Last week, a magistrate court sitting in Osisioma delivered a ruling I’m still turning over in my head.

It was a possession matter. Landlord versus tenant, on the face of the originating process — and the landlord, it turned out, was the defendant’s brother-in-law. But the defendant had filed an objection — she was disputing that a landlord-tenant relationship had ever existed. The store, she said, was hers. Her mother-in-law had inherited it from her father-in-law by gift inter vivos, and passed it to her. She’d occupied it for years, paying no rent, because she wasn’t a tenant. Title was in issue. That was the objection. That was all the court was being asked to look at.

The ruling came. And it didn’t stop at the objection.

The objection was struck out, and costs of ₦200,000 were awarded against the defendant. That’s a decision the court is entitled to make. But the ruling didn’t end there. It went on to find that the defendant had lost her right of possession. It held that by disputing the landlord’s title, she’d triggered a forfeiture. And then it did something I genuinely didn’t expect. It fixed rent arrears, in these words:

“Since the Defendant has never paid rent on the property, I hereby fix rent at ₦5,000 per month to be paid from May 2023, when the plaintiff inherited the property and became her landlord.”

Against a woman whose entire objection was that she had never been anybody’s tenant.

No oral evidence had been taken. No witness had been called. Nobody had been cross-examined on the gift. It was affidavit against affidavit — and a ruling on a jurisdictional objection quietly became a full determination of a case that had never gone to trial.

I keep turning it over because of what it says about where the line is supposed to sit. A preliminary objection asks one question: should this court be deciding this dispute at all, or does it belong somewhere else first? It doesn’t ask who is entitled to possession. It doesn’t ask what’s owed. Those are trial questions — pleadings closed, evidence tested, both sides heard on the merits, not just at the threshold.

What struck me wasn’t that the magistrate ruled against the defendant. Courts rule against people every day. It was that the ruling reached for questions nobody had put before it — and answered them anyway.
Crime › Re: Confession Of A Captured Suspected Kidnapper Who Demanded ₦100M Ransom by Ombre(m): 8:12am On Aug 07
Hey Chief, good morning.

The PA and CCA would ideally not be the best place for you to find what you are asking for.

Let us first understand that Investigation and Interrogation is a specialist profession, even within security agencies and private practice. As such, like every other profession, there are rules and regulations as well as qualities expected of a good investigator/investigation, codified into trainings and taught during courses of these specialists. This is what guides them. Hence, I believe you will find answers maybe if you take a professional course on these topics.

Further, do note that nothing is cast in stone as investigations can be dynamic, depending on how the investigator chooses to proceed, provided it stays within the ambits of the rules. However, in this case at hand, an ongoing investigation is regarded as confidential. Even the end of investigations does not necessarily mean it loses its classified status. This is why you see it sometimes takes years for some to get unclassified, and some on attaining that status are still redacted. However, there are situations where controlled information can be released to the publig during investigations, to help achieve a goal where there is a stumbling block.

To decide whether it favours the incestigation to release this type of video to the public at this stage of the investigation, certain considerations as to how it affects the investigative process have to be made.

So let us discuss, judging by what you watched, what might the information released do in:

1. Helping the investigation.
2. Helping the suspects still at large.

Maybe let us start from here.

Kobojunkie:
I happen to be conversant with the Police Act of 2020 and parts of the Criminal Code Act. And I have not come upon any sections in either document in which the claim you made is defined. Hence my reason for asking. I would appreciate it if you would provide a reference to the particular document, section, and article. At least so we can get on the same page on this. undecided

Maybe just allow that man and save your sweat.

It is typical of an average Nigerian to hold solid opinions about what they know nothing of and be garrulous about it.

I have followed your exchanges and from a professional, home and abroad, your opinions and submissions are the taught and practiced global best standard.

So, just chill and let them keep dancing at the altar of their ignorance and arrogance.

Shalom.

runningriot:
when ignorance is bliss abuse is inevitable... You don't know you don't know... Stop defending your ignorance with bolded vains in your neck!

Police is an organize force with protocols and tenets. When you see a police release a press briefing it is the work of a PPRO and no an IPO or faceless officer like we see here and in most a times there must be journalists to ask questions. And most importantly not in the hospital... So please do the calms and learn...

Secondly, any where in the world once a police wants to make a press briefing and tell the public the indebt of their progress made in an investigation for them to help them arrest the fleeing suspects is when they have tried to do that in secret and it did not work! and not when a suspect is in the hospital you are interviewing him and posting it online this is not policing this is unprofessionalism.

And finally common sense should have let you know that security investigation in general term is a conceal action and not a public display like a content creator trying to generate traffic in the Internet. Apparently that is why anywhere in the world the world police have there secret investigation room! And it is totally out of bounds for anybody including some police officers!

PigTormentor:
Obi is worse than them all.

All the people that he called criminals, he ended up kissing their behinds for political relevance.

And what's the difference between these people and even people like you?
When Reno and FFK were busy abusing and making asinine allegations against Tinubu and Buhari, you people were worshiping them.
Anything that they said back then, even when it lacked logic, you believed. Now that they refuse to support your Agulu cult leader, now you question everything they say and now see them as enemy number one.
You also sold your soul for political gain.

INEC can, should, does not decide. The voters/people decide and INEC is bound to announce and stand by the decision of the people.

I will keep on repeating it.

It is GEJ I blame. That man is the second worst thing that happened to Nigeria in all time, only closely behind Amalgamation.

If he did not cower to these charlatans, we won't be here. And spare me the rubbish talk that 'they promised blood of baboons will flow'.

What blood could have been shed more than what we have been shedding since these demons took power?

The worst that could have happened was a one time insurrection or chaos that can last highest months, which daft GEJ could have crushed with instruments of state at his disposal then carry the threat actors (Buhari, Tinubu and co) to underground dungeon somewhere around Aso drive, then try them for sedition and treason.

Truly, as the then opposition mantra was, I strongly apologise to them for arguing, GEJ is a true WEAKLING.

No driving test and certificate/result needed? Is this your update current?

annford:
Here in Abuja, it takes less than 6 hours. Walk into the FRSC HQ at Wuse Zone 7 or the one at Wuse Zone 3 by neighborhood center or the one at Mabushi. They'd first call you in for " Capturing" and then print out a temporary driver's license for you. They'd tell you'd be notified via an SMS when the permanent one is ready (usually on your birthday). Within 3 months of the capturing, the main would be out. You go give them the temporary one and show the text sent too you and they give you the permanent one. Chikina.
