*A "VICTORY" THEY ARE AFRAID TO CELEBRATE....*

Isn't it very instructive as it is very funny?

Isn't it comedic if not tragic?

Isn't it telling enough for the untutored?

How else could this be interpreted?

How could a Party, in this case APC in Osun State, win such a *"humongous victory"* and its members are scared to death to celebrate?

Many of them are hiding in the crannies of their hotels, dens, camps and houses and unable to flood the streets to celebrate their so called victory.

I am reminded of King Pyrrus of Epirus (318 to 272 B.C.). He was a son of Achilles. He waged two wars against the Romans in 280 BC and 279 BC. Those two *victories* were so costly and devastating to the *Victor,* King Pyrrus, that his name had come to be associated with costly, deadly, severely consequential and vacuous victories. Historians characterize such victories as *pyrrhic.*

That is what has happened in Osun State. *A pyrrhic victory by the APC.*

A victory that could not be celebrated by the victors.

A victory so costly that even the victors became psychologically worse situated than the so called vanquished.

A victory that put the fear of unknown into the victors.

A victory that has forced on the State and its people, *a peace of the sepulchre.*

A victory that is forcing the *'victors"* to mourn rather than celebrate.

A victory that is evidently ephemeral in all ramifications.

A victory that is so hollow and shallow as it fills the victors with trepidation.

Even, the robbed, the dispossessed, the disenfranchised, the humiliated and the spirits of the murdered seem to be in a more celebrative mood than the victors.

They seem to be propelled by their confidence in the *eventual victory of GOOD over EVIL.*

The seem to be encouraged by the fact that *their cause and course are just; and that the just shall be vindicated.*

The robbed are watching.

The dispossessed are paying attention.

The disenfranchised are keeping vigil.

The unjustifiably humiliated are angry.

The wronged are waiting eagerly for the D -Day of real reckoning. How soon that Day would come, no one knows.

But it seems that both the perpetrators of the robbery and their victims seem to be in agreement and are aware that there would be consequences for what has happened.

Hmmmmmm!

When a victory like that of the APC in Osun State could not and would not be celebrated, it only means it is not a just and a deserved victory, but a fundamentally pyrrhic one.

So, we wait and watch as time tells.

My Grievances Against Governor Aregbesola: What An Anti-climax

I find it necessary to once again put to pen to paper at this auspicious moment in the history of our state. I find it very cogent because many people have seen my sincere attempt to struggle for good governance in Osun state as needlessly troublesome. To some, I am working against the interest of a fellow Ijesa man as I will always tell people whatever material gains we acquired will remain here on the mortal plain. No matter how hard we try our legacies be it good or bad will outlive us. Many people will remember that on the 17th of August 2018, I sent a widely published letter to the governor informing him about the deep-seated resentment of Osun people especially Ijesa people and most importantly the legitimate grievances of the people of Ijesa North Federal constituency and Ijebu-jesa town in particular. Efforts will be made to xray some of the grievances that very many Osun people have against the outgoing government that lead to the embarrassing outing we call an election in Osun state.

Osun in General: We don't need a rocket scientist to know that Osun under the administration of Governor Aregbesola could have done better. His emergence after a long legal tussle gave a lot of people a ray of hope. That in our already failing system as a state and as a nation we can be the best. The struggle to classify our schools was needless. The hijab battle between Christians and Muslims could have been avoided. The uniform school uniform for Osun students was pointless. We saw the massive investment in school structures but like I stated in my public letter to the governor last year "Schools are peopled by people" with all these structures many state in North that were in awe of the academic performance of our fathers in WAEC came ahead of us in WAEC ratings. I have it good authority that many schools in Osun are grossly understaffed. Having multi-billion naira schools to litter Osun state will at the end become an albatross on the neck of state because maintenance will not come cheap. It would have made more political, economic and academic sense if half that money was used to renovate all existing dilapidated and decaying educational infrastructure in the state. Our people will say "one rich man in the mist of many poor people is himself poor" likewise, one good mega school in one federal constituency in the midst of many dilapidated and decayed schools is also decayed and dilapidated. His Excellency should have taken a cue from His Excellency Governor Adams Oshiomole Edo State governor as he then was on how he did his red roof revolution. Health institutions and workers received very little attention from the outgoing government. My biggest grievance is the arbitrary loan that might take forever to offset. It is stomach churning to hear the rhetoric that no nation develops without debts. Nothing can be farther from the truth. In Africa no father prays to leave debts for his children, why do we now find it convenient to leave debts for 10 successive governments? I leave this question open, to be answered by the open conscience of all readers.

