prophet of Synagogue Church Of All Nations yesterday told the Coroner Court investigating collapse of a guest house within the church that it must bow to the High Court. Joshua through his lawyer, Mr Olalekan Ojo, filed a substantive application before Justice Lateefa Okunnu of Lagos State High Court (unheard), challenging the invitation of the coroner judge, Mr Oyetade Komolafe, asking him to appear to give evidence before the inquest. “This court (Coroner) being a lower court to the High Court cannot speculate on the outcome of a higher court. The best legal position is to adjourn this cause of proceeding till outcome of the application before Justice Okunnu. Where a higher court has taken position courts in the lower hierarchy must bow. If the High Court does not agree with us, then we resume at the coroner,” Ojo said. In an application filed before the coroner court, Pastor T.B. Joshua and Synagogue Church are asking it to stay proceeding pending the determination of the substantive motion for judicial review by the Lagos High Court, as Ojo argued that the substantive application before Justice Okunnu is asking for a limited suspension. “The jurisdiction of this court to enquire into certain areas have been challenged before a higher court. The concept of jurisdiction is multi-faceted in nature, just like in the case of Doyin Okupe vs. Federal Board of Inland Revenue (FBIR). Asking questions on how engineering defects brought collapse to the building are outside the jurisdiction of the coroner court. A person acting within a jurisdiction can exceed its jurisdiction unconsciously when asking questions outside its jurisdiction,” he added. According to him, on November 17, 2014, the High Court of Lagos State sitting at the Ikeja Judicial Division presided over by Hon. Justice L.A. Okunnu granted leave to the Applicants in suit No. ID/188/MJR/2014 to apply for a judicial review of the proceedings in the Suit No. CR/AL/101/2014 which is pending before the High Court. Ojo told the coroner court that in the judicial review before the High Court, the Applicants (Prophet T.B. Joshua and Synagogue church) are praying the High Court to determine whether the statutory jurisdiction of the Coroner’s Court under the Coroner’s System Law 2007 particularly sections 15 and 40 of the Coroner’s Law is limited to conducting inquest into the cause and manner of death and does not extend to inquiry into matters that are not directly causative of the death or deaths being inquired into. Adding: “Whether or not the Honourable Court acted within its powers Court acted within its power in issuing witness summons on the 2nd Applicant at the time when the Coroner had not commenced sitting or taking evidence. “Whether or not the Respondents to the application for judicial review ought to be prohibited from continuing with the conduct of the inquest into the tragic death of unknown persons unknown in the collapsed building at the Synagogue Church of All Nations on September 12, 2014 on grounds of bias or likelihood of bias on the part of the Honourable Court.” Replying on point of law, a senior State Counsel, Mr Akingbolahan Adeniran, argued that in line with section 40 of the Coroner’s System Law 2007, the major interest is on how a death occurred and there is no definition in Coroner Law that restraints the how. “This is not the forum to argue an application before Justice Okunnu. The sole issue for determination in this application is whether the applicants has placed sufficient evidence in its favour. There is no currently no order by Justice Okunnu for stay of proceeding, which she would have done if she needed to do so. The ground for stay of proceeding is not automatic. It is because the Applicants filed an application that there should be a stay of proceeding,” the State Counsel stated. Adeniran noted that till date the Applicants have not presented any witness before the court and the request for the name of the contractor took almost three months of the collapsed building. He urged the court to dismiss the application because the Applicants have not presented sufficient material before the coroner court for it to decide in the Applicants favour. It will be recalled that the coroner judge had invited Prophet T.B. Joshua to appear before and a witness summons dated November 28, 2014 served. After listening to counsels, Komolafe coroner judge) said, “I will not do any other thing until this issue is resolved” and adjourned to December 10 for ruling. visit www.ournewspoint.com for more news updates |
