I thought the Appeal Court Judgement gave the Political appointees succour?

While the President's directive is commendable on moral grounds, the judgement given by the Court stipulated that Section 84(12) is unconstitutional....so why the confusion?

Ministers are within their rights if they choose to go to court (however, not advisable).

That’s not true. Even though the appeal court gave that opinion but the main ruling is that the appeal was upheld due to lack of locus standi in the initial case. So, this rubbishes all the high court judgement. The Attorney General will have to bring another case with locus standi before that partial advice from appeal court judgement can be upheld. And in that case, it will be too late for that amendment of the electoral Act to be removed. Remember that primaries must be held by this month.

You're the person that's wrong. Court of Appeal ruled that 84 (12) of the electoral act runs contrary to the constitution which says appointees must resign 30days to an election.

Nobody obeys the directive of the administration.

Their appointments are at the sole discretion of the President .

Their pre-signed resignation letters were submitted before they even got their appointment letters.

There should be a law that all appointed positions by the executive most be vacated 30days before handover.
