FIRS Affirms Position On VAT Collection: Maintain Status Quo Till Final Determination Of The Matter

_Urges Taxpayers Not To Panic_

The Federal Inland Revenue Service (FIRS) has urged taxpayers not to panic over the recent court ruling by the Federal High Court sitting in Port Harcourt which dismissed its motion for stay of execution of the judgment that Rivers State can collect Value Added Taxes from its resident, stating that “until the Court of Appeal, or even the Supreme Court, determines the matter, taxpayers are required to continue to comply with their Value Added Tax (VAT) obligations within the status quo framework.”

The FIRS disclosed this in a statement by the Special Assistant to the Chairman of the FIRS on Media and Communications, Johannes Wojuola.

“The FIRS having lodged, in the Court of Appeal, both an appeal against the decision of the Federal High Court sitting in Rivers State in Suit No. FHC/PH/CS/149/2020, Attorney General of Rivers State Vs Federal Inland Revenue Service, and an injunction pending appeal of the said judgement, assures taxpayers that there is no cause for alarm.

“The Federal High Court ruling should not breed any confusion as to the obligations of taxpayers. Taxpayers must continue to comply with the Value Added Tax Act pending the final determination of appeal.

“Taxpayers must continue to honour their tax obligations under the VAT Act. Failure to do this would put them on a collision course with the law”, the statement said.

“For the avoidance of doubt, records of appeal have been transmitted to the appellate court. The Service is confident that, given the extant laws, the arguments and case put forward, it will earn a favoured judgment at the appellate court”, the statement concluded.

Let each state collect their tax.

Kano state doesn't like alcohol but would get tax collected from Hero in Anambra and trophy in Ogun state and still go ahead ahead to destroy their products in Kano

Let all state collect their tax so that Kano can forfeit tax generated from beer since they banned it's consumption

You have not applied for a stay of execution yet, and even if applied, it hasn't been granted. Why ask people to maintain status quo? As far as I'm concerned, status quo in this matter is the decision of the Federal High court, anything besides that is null and void until the appeal court decides otherwise. Whoever gave out this press release should be job hunting by tomorrow morning.

FIRS SHOULD STFU & MAINTAIN THE PRONOUNCEMENT OF THE COURT.
The entire south support the collection of VAT by the states nationwide.
Let the Northern people leave Terrorism alone & start thinking of how to create a peaceful environment in their region for IGR to be generated because they can't be using VAT gotten from Beer/Liquor in the south to build mosques in the North & also to import terrorists from Niger, Mali & sub sahara Africa into Nigeria for Jihad.

They cant win. Federal VAT is unconstitutional. In fact many federal Government levies are unconstitutional (Witholding tax, education levy etc etc). This is the problem they created for themselves when they copied the American constitution. There is no VAT in America, only state sales taxes which are determined and collected by states.

If Wike wins this (and he should because the law is clear), this is a game changer bigger than the way Fashola changed the narrative for Gorvernors and performance.

it is very clear The only taxes the Federal government can impose are:

"58. Stamp duties

59. Taxation of incomes, profits and capital gains, except as otherwise prescribed by this Constitution."

VAT is not a stamp duty, income, profit or capital gain tax. it is a consumption tax!!!!

Section 7 of the concurrent list specifically states AGAIN what type of taxes the national assembly can legislate upon:

7. In the exercise of its powers to impose any tax or duty on -

(a) capital gains, incomes or profits or persons other than companies; and

(b) documents or transactions by way of stamp duties.

the National Assembly may, subject to such conditions as it may prescribe, provide that the collection of any such tax or duty or the administration of the law imposing it shall be carried out by the Government of a State or other authority of a State.