ABUJA- FORMER National Chairman of the Peoples Democratic Party, PDP, Alhaji Bamanga Tukur has accepted the one month suspension slammed on him by the National Working Committee, NWC, saying he was prepared to face the disciplinary Committee. “I am a party person. Whatever party decide is what I will do. So there is no question about that. If they ask me of course I will tell them because it is correct for people if they have reasons for doing that,” he said. Tukur who reiterated that he did not take the party to court, said his readiness to present himself before the Committee was borne out of the fact that he remains a loyal party member, but was quick to add that he was not given fair hearing. It would be recalled that the former PDP chairman was on Thursday suspended by the NWC for allegedly making moves to return to the office he left in January this year and attack on the incumbent national chairman, Dr. Adamu Mu’azu. Addressing Journalists yesterday, Tukur who noted that as a foundation member of the party he knows the rule, adding, “I have never taken my party to court. I have been sued myself as a defendant. The court cases are very clear. When I was sued to make appearance, naturally my representative has to go to court and represent me. But I have never sued my party. “I am a founding member of this great party. I am a member of the Board of Trustees of this party and I am past national chairman of this party. I know the constitution of this party. So, how is it possible that I will sue the party. It is just a misrepresentation of facts may be because I was sued as a co-defendenat. Once you are sued you have to appear that is all I can say.” The Ambassador at Large who maintained that he never swore an affidavit seeking to return to office as national chairman of the PDP, said, “I can’t tell a lie. When they asked whether I resigned without giving the 30 days notice, that is correct”. Continuing, Tukur who boasted that he saw no reason for him to brief the PDP national leadership before disposing the affidavit, said that nobody contacted him, adding, “In fact, I would expect that they will call me and tell me what they are seeing. I have never being asked or contacted. “I think they should do the needful because as a foundation member and the status that I have in the party doing what they have done I would say I wish them well. “I believe today if there is any Nigerian that wish the party and the president Goodluck Jonathan well, I think I am one of them. I am the one who presented our president right from the beginning, everybody knows that. So anything to do with moving the nation forward under his leadership I will do”, he added. On his next step and wehether he would petition the party, he said, I wish my party well. I don’t need to petition the party per se. I think they should do the needful because as a foundation member and the status that I have in the party doing what they have done I would say I wish them well. I believe today if there is any Nigerian that wish the party and the president well, I think I am one of them. I am the one who presented our president right from the begining, everybody knows that. So anything to do with moving the nation forward under his leadership I will do. More news update at www.ournewspoint.com |
DISCOMFORTING news for President Goodluck Jonathan’s re-election bid broke out from former President Olusegun Obasanjo’s Hilltop Mansion, Abeokuta, yesterday evening, indicating that the outcome of the ruling Peoples Democratic Party, PDP, governors who had gone there to plead for the President’s support was initially played down. We can authoritatively disclose today that Obasanjo flatly refused to support Jonathan although Obasanjo had publicly said that he only explained to the governors his position on national issues. But we gathered that it was more than that as he maintained his stand against Jonathan’s style of administration which didn’t deserve his support. This was even as Jonathan and the son of the late former Head of State, Mohammed Abacha met behind closed doors at the Presidential Villa yesterday, apparently to strategise on how to secure victory for him and the party in Kano and other States.. more details at www.ournewspoint.com |
