Rejoinder: Court Injunction on Lekki Pearl (Alpha Mead Development Company)

It has come to our notice that some mischievous parties have gone to Social Media with obsolete documents in a deliberate and sinister bid to misinform the public about Alpha Mead Development Company (AMDC) and one of our developments – Lekki Pearl Estate.

Although it is not our tradition to join issues with such parties, we deem this response necessary in the interest of our esteemed subscribers, stakeholders and the general public.

We wish to state that the entire land for the Lekki Pearl Estate was validly acquired from the Lagos State Government after satisfactory due diligence by our company. Certain persons however approached the High Court of Lagos State (Coram Oluwayemi J.) for an interim order of injunction in respect of our further developments on the land. The order was for a definite, named period in the terms prescribed by law. The Supreme Court of Nigeria prescribed clearly in the locus classicus case of KOTOYE V. CENTRAL BANK OF NIGERIA ((1989) I NWLR (PT. 98) PG. 419 that an interim injunction is one granted to last until a named or definite date.

This order was issued on the 10th of February, 2014 and extended specifically until the 31st of March, 2014 and was not renewed upon its expiration. It therefore important to note that since the injunction lapsed in March, 2014, AMDC has continued steady work on site, in our quest to keep our 24 months promise and hand over the first set of housing units to our subscribers by December 2015. Should we have contravened any court order, the court's inherent sanctions of punishment for contempt would have been invoked and visited upon our company.

We will therefore like to state that going to social media to malign our reputation is a lazy attempt at seeking redress, and we will take appropriate legal action against the perpetrator(s) once our investigations are concluded. In the meantime, we wish to alert the general public that these faceless elements cannot be taken seriously. A serious person with genuine claims would have toed the line of the law, rather than taking solace in social media to deliberately misinform and mislead unsuspecting public through distorted documents and false information, as these mischievous elements have done in the attachments they have posted in this forum.

On the whole, we wish to emphasize that there is no court injunction restraining AMDC from further development of the site. Instead, our stride to house middle income Nigerians with as little as N250, 000 monthly has earned commendations from the state government and other relevant stakeholders.

We therefore use this medium to reassure our esteem subscribers, stakeholders and prospective customers that our determination to deliver quality and affordable housing to middle income Nigerians can only be strengthened by this event.
