Exactly. There should be serious consequences starting from men who patronize hotels filled with underage girls to the senators using religion as a cover and to randy men who prey on helpless underage girls.

The only saving grace and this is a rare one is when the girl in question lies about her age and she is kind enough to say it in the court that indeed she lied to you...then you can have the affirmative defense but not if the lady don’t actually appear to the jury as someone about whom a reasonable mistake might be made.


Say for instance a lady is very sexually mature in looks and she lied to you that she is 18 when she is actually younger, if you can prove that she lied and she truly looks way more mature sexually then you just might get lucky.
The law actually says it makes no difference wether she lied or not. The only leniency is in age difference - say, you are 20 and she is 17, you'll still taste jail though.

I am not doubting what the law states but In some countries and some states in U.S, defendants can raise a defence to statutory rape based on a reasonable mistake as to a partner's age but usually only in limited circumstances.

Do you think the justice system is that draconian so much that they will just send someone to jail when it is proved that the victim lied about her age either verbal or perhaps forgery of age certificate?

Even in Baba ijesha's case, with a sound lawyer he will walk free. They only need to leverage on the lacuna in the local law in Nigeria that has the discrepancies of age of consent to be 11 or 18 cos the girl is 14 at the moment and the present Law in Nigeria didn't expressly provide that the age of consent in Nigeria is 18, ..

They will also need to prove that there was no force and the girl actually consented or let me use the English some olodos like Sterope and Pataricatering will process easily...that she approved of whatever was done to her by baba ijesha without any force used which could change the narrative.

A smart Lawyer will do the magic for him.

If you meticulously go tru my post you will see where I stated clearly that some states have a defence against error of age. Texas is just a state in U.S and what you quoted is about Texas but we are not in Texas, this is Naija so we need to apply the laws here.

Further more, you are still mistaken AGE OF CONSENT according to the Federal constitution which reigns supreme over state laws.

Until 2015 the age of consent in Nigeria was 18. Now it stands at 11 but as I wrote, there is a clause in the constitution that has been in contention and till this day, the lacuna still exists.

Don't get me wrong, I'm totally against the act but I'm just acting the Devils advocate now cos no matter how bad it is, his lawyers can't just let them sentence him without putting up a defence and if I'm his lawyer I will tell him to plead guilty as regards what happened in the video and not before that then we will argue the rest.

Hmm. I wonder now too. I'm sure it'll have a social and cultural origin. It literally means ''a returnee from abroad.'' So maybe our parents then actually used it as some form of prestige phrase. He just came back from Yankee, fresh from London, etc., and then it turned to a proper name. That's the namely meaning.

Then the other meaning (which could be degrading as well) is the second-hand one and is used for things, objects...

You are obviously reading my post to respond but not to understand. This is the lacuna I wrote about. A lacuna is series of argument as a result of an ommision or lack of clarity in a law or constitution.

Till date it is still unresolved and while some are arguing that the age of consent is 11, some are saying it is 18.

Please let's try to understand each other.

I rest my case on this matter... Let us see how it plays out.

Yes the minor was defiled we know, but by who exactly? Can you actually prove that it was Baba ijesha that actually difiled her, that's the question, and if I was the lawyer to d defendant,that'll be my case. In the clip, he didn't penetrate, he only corrased, corrasing isn't what this case is about, it's about tj defilement. Mind you am not in support of what Baba Ijesha did, am only speaking from a rational point of view. The girl is a young girl that may have been bleeping since God knows when, so how do you prove it was done by him without any DNA evidence. If he's for a good lawyer he's walking out a free man.

My brother you are the one making easily disproved statements. First you said "Justice system can't be so draconian...", then you said there was no eyewitness.

As for age of consent, my brother the law is VERY CLEAR that AoC is 18. The courts are just pretending about lacuna. The law was passed in 2015. You can't find any prominent person or NGO since 2015 who says AoC is 11. There'd be outrage.
There is nothing there for a lawyer to interprete, unless they are just being mischievous.
I DARE ANY LAWYER TO INTERPRET THE BELOW TO MEAN AoC IS 11.
(Note that the constitution defines "child" as any one below 18)
