The Court of Appeal sitting in Abuja has nullified the judgment of the FCT high court delivered on December 16, 2021, which affirmed Mainasara Sani’s faction as the All Progressives Congress (APC) executives in Sokoto State.

Three factions had been claiming leadership of the party in the state. The factions consist of the one loyal to a former governor of the state and current senator representing Sokoto South, Aliyu Wamakko; then that of former senator Isa Abubakar Gada, while the third favours a current House of Representative member, Hon Balarabe Salame, in conjunction with the speaker of the state’s House of Assembly.

The Thursday Court of Appeal judgement affirmed the Senator Aliyu Wamakko camp led by Alhaji Isa Achida as the authentic executives of the APC in the state.

The Wamakko camp had produced Isa Sadiq Achida as the state chairman of the party upon conclusion of its state congress, but the attorney general of the federation and minister of justice, Abubakar Malami, declared Mainasara Sani as the legitimate state chairman of the party in a state congress organised by the Senator Gada-led faction.

But delivering judgement on the matter yesterday, Justice Haruna Simon Tsammani nullified the judgement of the Abuja high court, stating that it had no jurisdiction to entertain a matter on an issue that happened in Sokoto State.

Justice Tsammani held that, “This court and the supreme had on many occasions made pronouncements on matters of jurisdiction. Bringing these kinds of cases, you are asking us to sit over our own judgement. We should know that where a matter happened, that is where it should be addressed.


“How can someone come all the way from Sokoto to Abuja on a matter that should be addressed there? It is all these kinds of arrangements we frown at, and even the Supreme Court frowns at. I also strike out the suit on the basis of lack of jurisdiction.

“Federal High Court, Abuja, has jurisdiction only on matters arising from Abuja. FCT high court has no jurisdiction to hear the matter. Any stake, including decision and judgement done at the high court, is nullity.”

Na on the note above, all the APC's defection matters go die....because the high courts that sack Umahi and those house of Rep members did so at Abuja..whereas, they have Federal High Courts at their jurisdiction where those matters happened grin grin

I have actually been waiting for a day a judge, a courageous one at that, will make a pronouncement that will shapen this arbitrariness as it concerns jurisdiction. Am not a lawyer but I have always known that jurisdiction has something to do with adjudication of matters. I am happy finally it has been explained that u can't have a crime or a matter in Enugu and run to Abuja court which will often play along d line of d ruling party at d center. Secundus at that time even has one judgement from Kebbi High Court or thereabouts.
With this also d case of lack of jurisdiction against Nnamdi Kanu case is gathering steam cos d Federal prosecutors have to establish d physical presence of Nnamdi Kanu within and around d shores of Nigeria when he committed d crimes

The underlined is wrong. I think it was an error from the editor. The Federal High Court has jurisdiction all over the Country. The judgement like that of Kano is apt.

I am not a lawyer, but lawyers have argued several times that Supreme court as ruled that you take matters in a particular location to the closest Federal High Court...I can't remember the legal terms.

That's why Federal High Courts are scattered all over Nigeria..bring the case closer to them to them

The Supreme Court didn't say that. I have read cases like this. The Supreme Court in very many decisions have insisted that the Federal High Court is one. It is only shared amongst States for administrative purposes.

When an issue comes up in Adamawa, it can be taken at the Federal High Court in Owerri. It is the Chief Judge who transfers the case to Yola if reason(s) deduced are concrete.

In this case, the FCT High Court is equivalent to a State High Court whose jurisdiction cannot exceed the territory of that State.

Has anyone observed that political cases (and injunction) in the south south axis are usually taken to federal high court Port Harcourt for determination?

I don't know why it's like that and the judges will assume jurisdiction. They would take the matter there today and judgement will follow within 24 hrs.

No. The Case of Kanu is a Case against the country Nigeria. Therefore, he can be tried anywhere within the territory of Nigeria.
