A suspect will first be arrested, then charged to court where he will be given a fair trial, it's after he has been found guilty that he will be judged as a condemned criminal. But until then he's just an accused not condemned!

But in Jesus' own type of judgment the accused only need to report himself by first acknowledging that he's a wrongdoer, then turn around (repent) of his wrongdoings after listening to what Jesus has to say. Whoever ignore Jesus' words has already been condemned so there's no further case to be established! John 3:16-18
