Clearing Agents Decry Customs’ Manual Valuation!

Clearing agents under the aegis of the Association of Nigerian Licensed Customs Agents (ANLCA) have lamented that despite the introduction of the centralized national database, Vehicle Registry (VREG) and Vehicle Identification Number (VIN) for easy verification of Customs duty on vehicles at seaports; operatives of the Nigeria Customs Service (NCS) still subject importers and freight agents to manual processes at Tin Can Island Command and the Ports and Terminal Multiservices Limited (PTML) Command of the service.

This was disclosed by the Vice President, ANLCA, Dr. Kayode Farinto in a chat with LEADERSHIP over the weekend.

Farinto who said the implementation of VIN is said to be targeted at reducing human interface between Customs and clearing agents noted that Customs officers at Tin Can and PTML still subject freight agents to manual valuation.

He said, “VIN was introduced by Customs on January 1, 2022. VIN gives Customs an opportunity to have uniform value on the importation of vehicles when they are the same year, the same product and same capacity,” he said.



He, however, observed that there hasn’t been a Customs circular to sensitize the trading public that Customs has started the utilization of VIN.

According to Farinto whonis also the spokesperson of Shippers’ Association of Lagos State (SALS), the VREG platform has also ushered in novel challenges with the server unable to generate the VREG in the last three weeks.

His words, “The server has been down and it could be down for another 4-5days. Nobody is addressing freight forwarders from Customs as they say it’s not their making. VREG is domiciled in the Federal Ministry of Finance and the issue is believed to be between the consortium and the Ministry.”


“It is very unfortunate that we are talking about trade facilitation and ease of doing business, yet it takes a minimum of 4 days to generate VREG to evacuate a vehicle. Most times, you make the payment and the status doesn’t change. Consequently, you’ll not be able to migrate to the NCS portal to generate the VIN that was introduced in January.”

While Farinto admonished the Minister of Finance, Mrs. Zainab Ahmed to look into the issues affecting VREG in order to simplify it and make the process seamless, he lamented that a lot of people are paying unnecessary demurrage and storage charges since the introduction of VREG.

“I believe that the sector doesn’t need VREG because it seems to be another means to extort importers. If the government wants data of vehicles cleared legitimately from the ports, all they need to do is to liase with the NCS. When experts posit that Nigerian seaports are bedeviled by numerous charges, this VREG is another issue that validates such assertion,” he stressed.

Farinto also asserted that findings on the data in the Customs portal, with regards to duties on vehicles, show that the figures are very outrageous.

Stating that the rates negate the principles of transaction value, he argued that the trading community has a legitimate right to ask questions on the mode of deriving Customs duties.

“We aren’t in a military era, so when I get the value as a freight agent, I should be able to ask how that value was derived. The World Customs Organization (WCO) and World Trade Organization (WTO) have said that Customs formations must make their operations open. Traders and the trading public should know how these things are done,” he posited.

He also warned that the federal government’s propensity to prioritize only revenue generation from the maritime and port sector would kill legitimate port business, cause inflation and heighten land border smuggling as importers seek alternatives to the nation’s overlevied seaports.

Agents launch indemnity to halt detention by Custom.

Incessant arrest and prosecution of clearing agents by the Nigeria Customs Service (NCS) over importation of illicit drugs, arms and ammunition, have pushed the Association of Nigeria Licensed Customs Agents (ANLCA) to introduce indemnity form to its members.

The step is being taken in order to proctect genuine customs agent and freight forwarders. Its National Vice President, Dr. Kayode Farinto, noted that importation of offensive items, including psychotropic substances like tramadol, arms and ammunition, among others, was increasing in the ports.

He explained in Lagos that the first person to be arrested was the customs broker, who did the clearing of the consignment. Farinto stressed that the development had assumed a worrisome dimension, saying that the association had advised members at various fora to go extra mile to protect themselves and their agencies.