Ijesa Acrimony: In our clime, we play the politics of he his our son let him do it, this explains why politician no matter how bad get bloc votes from their areas. Ogbeni got to power riding on the wings of the political strength of Ijesa masses and elites alike. In my letter to the Governor last year I asked a rhetorical question, "What have you brought home to your people?" the answer to that question is next to nothing. Aregbe brought next to nothing to Ijesa land. Brewery road, that connects the heart of the capital of Ijesa land to Akure Ibadan expressway is still very narrow and in a terrible shape. No serious state institution or federal institution was attracted to Ijesa land. No signature project in Ijesa land to show that our son was once a governor. This is a saddening development because going by zoning and rotation of offices which we do, it will take Ijesa land another 32 years to produce a governor, even it comes after 32 years it will surely go to Ijesa North federal constituency. That means for the next sixty years Ilesa the capital of Ijesa land might not produce a governor, because the opportunity they had Broda Raufu blew it away. What an anti-climax for the hope of Ijesa people.

Integrity & Other Virtual Claims : Between Madam First Lady & an ADC

Being a Nigerian is hard, being a middle or lower class Nigerian is even harder. Class privilege and social status, earned or vicarious, always often determine rights and the respect of these rights. More so, 80% of our laws benefit 20% of the population, while 80% of our population must make do with 20% of our extant laws. This is pure fact.
I state the above conscientiously, mindful of the still on drama at the State Villa that goes to proof that integrity is not a virtual commodity, nor can it be claimed in a vacuum. The toga of integrity once worn must bear out a complete tapestry of honesty. I will discourse this briefly in the context of class privilege and hypocritical integrity.
Here are the bare facts: Mrs. First Lady, Aisha Buhari alleges her Aide -de-Camp, Sani Baba-Inana ( ADC hereafter ) received from politicians and businessmen a sum of N2.7Billion as ‘gratification’ meant for her person and office, yet failed to remit same to her, in light of which she had him arrested and investigated by the Nigeria Police Force who found no evidence to substantiate her claims and now has him detained by the State Security Service (SSS).
Let’s begin by finding the answer to some simple questions : Is the office of the first lady constitutional ? What motives could lie behind such gratification? Who has the power of arrest, investigation and prosecution in this instance ; the Police or DSS?
A major talking point of President Buhari ‘s campaign of 2015 was an animated argument against the Office of the First Lady, so called. He spoke vehemently against budgetary privileges of said office, moaned its excesses and promised to end its presence in our democratic experience. Granted, traditionally and world over, first ladies DO enjoy certain privileges that come with being married to the country’s legal first citizen. But having spoken so strongly against it, one would have hoped to see principles birth action.
As we speak the First Lady Aisha Buhari not only enjoy an office space at the villa but has an office arrayed by an abundance of staff and personal aides that would rival neighbouring small countries.
Sustained on a shared allowance with the State House or Aso Villa, political favours orbit her sphere and this would explain the readiness of politicians and businessmen to part with a collective sum of about N3Billion. Think about it. Being a total sum from different lobbyists, it is safe to say the amount mentioned was accrued over time. It only makes sense that first callers had their wishes or request for favours met and that encouraged the enterprise of money for favour overtime. This, though disputable by contrary fact, logically explains the huge sum accrued over time.
There is the matter of how swiftly and efficiently the Nigeria Police Force applied themselves in this matter. Way before the information became public, the Police Force had investigated and found the ADC innocent of the allegations against him. According to them, he has no more than N30,000 in his account and all transactions on his accounts are regular and raise no flags.
You know as I do, from first hand experience, that such diligence and attention to detail is not the rule but an exception of our police force. Thousand of allegations go unattended to or inadequately investigated, yet the finest comb went through Madam First Lady’s allegations and swiftly so. If that doesn’t spell class privilege, what else does?
Nonetheless, I’d hate to begrudge Madam First Lady an obvious privilege that comes as a perk of her husband ‘s office and authority. That would be not just foolhardy but naive. I do, however, strongly contest and condemn her decision to involve the DSS in in a matter that is strictly within the operative jurisdiction of the Nigeria Police Force, or by extension the Economic and Financial Crimes Commission. It is this sad turn to the tale that makes it the stuff of class privilege and the abuse of that privilege.
There can be no pretext, remote or immediate, at law to justify the detention of the ADC to Madam First Lady by the DSS. By using her position to influence his unlawful arrest especially after having him picked up from Police custody, she demonstrates an abuse that is rampant and symptomatic of a greater institutional rot in our system. The law creating the DSS does not empower it to meddle in such affairs, doing so at the First Lady’s behest is unprofessional and an institutional servitude for selfish reasons.
The Police Force itself deserve some knocks for handing over a suspect in their custody to the DSS. They should know better than let their powers be usurped as such. That this happened shows that the tough police act is only put up when ordinary citizens are involved. I can’t emphasise this enough.
The right course of action open to Madam First Lady would be to institute a claim in court or direct the matter to the EFCC for further investigation. This I say assuming the money itself is the proceed of a legitimate transaction. If the reverse is the case, then the Police Force and the EFCC have a big integrity test at hand to do the needful being that Madam First Lady enjoys no immunity under our law.
Lets be reminded that former First Lady Dame Patience Jonathan has a matter in court over something indistinguishably similar. What is good for one goose is good for the other.

