If you looked at the issue and my second comment I was quite concerned but then it is what it is, forget about whatever CBN directed, bail is free, an accused is innocent until found guilty, a suspect is not suposed to be detained bla bla bla, you and I knows that these issues can take way more time to rectify, I had stated that especially if it is connected to another bank ATM sometimes the money would even be in your account but it would not be seen by you.

I'm not trying to sarcastic but the most important thing to her was her health which is quite a serious thing but even within the five days as stipulated by CBN, she could have died if her life was to be solely dependent on the money, let's look at justice from the perspective of mercy too.


Obviously there is a fundamental breach of contract, and the intent of the bank is malicious. This is so because the bank held the money for months. The essence of damages is to bring the injured party to the position he was at the beginning of the contract.
In sueing for damages the OP must be able to prove that negligence on the part of the bank resulted to some unfavorable medical condition (he that alleges must prove). If not, the court will instruct the bank to only pay the 2k with a nominal fee.
But if the OP can prove that a fundamental organ in her system failed because of her inability to receive the 2k, then AM IN.

I don't care about all those. I need legal groundstanding if I can win the case.

My sister you are not alone. On 26th September I made a #6k PHED prepaid payment via my Eco Bank mobile app. I was debited but not given a token. Went to PHED and they confirmed they didn't get any detail from my bank. My bank keeps saying that it is hanging and they are working on reverting it. Since then, I have gone to the bank, filled form and chatted online with their customer agents for more than 30 times on a daily basis. The message I keep getting is, "the issue is currently receiving attention". This is November and nothing has happened. I threatened them with a lawsuit today but don't know how to go about it either.

Don't get jump into the case, it is quite dicey first of all, different system was involved and one of them being inanimate (Computer) which has no emotions or conceptualisation of contract, be that CBN maintained that bank should refund in 5 days, in this case, did your client die or develop the organ failure within 5 days.

What is the disease that she was having, is it acute or chronic, can the sickness lead to such organ failure after 5 days, whatever your arguments is, should take account of the fact that according to CBN everything being equal, the bank ought to refund the money within 5 days but as can be seen in this situation everything was not even being equal,

While at that if I'm defebding the bank I would still plead guilty and demand out of court settlement, which was the first thing I adviced earlier, the said lady is a customer of the bank and if you be the judge do you think my bank would be stupid enough to aid in the killing of our own customer. My lord I don't think my client here wants to kill their own client which our esteemed customer here is erroneously making it seem like, I would be most delighted if this honourable court may grant an out of court settlements so that we can first nurse her yo health as it seem she is obviously impacted

Someone sent you urgent 2K meanwhile you survived without it, a proof that the urgent 2K was not urgent afterall, go and fill the form in the bank, there is a process for it, your money would be returned to you in no time it was a technical error, the money had left your account and now hanging especially if you used an ATM not operated by your bank. I doubt you did cos they would have given you a form to fill and your money would have been reversed within a few working days if not immediately.

If you want the truth, you don't have a case here, not to talk of winning it.
Now you can think of more genuine ways to raise funds to pay that house rent wey don dey near or whatever is the reason for this your grand scheme

The OP said she solicited for fund to treat a medical challenge which the bank refused. If she can prove that the bank's refusal caused her both emotional and medical break down, then the court will compensate her more than the nominal fee, because the breach is fundamental. Infact the CBN will be joint in the suit, since it is the regulatory bank.

No you didn't get the situation, she went to withdraw from an ATM machine but she was debited without the money being dispensed, it happens atimes, it is not that the bank refused to give her the money.

She later went to bank to complain but myself from personal experience if the ATM is another bank ATM, it takes time becuase the two banks need a back and fort confirmation.

So while she can go to court, I don't see the reason, there is no contract that ATM machines MUST never malfunction.

Na d problem with the country be this. There is a lot of unnecessary frustration in the system. This kind of Avenue to find redress is accessible in foreign countries and that's the difference with them...that's why their service is topnotcth, because everybody is on their toes.
An injustice no matter how small should be nipped in the bud early. And if u can gove any reasonable suggestion to someone that is down, u should just keep shot

What are my chances if I sue them for damages? Write a mail to customer service department and copy consumer protection department cpd@cbn.gov.ng they will act fast on it though same happened to me 2 weeks ago 7k was debited.someone gave me d mail today and they assured me of getting my money.

I wish I could slap you for raising this topic … Do you think legal process is free or can you withstand the stress of going to court every time ? Even for 200k I can’t advise anyone to sue cos it takes time and money .