The vice president said that the association was ready to protect any freight forwarder, who issued indemnity to his customer and was not practically culpable. He advised genuine agents not to impersonate importer by putting their names on the consignment, saying such person would expose himself and not be protected.

Also, Farinto urged agents to notarise their indemnity forms, noting that any document notarised had become legal and acceptable document anywhere in the world. He said: “I have come out with an indemnity form; it is going to serve as indemnity between the agency which is the indemnitee and the importer who is the indemnifier that is giving you the job.

The indemnitee desires protection against any personal liability, claim suit, non declaration of actual content in the cargo or any false declaration.

“Note that your bill of lading with number (you state the number on the bill of lading) is said to contain your name and the content of the consignment as well as where any psychotropicy, illicit drugs or any offensive goods are found. We shall not be culpable. “The indemnitee wishes to minimise any hardship the indemnitee might suffer as a result of any personal liability claim. The indemnitee is a member of the Association of Nigeria Licensed Customs Agents and shall be protected by them.” Fairnto noted that where any other thing was found in that container on signing the indemnity, the agent would not be the first person to be punished. According to him, many agents were suffering in silence and were being punished. He added: “I have it on record, even last two weeks where these agents, who are clearing a container were the first ones that were arrested.

But the moment you have this indemnity, all you need to do is to go extra mile and notarized it for it to become a public document or a legal document. When you notarized it, it is stamped, it is approved.

Then, if any offensive item is found in the consignment, you shall not be culpable. “I am talking about genuine agents and genuine freight forwarders. It has its purpose and we need to enumerate that. One, we are likely to migrate to authorised economic operators.

The moment your agency is being profiled on a daily or monthly or yearly basis and you are found to be wanting, customs may not allow you to migrate to the status of economic operator.

Customs bans clearing of pharmaceuticals, old vehicles at Tin Can port.

The Tin Can Island Command of the Nigeria Customs Service (NCS) has barred importers and agents from clearing pharmaceutical products and overage used vehicles imported through the Tin Can Island Port Complex, findings by SHIPS & PORTS has revealed.

Confirming the development, spokesman of the command, Uche Ejesieme, said the Customs headquarters recently issued a circular stopping the importation of pharmaceutical items through the port. He said the content of the circular has been brought to the attention of relevant stakeholders.

“Yes, it is true. A circular has been passed stating that pharmaceuticals would not be allowed at Tin Can Island Port. It is an extant law that is still standing till today. The law stated that Apapa port and the international airport are the only places where pharmaceuticals can be allowed to come.

“Regarding overage vehicles, the Comptroller’s stand has been made known to the clearing agents. No overage vehicles would be allowed at the port,” Ejesieme said.

However, freight forwarders at the port have kicked against the ban, describing it as “sudden”.

Speaking with SHIPS & PORTS, the National Secretary of the Association of Registered Freight Forwarders in Nigeria, (AREFFN), Frank Obiezekie said the ban was being implemented by the new comptroller of the command, Olakunle Oloyede, without ample notice to freight forwarders.

He said the action could lead to another round of protest by freight forwarders. Recall that freight forwarders last month embarked on a prolonged protest against the implementation of a new valuation system for imported vehicles based on the vehicle identity number (VIN). They suspended the protest after the Customs management suspended the implementation of the controversial policy for one month.

“It came to our notice recently that the new command controller gave a directive that old vehicles and pharmaceuticals would not be accepted at Tin Can Island port henceforth.

“When asked why the sudden policy, he said it is a policy that ought to have been implemented by previous controllers but because of unidentified reasons, they left it unimplemented.

“No one is against that implementation but what we are clamoring for is that they should let agents clear their already imported pharmaceuticals and overage vehicles. And one of the reasons why we go for overage vehicles is because they are affordable. Any vehicle above 2014 upward attracts heavy duty.

“Predicated on this now and the VIN policy, there is side talk that there would be another strike action at the port.

“Customs is just too desperate about generating revenue. If care is not taken, the port would be locked down again,” he said.

Customs denies alleged reduction in duty for imported vehicles.