Contrary to widespread reports in the Nigeria media (PREMIUM TIMES not included) the South African government has not returned the $15 million seized from arms dealers purportedly buying arms for the Nigerian military. PREMIUM TIMES can authoritatively report that the money remains frozen in South Africa and has not been returned to the Nigerian government. In October, several media articles quoting the South African High Commissioner to Nigeria, Lulu Mnguni, reported that the money seized in connection with two dubious arms deal had been released to the Nigerian government. However, Mr. Mnguni has told PREMIUM TIMES that the reports are false. Apart from the High Commissioner, the spokesperson of the South African National Prosecuting Authority, NPA, Nathi Mncube, and a South African source that is knowledgeable about the matter but requested not to be named, told PREMIUM TIMES in separate correspondences that the money was yet to be released to the Nigeria government. Rather than return the money, there is possibility that the money may never be returned to the Nigerian government again. Responding to PREMIUM TIMES enquiry about the extent of the investigation into the seized arms money, Mr. Mncube, who declined to give specific information because the NPA does not respond to matters under investigation, however, said the money may be forfeited to the South African government. “In terms of our law, proceeds of crime are forfeited to the state,” he said. On his part, Mr. Mnguni vehemently denied the reports credited to him that the matter has been resolved diplomatically and the money returned to the Nigerian government. He said it was not procedural for the South African government to return frozen money in the manner suggested in the reports quoting him. “We don’t refund money that way,” he said during a telephone conversation. “I said the matter would be resolved within the legal and legitimate means. That was what I said. I did not say the money has been refunded. And I did not follow up since then on whether the money has been refunded or not. It has to be done through the legal and legitimate means.” PREMIUM TIMES investigation also revealed that instead of providing document that validated its claim that the deals were legal, the Nigerian government has been vigorously pursuing a diplomatic resolution of the matter. Hard as it is trying, it appears the Nigerian government is merely chasing the wind, as the matter is no longer in the hands of diplomats and politicians. Unfazed by subtle threat of the National Security Adviser, Sambo Dasuki, to come hard of South African business interests such as MTN and DSTV in Nigeria, NPA obtained court orders freezing the money. Now, Nigeria has to go through the full hog of court processes to secure its release – something the government, which claimed ownership of the money, appears incapable of doing following the backdoor manner the deals were reached. “The money was frozen by two court orders and the court requires the documentations before the money is released,” Mr. Mncube said. “The money is still here and is not going anywhere. We would not release it if we don’t have a surety where the money is going. It is a court process.” Shady arms brokers The inability of the Nigerian government to recover the seized money is hinged on the fact that the two South African companies it was transacting the deal with may have lacked the legal status and the prerequisite authorisation to engage in such deals. In fact, in addition to not having the legal authorisation to deal with the sale of military grade armaments, one of the companies, Cerberus Risk Solution, was in 2013 indicted for breaching a United Nations Security Council Resolution unlawfully by exporting controlled items to the Ivory Coast and is facing a criminal investigation over the matter. With the first tranche of $9.3 million, the NPA said, Tier One Service Group, which the government wanted to procure the arms from, does not have the authorisation to sell or rent military equipment. While casting doubt that the money was meant for the procurement of arms as claimed by the Nigerian government, South African investigators said Tier One was not a registered arms dealer. “In court papers, the NPA submitted evidence that Tier One is not registered with the National Conventional Arms Control Committee and is thus not authorised to enter into any agreements regarding the sale and/or rental of military equipment,” a statement by NPA read. An invoice obtained by the NPA showed an order for drones, rocket and attack helicopter. In the second deal worth $5.7 million, South African investigators discovered that Cerberus Risk Solution neither has a valid Registration Certificate, valid Marketing Permit nor a contracting Permit – statutory documents stipulated by South African law before a company can engage in brokering a deal involving the sale of 50 units of M-75 20mm cannons and 200,000 rounds of 20mm ammunitions Societe D’Equipments Internationaux was seeking to buy on behalf of the Nigerian Military. The NPA explained that though Cerberus Risk Solution was registered by the South African National Conventional Arms Control Committee and issued a registration certificate MS1-11-0001041 on May 30 2011 with legally empowers it to act as an agent to deal with “specialised