What the government did is unconstitutional on Nnamdi Kanu case, it's an act of executive rascality and contempt for the rule of law. The Court of Appeal had clearly discharged and acquitted Nnamdi Kanu, yet instead of complying, the government filed a stay of execution and kept him in custody, which is a deliberate defiance of judicial authority.

A stay of execution doesn’t apply to a judgment of discharge and acquittal, because there’s nothing left to “stay” once a person has been freed by the court the only lawful step would have been immediate release.
So, he's continued detention remains illegal
