The Federal High Court has dismissed a suit brought by DIG Udom Udo Ekpoudom (rtd) on the authentic Candidate of the All Progressives Congress (APC), for the Akwa Ibom North-West (Ikot Ekpene) Senatorial District in the 2023 General election.

Donatus Okorowo, the Judge, declared that the suit was lacking in merit and thereby dismissed.

The rightful Candidate of the Party has been subject to litigations since its Primary in May 2022. The party’s internal crisis made it conduct two factional primaries in May & June 2022 featuring Ekpoudom and former Niger Delta Affairs Minister, Godswill Obot Akpabio on different sides.

Akpabio, who participated in the Party's Presidential Primary a week before he emerged winner of the re-conducted Senatorial Primary had been backed by the APC, a decision Ekpoudom challenged.

However, INEC, through Mike Igini, former Akwa Ibom Resident Electoral Commissioner vide a report, insisted that Ekpoudom won the Primary on May 27, despite the APC NWC backing the man nicknamed the 'uncommon transformer'.

In a list of candidates later published by the Independent National Electoral Commission (INEC), the position was left vacant with neither names published.

INEC however bowed to a September 15 judgement declaring that the name of the former Governor, Akpabio be published in the final list.

In a judgment delivered at the Federal High Court (Abuja Division), Suit No: FHC/ABJ/CS/1011/2022 - APC & Akpabio V. INEC, Emeka Nwite, the Judge, held that INEC had no rights to disqualify any Candidate forwarded by the 1st plaintiff, APC and ordered Akpabio's name be published as the Candidate for the Senatorial District.

In similar fashion, Ekpoudom, on June 26, had approached the Court via Originating Summons: Suit No: FHC/ABJ/CS/1000/2022 - Ekpoudom V. APC & INEC asking the Court to determine if his name shouldn't be published having emerged from a valid primary, and did not withdraw for another Primary to be re-conducted.

Summary: Godswill Obot Akpabio is the APC Candidate for the Akwa Ibom North-West Senatorial District.

APC as a party is a big threat to our democracy.

He should appeal

Akpabio will give Tinubu 25% in Akwa Ibom State.

That's all that matters.

If he wins his Senatorial bid, he'll battle Senatorial seat with Uzor KALU. If he doesn't, he'll still return as a Minister. A win/win for him!

What I don't understand is what the court means by Inec has no business with whom a party presents for elections.
What happened to Inec's role as a regular of political party activities in the Constitution

APC getting 25% of Akwa Ibom votes in the presidential elections would be a miracle literally. That's about a quarter of the votes. Like who would give that vote considering that Akwa Ibom is a highly christianized state. APC fielding a Muslim Muslim ticket would lose them the votes. That's the reality. Nothing Akpabio can do (although you seem to overate him). Remember Akpabio lost the senatorial seat last time he tried? He'll likely win this time but don't see him influencing the presidential elections much.

What is even there to fight for in apc..a party that has brought disaster upon this country... Nigeria need deliverance

Well, from the little I know a FHC erroneously gave a judgement affirming Ntukekpo as State Chair. The Court was misled but a judgement is a judgement..... So the decision this Court stood on was decisions made by the State Chair.

The Chairmanship tussle is on appeal by Ekanem and the judgement is on the 28th. INEC admitted in their written address that Ntukekpo informed them to come monitor the Senatorial Primaries on June 9 but they declined as decisions they stood by were that of Ekanem's.

It happened exactly same in Ebonyi and that case too is before the Supreme Court.
