A 33-year-old man, Emeka Ezeh from Enugu state Ngeria , was on Thursday 20th July, 2017 arraigned in an Awka Chief Magistrates' Court in Anambra State for having same sex with one Mr Orajiaka Melford Chikezie from Onisha who is now at large.
They were caught in the act, a practice which had been going on for months in Orajiaka Melford Chikezie's room in Onitsha.
The accused, a painter, who resides at 17, Akinjobi, Moricas, Street Enugu, was charged and sentence Under the Criminal Code of 1990. Nigeria provides for a 14-year prison sentence for homosexual acts involving either men or women. In addition, the misleadingly named Same-Sex Marriage (Prohibition) Act, passed in 2013 and enacted in 2014, provides for prison sentences of 10 years for Nigerians belonging to a gay organization, supporting same-sex marriages, or displaying same-sex affection in public. It also calls for up to 14 years in prison for any Nigerian who marries a member of the same sex.
The Prosecutor, Insp Clifford Ozor, told the court that the offences were committed on the 25th December, 2015 at Onitsha. In delivering the judgment by chief magistrate Ekoma Abiola, it has also been learnt that Oraijiaka Melford who is an accomplice to the crime has ran away from the country.
Every effort is being put in place to arrest him.
