Someone told me if the land is not in an urban area, R of O wolud suffice. But I've seen someone whose land is in Abuja given an R of O. Can someone pls help with some clarifications? Does a C of O add any economic value value?

right of occupancy R OF O is just an offer while a C OF O certificate of occupancy is certified right of ur ownership of the said land.

r of o is a weaker title to land and vulnerable while c of o is a superior title and secured. r of o could revoked without compensation while c of o is compensated for.

so its very important to perfect ur land title to c of o after an offer of r of o is given to you. that is why most land buyers are very concern on the title as a c of o always attracts a higher value.

when given an offer of r of o, a premium sum is attached to the offer to be paid for perfection to c of o.


so u can go to the relevant land authority to clarify and get urself more informed.

i bought a plot at Bwari AREA COUNCIL Abuja for five years now and the C of O is yet to be issue. why is it taking so long for C of O to be issue at Bwari AREA COUNCIL? your information is appreciated

A lot of Nigerians misconstrue R of O and C of O for title. While In actual fact, neither R of O nor C of O confers title. They only give right to develope your property. If your chain of title is defective, a C of O will not cure or remedy it. This was the ruling of the Nigerian Supreme Court in Ogunleye v. ONI.

Please get a copy of C of O and read it, it is sometimes not worth the paper it is written on. C of O is just a clog in the wheel of proper real estate transactions just like land use decree. They are nothing but tools of domination and extortion. Don't ask me why and how because explantions would need long legal treatise.

A fee simple conveyance is what many common law climes do in land transactions but Nigeria introduced communist land tenure system in a free market economy. The feudalists wanted it that way so that they can be in Sokoto in the North and deep their hands into your sokoto in the South. This why you find many Nigerians who are land barons but they live in abject poverty. Many Nigerian Land holdings cannot easily be converted to cash.

The land use decree was used to confiscate and control the wealth of the southern part of Nigeria hence the introduction of C of O and R of O. In many states, the politicians use this C of O to victimize opponents.

In Asaba one Gideon Nwaomu had a popular hang out called Giddis. When he publicly chastized Uduaghan for non performance, Giddis' C of O was promptly revoked and the structures demolished despite Nwomu's injunction from a competent court. The message was sent by Uduaghan, criticize me at your peril. This has the desired purpose which is a chilling effect. Now if Nwaomu had a fee simple title, no vendetta would have allowed Uduaghan to confiscate his property without showing a compelling public interest.