military and law enforcement equipment”, its Registration Certificate expired on May 27, 2014 two weeks before it received the $5.7 million paid into its Standard Bank account. The NPA also explained that though Cerberus was granted a Marketing Permit AMP2-12-0004803 on April 2 2012, the expiration of its Certificate of Registration automatically rendered that permit invalid. On September 5, $9.3 million cash stashed in two plastic suitcases and two pieces of hand luggage was seized at the Lanseria International Airport, Johannesburg from three men, now identified as Israeli, Eyal Mesika, and two Austrian nationals, R. Wolfgang and M. Michael. The private the jet that conveyed the money belongs to the president of the Christian Association of Nigeria, Ayo Oritsejafor, although the cleric has said he had leased the aircraft out and was ignorant of what it was being used for. The NPA said the suspect did not obtain the necessary approval or documentation allowing them to carry more than the $2,300 cash limit allowed by South African law. While the dust created by the confiscation of the cash was yet to settle, South African authorities seized another $5.7 million transferred by Societe D’Equipments Internationaux of Nigeria to a South African arms company, Cerberus Risk Solutions, for the procurement of another batch of arms. The National Security Adviser, Sambo Dasuki, who signed off on the first deal, said the arms deal was conducted legally. He reminded the South Africa government that Nigerian has provided favourable environment for South African companies such as MTN and DSTV to thrive unhindered. He said he expected the South African government to “reciprocate the noble gesture” by releasing the money. for More news updates contact: www.ournewspoint.com email: news@ournewspoint.com BBM pin: 7F02DD8A BBM Channel Pin: C003D1E9B whatsapp: +2347065964200 facebook: http://www.fb.com/ournewspoint twitter: http://www.twitter.com/ournewspoint |

Chairman, you no look like 20 o...lol. Dolphins FC of Port Harcourt striker and 2014 Federation MVP, Emem Eduok has been dismissed from the national U23 camp for age falsification. According to the management of the U23 players, Emem's passport states he was born January 31, 1994 while his club license shows he was born in 1991. Media officer of the U23, Timi Ebikagboro while speaking on his dismissal said Emem has to go and sort out his age irregularities with his club. He came with a passport showing he is 20 but his records in the LMC shows he is 23. If you watch the Federation Cup final on Super Sport, his age was shown as 23. The license his club sent to the NFF is 23. So, it’s left for him and his club to sort out the issue. It’s assumed that the player signed the LMC document, which stated that the player agreed to all the information in the document,” he said. Meanwhile Emem maintains he is 20 and not 23 "I’m 20 and not 23. I was born in 1994, so I don’t know where the club got their information from. I played at the U-20 World Cup last year, with the age on my passport. That is my age and that is what FIFA knows” he said. for More news updates, visit www.ournewspoint.com |

A 28-year-old woman, Mirian Ndubuisi, was on Tuesday arraigned in an Ikeja Magistrates’ Court, Lagos, for a vicious assault on a co-tenant. The accused, a business woman who resides at 18, Odolowu St., Ijesha, Lagos State, is facing a two count of conspiracy and aggravated assault. She pleaded not guilty to the charge preferred against her. The prosecutor, ASP Eranus Nnamonu, told the court that the defendant committed the offence on October 12 at their residence. Nnamonu said that a fight broke out between the two tenants who had previously been at loggerheads. He said the complainant had alleged that the defendant’s attempt to eliminate him had resulted in the death of the defendant’s son. “A scuffle ensued between Ndubusi and the complainant, one Phillip Eze, over his declaration in church while giving a testimony that the complainant’s son death was as a result of her intentions toward him. “During the fight, Ndubusi bit one of Eze’s arms and his scrotum, leaving deep lacerations there ,” Nnamonu said. He said that the offences contravened Sections 171 and 409 of the Criminal Law of Lagos State, 2011. The News Agency of Nigeria reports that Section 171 of the law prescribes that any person who unlawfully assaults another and thereby does him harm is guilty of a felony and is liable to imprisonment for three years. The Magistrate, Mrs A.R. Onilogbo, admitted the defendant to bail in the sum of N100,000 with two sureties in like sum and adjourned the matter to December 11 for mention. visit www.ournewspoint.com for news update |
