Breaking: Lagos State Govt through @LagosMoj has advised the Lagos State @PoliceNG Command to charge Baba Ijesha to Court using (5) sections under the Criminal Law of Lagos State. The punishments range from 3, 7, 14 years and life sentences if found guilty.

PRESS STATEMENT ON THE CASE OF COMMISSIONER OF POLICE V OLANREWAJU JAMES (BABA IJESHA)

It would be recalled that the Nigeria Police Force arrested Mr. Olanrewaju James (also referred to as Baba Ijesha) on account of various sexual abuse allegations. On the 30th of April, 2021, the Police forwarded the case file of COP v Olanrewaju James to the Directorate of Public Prosecutions (DPP) for legal advise.

After due consideration of the facts in the case file, the Directorate of Public Prosecutions issued legal advise on the 4th of May, 2021, which is to the effect that a prima facie case has been disclosed against Mr. Olanrewaju James and recommended he be charged under the following provisions of the CriminalsLaw of Lagos State, 2015:

(1)Section 135, Indecent Treatment of a child- punishable by 7 years imprisonment, (2)Section 137- Defilement of a Child-, punishable by life imprisonment, (3) Section 261- Sexual Assault by Penetration- punishable by life imprisonment, (4)Section 262- Attempted Sexual Assault by Penetration, punishable by 14 years imprisonment and (5)Section 263, Sexual Assault- punishable by 3 years imprisonment.
Whilst the State would ensure that Mr. Olanrewaju James's rights as enshrined in the Constitution are upheld, the Ministry of Justice would not relent in its efforts in ensuring that whoever sexually abuses any resident of Lagos State is speedily brought to book.

It is instructive to note that the Lagos State Ministry of justice has been consistent in it's efforts in protecting the vulnerable in our society and since the establishment of the Domestic and Sexual Violence Response Team in 2014, it has till date prosecuted over 800 cases of Sexual and Domestic offenses.
The Attorney-General hereby assures Lagosians and indeed Nigerians that in accordance with the DPP's advise, charges would be filed accordingly.

A lot of adults we see today have had their childhood stolen from them cause one shameless person abused them sexually.

One news will soon hit front page about a man who has been abusing three of his underaged daughters.

Hmmmn.

Charges 2,3,4 will be difficult to prove in court especially if all they have as evidence is the video plus his purported confession. (I didnt hear him confess to defilement)

Charges 1 and 5 should be a shoo in conviction. Whether he will be given the upper limit of the sentences and whether the terms will run concurrently or consecutively is another hurdle. I pray the case is fast so that we can get him off the streets. He is definitely a danger to the society.

Kind of wondering on the charges 2 and 3 though. I thought the first DPP opinion is that it is Statute barred? Or is it that there is a new defilement?

EDIT
I just read a legal write up on Section 218 of the criminal code which sexual assaults and defilement of minors. It is grossly evident that our legislators are absolutely not doing a good job if such a law can exist in its current form.

1. Defilement only applies when the child is below 13years(11years in some state). Action must commence within 2 months of the offender can no longer be prosecuted.

2. If the child is above 13 but less than 16, unlawful carnal knowledge only fetches 2years with or without caning.

There are so many outdated stuffs in the Act except lawyers in the house can elaborate on how DPP got the terms above for a 14year old

Many thanks to Lifestone for pointing this out. The Section 218 above is from the criminal code. The DPP statement was sourced from the Lagos state criminal laws of 2015 and is as spelt out in the DPP write up. It is silent on statute of limitation though.

@lifestone is there anything of statute of limitation in relation to such cases?

The guy will get away with defilement and attempted assault penetration, which are the grevious charges, the other charges will only fetch between 3 to 7 years at most.