Over Confidence Kill Faster Than Aids
It will be on note that PDP is the first political
party that went to Omisore in his country home to
seek his suport for the rerun. PDP was
represented by Senate President, Senator Bukola
Saraki and he was given SDP blue print. In the
blueprint, Omisore demand for the payment of all
arrears for Osun worker's salary within three
months of the new administration, abolition of
single uniform for our students and return to
6_3-3- 4 system of education, Qualitative health
delivery system and revitalisation of Agriculture in
the state to banish hunger.
After the meeting, Dr Bukola Saraki told him and
the general public in a press conference that
within the next 24 hours, the party will get back
to him but surprisingly, the feedback from Saraki
to Omisore is on phone call in which Adeleke said
they don't need Omisore to win the election. In a
situation like this, what do you want him to do?
Will he be begging them to do the needful or
what? If you all are there raising voice on
Omisore for adopting APC after the party
agreement to fulfil all listed conditions in the SDP
template handed over to them, I believed we all
should fear God.
If not for the over confidence that is about to kill
Osun PDP, the party would have shun the
egeocentric attitudes that is currently affecting
the party, it will be a difficult task for the party to
win the rerun because majority of the electorates
are of the belief that Oyetola might have learn in
hard way under Aregbesola administration and
thereby ready to put in place all necessary
measures to correct administrative lapses that
was attached to the outgoing government of
Aregbesola in the state. Despite Omisore did not
defect to APC but only solidifying support for APC
to win the guber race after the mutual
understanding to fulfil all agreement in the SDP
template I would rather appeal to the good
people of Osun state to remain focus and be
positive about the decision of Senator Iyiola
Omisore and his frantic efforts to end the
suffering of all and sundry.

As the PDP primaries for Ijesha North Federal Constituency and general election draws near daily it's pertinent we start to be true to ourselves as delegates and stakeholders in our great Party PDP. Truth does not favour everyone because it's a very bitter pill.

My rhetorical question to Oriade delegates and stakeholders is that are we going to behave like Esau in the bible to sell what is rightly our turn in 2019 because of porridge (money) and give it to Jacob which will make us to be politically voiceless for another four years or are we going to stand by the truth that it is actually the turn of Oriade to represent Ijesha North Federal Constituency in the House of Representatives 2019?

With all due respect to my fellow PDP stalwart we all know Ijesha North Federal Constituency have a zoning formula in place of 4 years for Oriade and 4 years for Obokun to represent Ijesha North in the House of Representatives like the way we have PDP rotational 8 years Governorship for the 3 Senatorial district in Osun State. The PDP 4 years for Obokun elapses in 2019 and it is the turn of Oriade to represent us in the House of Representatives 2019.

We as a party have come a long way and have contributed alot to national development. The task before us in the 2018 PDP PRIMARIES and invariably the general election is immense. Our decision of choosing a credible and people oriented candidate for 2019 election is not just for our party PDP but for the interest of the generality of Nigerians and the unborn generation. If we want to achieve a positive result to get the right leader we need to look deep into our soul to vote for truth and candidates that have a blue print of what he or she aim to achieve if given the opportunity to serve.

The choice before us in 2018 primaries is between good and bad leaders. It's between misrepresentation and proper representation of the people. It's between leaders that will be with the people from the beginning after winning election to the end of their tenure and the leader that will abandon the people after winning but start consultation when it's time for another election. It's between leaders that have embezzled our billions of Naira of our constituency project allocation and the leaders that have the burning desire to change our lives for the better. Its between leaders that will always follow the tradition of giving foods to us to buy our votes and the leader that has a blue print on how we can buy our own food in our life time. It's between leaders that don't care about their people that are being killed and the leaders that are prepared to defend the people. It's between leaders that see politics as an opportunity to serve for the benefit of all and leaders that see politics as a business so embezzle all the funds meant for development.

How long shall we be living poor in the midst of plenty? How long shall we be looked upon as a potential criminal because we are holding a Nigeria passport? Delegates, leaders and stakeholders in the PDP primaries your vote is paramount to the production of good leadership that will in turn transform the lives of everyone for the better. You owe a duty to your fatherland by making the right decision of voting the leader that is ready to serve the masses. These whole analysis still apply to other political parties but am just using PDP as a scope of study to set the standard for other parties to emulate.

