CrimeEvans: Kidnapper's Judgement Adjourned by pitlaterine(op): 5:02pm On Aug 29, 2017
A Lagos Division of the Federal High Court has fixed September 5 to hear arguments from counsel on why he should not deliver judgment on the fundamental rights application filed by Chukwudumeme Onwuamadike, popularly known as Evans.

Justice Abdulaziz Anka had earlier fixed today, August 29, for judgment but said he would not deliver judgment because there are pending applications before him. The judgment date was adjourned after the police brought applications seeking to set aside the delivering of the judgment, Premium Times reports.

"The question is, can I still go ahead when there are still motions before me and the fact that the applicant refused service?" Mr. Anka asked. "I’ve read the case file, I’ve seen the processes attached inclusive of a court order."

Alleged kidnapper Evans won the first round of his court battle as the Federal High Court sitting in Lagos dismissed the objections of the Lagos state Police Commissioner and the Special Anti-Robbery Squad on August 16 and ruled that the fundamental rights enforcement suit filed by Evans can proceed.

The judge had adjourned on August 16 to deliver a judgment on the fundamental rights application filed by "Evans" Onwuamadike. The first and second respondents, the Inspector General of Police and the Nigeria Police Force, did not send a legal representative throughout the hearing. But the Commissioner of Police in Lagos State and the Special Anti-Robbery Squad, the third and fourth respondents, were represented by lawyers who argued that their colleagues were not served the court process.

On Tuesday, David Igbodo, a lawyer, announced appearance for the first and second respondents, saying they did not receive any court process in Abuja. He said they had filed a motion before the judge making five applications, including an order seeking to set aside the ruling on August 16 as well as the adjournment for judgment without hearing his clients.

Mr. Igbodo, a Commissioner of Police (Legal) also said the police was seeking an order to set aside the purported application and submission made by Henry Obiazi without authority, and an order granting leave to the first and second respondents to file their counter affidavits.

Mr. Igbodo said: "Parties have been served though the applicant, I was told, refused to accept service. The application is before your lordship, it’s our belief that this court is a court of justice."

Evans' lawyer, Mr. Olukoya Ogungbeje, in his response said he never received any application from the police, insisting that the last adjournment had been for judgment and not to entertain fresh applications.

"It is our strong view to the learned counsel to the first and second respondents that his application is calculated to arrest the judgment of the court," said Mr. Ogungbeje.

Premium Times report that after the judge said he would be unable to go ahead with the judgment until the pending applications before him are heard, the lawyers from both sides could not agree on the next date for adjournment. Mr. Igbodo said he would be traveling to China on official assignment next week and requested for a date in the last week of September.

"This matter is very important to the IG (Inspector General). Before that 25th (of September, the applicant will be charged to court," Mr. Igbodo added.

But Mr. Ogungbeje disagreed, insisting that his client needs to know his fate as soon as possible.

The judge stood down the matter for both parties to agree on a date, and later adjourned to September 5 to hear arguments.

PoliticsNigerian Government Approves Whistle Blowing Against Human Traffickers by pitlaterine(op): 9:44am On Aug 23, 2017
Nigerian government has approved a whistle blowing policy for the National Agency for the Prohibition of Trafficking in Persons (NAPTIP).

Head of Public Relations, Josiah Emerole, in a statement, said that the approval was conveyed to NAPTIP’s Director-General, Ms Julie Okah-Donli, by the Minister of Justice, Mr Abubakar Malami (SAN).

He noted that the inclusion of human trafficking cases into the whistle blowing policy had remained one of the cardinal plans of the new director-general since she assumed office late April.

The spokesperson said that it became imperative because many cases of human trafficking had not been tackled because those who were aware of such incidences never reported to NAPTIP and other relevant agencies.

“The approval is contained in a letter dated 7th August, 2017, and addressed to the Director-General of NAPTIP.

“The Director (Solicitors Department) Z. S Adevanju, conveyed the approval on behalf of the Hon. Attorney-General and Minister of Justice to Okah-Donli.

“It stated that the approval was given based on the fact that the request by NAPTIP for the inclusion of Human Trafficking cases in the whistle blowing policy of the present administration was not in conflict with any extant law,” he stated.

Emerole noted that with the latest development, anybody can now give verifiable information on any case of human trafficking, including on the assets of human traffickers for possible confiscation through legal proceedings.

He quoted the director-general as expressing excitement on the development, adding that with the approval, the coast has become clearer for informants to come up with verifiable information on traffickers.