The Nigeria Customs Service (NCS) has debunked speculation that it has reduced duty on vehicles from 35% to 20%.

Customs spokesman, Timi Bomodi said the existing 35% duty rate on imported vehicles remains.

Some clearing agents claimed on Friday that duty rate applicable on the Common External Tariff (CET) trade portal on vehicles under HS Code 8703 was reduced to 20%, a situation which created confusion among the agents. However, the Customs spokesman disputed this.

”There is no reduction in the duty of vehicles. It was just a mix-up. All of that will be sorted up by Monday,” Bomodi said.

Customs Affirms 20% Duty On Vehicles Importation::

Comptroller Kunle Oloyede, Customs Area Controller, Tin Can Island Command, Nigeria Customs Service
The Nigeria Customs Service Area Controller , Tin Can Island Command, Comptroller Kunle Oloyede has affirmed that to discourage smuggling, the federal government has reduced duty paid on imported vehicles from 35% to 20% thus may further decline in coming weeks.

Oloyede stated this when the executives of the Association of Maritime Journalists of Nigeria (AMJON) paid a courtesy visit to the Customs Command on Wednesday in Lagos.

He also informed that at assumption of office, he reel out his three points agenda to include, discipline, increase in revenue and trade facilitation.

He told the group of journalists that on his resumption at the command, he was given a daily target of N2.5 billion from the previous N1.5 billion daily target. And within barely six weeks of his being in office, despite the two weeks strike action embarked upon by freight forwarders due to the Vehicle Identification Number (VIN) policy, he has increase the revenue of the Command by over N25billion.
Comptroller Oloyode said, “The revenue as at the time I got here it was N1.5bn revenue target per day. So I was given a revenue target of N2.5bn per day. And I had the first parade , I told my officers three key things in no particular order, discipline, increase in revenue and trade facilitation.

“I am also in agreement with the World Customs Organization (WCO) and the World Trade Organisation (WTO) article that says for West Africa and Africa generally, we should do low tax and high turn around time. When you have low tax and turn around, you make more revenue.

On the controversy over reduction in duty on imported used vehicles, the Controller who confirmed the reduction, stated that such move was necessary to reduce the smuggling of vehicles into the country.


According to him, the duty may drop further because by so doing, smuggling will become unattractive to the people.

“Because when you check what is happening around, its those high values, high rate of duty that allows smuggling through our ports and borders.

“Two to three days ago, the duty of vehicles dropped to 20%, government is looking at it that iwhy new vehicles pay 35% duty and old vehicles also pay 35% duty, when after giving backwards integration incentives to most of these assembling plants, we don’t have Vehicle plants that can really satisfy the demands of transport sector.

“I think that is why government in its decision decided to drop the duty and its going to drop further. From grapevine am hearing that there could be further reduction as to discontinue smuggling. We want to make smuggling not to be lucrative again, that is the way government is looking at it.

On revenue drive, Comptroller Oloyede said the management team of the command have started making moves to lure people back to the command for more revenue generation. He enthused that since his coming to the command, the revenue has improved significantly due to engagement with stakeholders

“I can tell you, when we compare revenue from the time I came in up to now, we have over N25 billion extra , compared to N24 billion it was before because I have been able to lure back people that are into bulk cargo. I have been able to convince them to come back to Josepdam terminal.

“I visited Josepdam today, I told them that my doors are open, the doors of my DC Enforcement, DC in charge of bulk cargo are open.

The CAC urged journalists on developmental reportage from well informed judgement of issues before going to the press. He commended the AMJON for carving a niche for itself, saying he noticed that there is a great difference in their reports.


“Yes you may have one or two incidents but, I always urged you to always ask from both sides before you go to the press, this will give you a very informed judgment about what we are doing.

“When we are contacted, there are certain things we need to correct the impression and there are certain things when we hear it, we need to apologise. We need to bring all parties to round table to solve problems.

“It’s a great opportunity to meet you today because am barely six weeks here” he said.