The rich also cry because on regular bases they give money to the needy people in their family and that is because of bad leaders that have embezzled our common wealth, but if we have good leaders the system will be working fine hence no one will be putting pressure on friends or relatives for money.

When I was a kid I thought money will make you happy but now I realise the greatest way you can be happy is the love you express towards your fellow human. When you give to people you are indirectly replenishing your soul by being happy. When you love your fellow human you will not do things that will be detrimental to his or her wellbeing.

A stitch in time saves nine so we should respect the zoning of the House of Representatives 2019 to Oriade to avoid escalation of the anger that is already on ground. Oriade is PDP 100%. Let us be fair to the Oriade people.

Legality or Otherwise of the Declaration of Inconclusiveness of the Osun State Governorship Election by INEC

The declaration of INEC in the Osun State election may have generated lots of cacophony from different strata of the country. It must be posited that the cacophony is rightly so because the decision of INEC though consistent with previous practice and custom is illegal and unconstitutional, hence null and void. This is because by the general provision of section 179(2) (a) and (b) of the 1999 Constitution as amended, provides thus: (2) A candidate for an election to the office of Governor of a State shall be deemed to have been duly elected where, there being two or more candidates -


(a) he has the highest number of votes cast at the election; and


(b) he has not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the State.


Indeed, the above copiously reproduced provisions are explicit and unambiguous hence needs no further interpretation. Put simply a candidate in an election who scores the highest number of valid votes in election, having as well scored one-third of at least two-third of the Local Government Areas in the state shall be returned elected.



The Electoral Act, specifically its Section 69, is consistent with the said provision of the constitution in that respect as same is made subject to 179 as it relates to governorship election as it provides thus:




69. In an election to the office of the President or Governor, whether or not contested and in any contested election to any other elective office, the result shall be ascertained by counting the votes cast for each candidate and subject to the provisions of sections 133, 134 and 179 of the Constitution, the candidate that receives the highest number of votes shall be declared elected by the appropriate Returning Officer.




Reverting to the facts as presently constituted in Osun State, the PDP candidate Senator Adeleke from the summation of the results scored 254,698 votes while the APC candidate Oyetola scored 254, 345. It is expressly clear that there is a winner in the Osun elections as there is no tie as to warrant a re-run and it is clear that the candidate of the PDP scored the required one-third votes in at least two-third of the all Local Government Areas in Osun State. Hence the decision of INEC to declare the elections as inconclusive is unconstitutional and must be declared null and void.



The provisions of the Constitution must at all times be given priority and in fact is supreme over any other law including the Electoral Act. By the express provisions of Section 1(3) of the 1999 Constitution as amended where any other law is inconsistent with the provisions of the 1999 Constitution, said law shall be null and void to the extent of its inconsistency. It is imperative and trite to state that in interpretation of statutes, more so the Constitution which is the grundnorm of the land, words are not allowed to be inserted other than the primary and exact words used by the statute and in this case the Constitution.



The Courts have in a plethora of authorities and cases enunciated the status of provisions of the Constitution as it relates to interpretation. In F.R.N v. Nwodo (2016) 17 NWLR Pt. 1541 226 at 294 para D posited thus:


"Indeed the Constitution is our supreme law and where it is clear and unambiguous on an issue, it must be the only provision to resort to...". See also: Nafiu Rabiu v. Kano State (1980) LPELR-2936(SC).


In the same vein the Supreme Court in Saraki v. F.R.N (supra) held this



"The construction of the Constitution should be undertaken as a holistic endeavour".



The case of Onashile v. Idowu (1961) 2 SCNLR 53 expanciated further thus “by the literal rule or principle of interpretation of statutes, the words used, employed in the Sections of the Constitution and Electoral Act are to be given their ordinary, natural and grammatical meaning unless to do so will result in absurdity with the provisions of the statute as a whole". See also Lokpobiri v. Ogoala (2016) 3 NWLR Pt. 1499 328 at 363 paras. E-F.


The provisions of Section 179 of the 1999 Constitution as amended were not made subject to Section 63 of the Electoral Act 2010 as amended. Hence the decision of INEC to declare the elections inconclusive is ultra vires the Constitution hence null and void to the extent of its inconsistency. This is more provident considering the fact that the PDP candidate scored more valid votes cast in the elections and is not on equal votes with the APC candidate. More so, having achieved the constitutional landmark of scoring majority of the votes coupled with one-third of votes in at least two-third of the Local Government Areas in Osun State, doing otherwise is unconstitutional.

Conventional error should never supplant constitutional directives, no matter how prevalent. There is no way the Electoral 'Subsidiary' Laws can be more powerful than the constitution. That it is a custom or practice does not in anyway usurp the constitutional provisions in that respect. INEC being a product of law must act and be seen to act by the law in the Osun gubernatorial debacle.