PoliticsTwitter Senator, Ben Bruce To Face Recall From National Assembly by pitlaterine(op): 8:37am On Aug 23, 2017
Constituents, mainly students, from the Bayelsa East Senatorial District, have threatened to recall the Senator representing them in the National Assembly, Mr. Ben Bruce.

The aggrieved constituents accused the “common sense” senator of neglecting them and having no plans for his constituency, which comprises Nembe, Brass and Ogbia local government areas, Bayelsa State.

Leaders of student bodies for the three local governments made their grievances known yesterday in a statement.

The statement was signed by Samuel Tari (Nembe), Ambrose Joseph (Brass) and Mark John (Ogbia).

They lamented that the senator was not in good relationship with his people and had continued to shy away from his constitutional responsibilities.

Besides, they said since he was elected, Bruce had not visited his people.

They said: “Since Bruce became a senator, he has failed to look into the basic needs and challenges currently bedeviling the East Senatorial District, such as education, as most of our students cannot access good quality education.

“He has failed to attract a single project to the district in terms of infrastructures, roads and others. He has continuously and deliberately ignored efforts by the people to create a working relationship that will bring out purposeful leadership for our people.

“He is yet to fulfil any of his campaign promises; painfully, he is an Abuja-based senator. He refuses to visit his constituency, except only once when he visited his hometown and couldn’t even stay for up to four hours.

“Sincerely, we are tired, other places are enjoying the benefits that come from having a national representative. Our case has been a curse rather than a blessing. We are just like a district without a senator. This is why we are intended to change that narrative”.

The student leaders gave the senator a 10-day ultimatum, to amend his ways or face consistent protest and the recall process.

“We are, hereby, giving him an ultimatum of 10 days, starting from 21st August. If he fails to meet with us, we shall take our protest to the National Assembly.

“We will mobilise all the students, our mothers and our fathers. We will initiate his recall process. Our people deserve a better treatment from him. We request to have a town hall meeting,”‎ they said.

PoliticsSaraki Reacts To The Arrest Of Kwara Civil Servant For Criticizing Him by pitlaterine(op): 2:18pm On Jul 28, 2017
The Senate President, Bukola Saraki, has reacted to social media attacks on his personality by a primary school teacher in Kwara state, Baba Biodun.

Biodun was arraigned yesterday before a Magistrate Court in Ilorin presided over by Ahmad Dasuki for allegedly calling Saraki a ‘Bastard’ and making inciting posts on Facebook against him.

This was consequent to a suit filed by Jimoh Adesina, who is a chieftain of the All Progressives Congress (APC) in the state.

Following Biodun’s arraignment, it was rumoured in some quarters that he has been relieved of his appointment in the state civil service.

However, the Senate President who denied having any hand in Biodun’s arraignment also dismissed the sack rumours.

He said on Friday morning: “My attention has just been drawn to an entirely untrue story about a civil servant being sacked for criticizing me.

“As a public servant who has subjected me to the service of my country, I face criticism every day from many quarters.

“However, this does not deter me. It never has. I learn from the constructive criticisms, and continue to work with my colleagues in the Senate to pass our legislative agenda for all Nigerians.

“I use social media. As such, I am a firm believer in freedom of speech and the use of social media to air out views.

“Throughout my time in public office, I have never attempted to stifle anyone’s freedom to speak his/her mind. This can be said of my time as a Governor, as a first time Senator, and now as the Senate President. This will not change.

CrimeNigerian Arrested In Cyprus For Killing A 21-year-old In An Accident by pitlaterine(op): 6:07pm On Jul 27, 2017
Franklin Onyedika Onoura, a Nigerian student in Cyprus who was arrested by Turkish Cypriot police on Sunday for killing a 21-year-old Cypriot in an accident has been detained for three days on the order of a Turkish Cypriot judge after he appeared in a Nicosia Accident Court on Monday.

Onyedika was arrested on Sunday by police after he hit a pedestrian who died on the spot at the Nicosia - Famagusta express road, with a rented vehicle.

According to police report, the victim, a Turkish Cypriot identified as Barış Hakan, 21 was passing by on a pedestrian crossing, near the Yonca Crossing on the Famagusta main road in the early hours of Sunday morning when he met his untimely end.

Also detained in prison and charged to court is Sam Valentine Okolie, who rented the vehicle with which Onyedika was driving in at the time of the incident, although he was not authorized to use the car.

