Your friend shouldn't have agree with 30% forfeiture in the agreement, well the deed has already been done.

1. Convince one of his friends/associate to complete the payment and sell the plot later (share profit equally)

2. If interest of 1.5m loan isn't 450k then obtain the loan and complete the payment.


NB: ensure that 3m plot is worth buying at that rate

Losing 450k is so painful in this hard times ,why not he should go ahead and pay the 3m and know that he have something in hand than losing everything.

But in another suggestion I will still advise him to forget about the 450k and maybe find a different plots somewhere else.

Please I need your oppion for a friend on what to do.Even me self I am still not very sure of the advice I gave him

A friend of mine subscribed to buy a plot of land in one of those estate agents in Port Harcourt for 2.5m . This happened around 2019 before the covid-19 pandemic,he was expected to pay installmentally for one year.But unfortunately he was able to pay 1.5m before the covid-19 pandemic which made him to loss his job.Ever since he lost his job, he had not been able to make any further payment to the company.Now has gotten a new job, with pay around 130k.

Last week , he went to visit the Estate agent to see how he could resume payment, But he got the shock of his life when they told that the land has been sold to another client.They said they had to sell it to another client becuase he didnt meet up with the agreement.On getteing to know, my friend requested that his money be refunded.They said he would have to loss 30% of the total amount he paid i.e 450k out of the 1.5m naira.Now , there is a document showing that he would loss 30% of the said amount if he didnt meet up with the payment.That means he cannot go the legal way.

However, they gave him other options of subscribing to other available plots in the estate if he chosed to contiune.But with higher amount diffferent from the 2.5m per plot initially agreed . The new amout is 3.5m per plot and he is expected to pay before the ending of March next year.They however said, they would reduce the amount to 3m since he is an existing customer.

Now here lies his problem,he finds it hard to loss 450k from the amount he paid , and secondly, subscribing to a new plot means he would have to pay 300k per month for the next 5months starting from this month November.His salary is barely 130k per month after necessary deductions.Though he could sometimes get money from other means aside his job but this is not 100% guaranteed .

I advised him to let go off the 450k since he's not sure of meeting up with the payment duration.Though my other friend advised that he should give it a shot since no one knows what tomorrow holds.