Onyedika had initially fled the accident scene with the damaged vehicle but returned to the scene on foot after hiding the vehicle in the garden of a drug factory about a mile from the scene, and was caught by the police due to his suspicious behavior.

Judge Cenkay İnan presided over the case while prosecutor Ayşe Kaymak Şadi stood on behalf of the TRNC Prosecutor's Office. The presiding judge listened to police witness, sergeant Yasar Arkıner, who worked as a witness in the Traffic Branch of the Nicosia Police Department.

Arkıner stated that the indictee Franklin Onyedika Onoura caused the death as a result of his carelessness.

The police witness also indicted Sam Valentine Okolie who hired the rented car to Onyedika even though he had no valid license in the TRNC.

Arkıner stated that the suspects gave voluntary testimony and demanded that he be kept under arrest, stating that statements should be taken and camera images be examined.

Judge Cenkay İnan then ordered Onyedika to remain in police custody for three days while investigation continues.

PoliticsAPC Is A Copy Cat Party, They Copied PDP - Makarfi by pitlaterine(op): 11:41am On Jul 27, 2017
Chairman of the National Caretaker Committee (NCC) of the Peoples’ Democratic Party (PDP), Ahmed Makarfi, has described the ruling All Progressives Congress (APC) as a copy cat party.

Makarfi took this swipe at the APC when former Speakers of PDP-controlled State Houses of Assembly paid him a solidarity visit at the party’s National Secretariat in Abuja.

He said that until the PDP held its expanded caucus meeting among others, the APC never remembered there was the need to bring its members together to chart the way forward.

“We have chosen to be a greater party and even with our crises we are never afraid to hold meetings.

“Within two days, we had expended caucus meeting and that meeting was like a market place as even those who were not members of the party came.

“When we had the caucus meeting, we had the Board of Trustees (BoT) meeting too and the government wanted to copy.

“They had meeting with the Vice President and some governors were threatening to leave the party because it was the first meeting in over a year or so,” Makarfi said.

PoliticsLASG Gives Quit Notice To Owners Of Properties Blocking Drainage Channels by pitlaterine(op): 4:21pm On Jul 23, 2017
…To Reestablish Drainage Right Of Way

In a bid to mitigate the incidence of flooding, the Lagos State Government on Sunday ordered owners of properties erected on drainage channels and impeding the free-flow of water to immediately vacate or risk being removed.

The Government, in a statement signed by the Commissioner for the Environment, Dr. Babatunde Adejare, expressed dismay that the lawless activities of some people was constantly putting the lives and property of residents at risk.

He listed some of the areas where properties were erected on drainage channels to include Illubirin, Dolphin Estate, Osborne Foreshore Estate, Ikoyi, Osapa London, Ikota, Ogombo, Lekki, among others, noting that the massive investment of public fund into drainage clearing and de-silting had been compromised by structures hindering the free-flow of water.

The Commissioner said the State Government was seriously concerned that man-made causes, particularly impediment of free-flow of storm water through indiscriminate erection of buildings on drainage alignments/ right of way and water courses, have played a major role in the recent experience of flooding in the State.

“Therefore, it is now of paramount importance that owners of buildings or structures impeding the free-flow of storm water, wherever they exist in the State, are advised to voluntarily quit forthwith in the overriding public interest or risk being removed by the State Government as no responsible government will allow the interest of a few to jeopardise the wellness and wellbeing of the generality of its people.

“In view of the grievous consequences of compromising drainage right of way and alignment, Lagosians are hereby warned to henceforth refrain from this illegal act, report perpetrators and cooperate with the Lagos State Government in its bid to achieve a flood-free, clean and livable State,” Adejare said.

The Commissioner also disclosed that the State Government has resolved to reestablish the right of way of drainage infrastructure across the State also to stem the tide of flooding.

He said the decision became necessary to enhance the ability of the drainage channels to effectively discharge storm water into the rivers, lagoon and other water bodies and relieve Lagosians of the incidence of flood.

“For the avoidance of doubt, Lagosians are once again reminded that the right of way for primary unlined (without concrete) channel is 25 meters and 15 meters for primary lined (with concrete) channel, while the right of way for secondary/connector channel is seven meters. The right of way for tertiary channel is three meters from the fence of the house.

“Primary channels such as canals are those emptying directly into the river, lagoons and other water bodies, while secondary/connector channels connect water from channels in the frontage of the house (tertiary channels) to the primary channel,” the Commissioner said.
