While the idea of making states be responsible for convictions at state level is fine, the resources to be spent in building , equipping and funding state prison annually is going to be cumbersome so except the federal government is shedding their budget for the interior ministry to raise funds to support each state government not all the states would be able to run a decent state prison except you are now looking at the commercialisation of the prisons which as much as it is another idea would open another round of its own corruption at the expense of the lives of the prisoners
I will disagree on that point about states needing federal funds to run their prisons. It would defeat the purpose of saving money if the federal government is still funding their prisons. If States want to pool funds together, tax the population more or cut things that's their head ache. The private private prison plan is another interesting idea. There's 36 states and 36 state governments who will do what works for them.

We do not deny that most of our prisons are heavily congested and nothing to write home about. But my question is "why now?".. Why not 2 or 3 years ago.Why 2022 October when election is just by the cornerhuh?

This shows two fundamental issue with prison system. The federal government shouldn't be housing state local inmates. The solution to the is to decentralised prisons. The simple solution to that long term is amend constitution by deleting prisons from exclusive list. The short term solution is NASS pass a law saying The FG will no longer hold Non federal inmates by December 31, 2024 for example. This will force states to build their own facilities and reduce fiscal burden on the FG.

The second issue is the the difficulty in getting bail in Nigeria. If States could determine their own bail requirements by law or have guidelines for judges we would have so many sitting in jail. The next big solution is offering guilty inmates time served while sitting in jail on trial. Again it reduces fiscal burden and they served their punishment anyway.

ps: It's sad Nigeria current statesman like Aregbesola and Buhari aren't very strategic or smart. Since Prisons are in the exclusive list you can just force the responsibility in the states if you please. Use the Majority post in NASS for something useful. This would give leverage to force states to delete prisons from the exclusive list. Yes strong arming is better than slow consensus building and endless meeting in this case.

Go and review the recently concluded constitution amendment carried out by NASS around February. About 90% of the contentious issues and call for restructuring have been amended/addressed, many items from exclusive list were removed and I think last week Speaker HoR asked State Assemblies to work on what they transmitted to them. Now States can have their prisons as amended if State Assemblies can do the needful....

They haven't done prisons from what I seen. NASS is yet to pass it. If I'm wrong excuse me.

Amending constitution is different from Making new laws. If it were new then some protocols need to be passed through but in case of amendment, changes are made in line with the work of committee assign for the job. The issue now is, many of the amended parts of the constitution need state legislatures to act on them before they become law in those states...

I said NASS didn't pass it meaning both houses didn't pass it. You need 2/3 majority before it goes to the state assemblies to ratify the amendment. If you have proof both chambers did such I'll concede that point. Lastly I already said they could force their hands by simply throwing the cost on them and not holding state law offenders by a certain date. They'll rush to pass the law when their foolishness has a onerous price tag attached to it.

AFTER THE 2023 ELECTIONS AND THE STATE GOVERNMENTS HAVE POWERS TO CONTROL THEIR POLICE, RESOURCES AND THEIR DEPUTATIONAL REPRESENTATION, THEY WILL RELEASE INMATES AS THE STATES PLEASE.

I'm telling you the majority of people in jail have evidence to justify a trial. Yes they'd probably be guilty if the case runs its course. I dont know the conviction rate in country but I'm guessing its over 50% so odds are they did it. Are you going to tell me every accused rapist, murder, drug dealer is innocent.

Good you're being irrational thinking there's no guilty person in person everyone was set up in your opinion. Every rapist, murder, yahoo boy, arsonists low life is convicted without evidence. If you can't accept reality that's your problem. I made my argument clear to you. I didn't disagree about certain people being innocent.

Back in the day as a young man, during Christmas period, police goes about raiding people on the streets into their danfos, only those who got immediate cash are let go, the rest you go sleep cell next Monday you go to court, from there to remind for late night movements.

I’m talking about real life situations here, Police stations are filled with cases that shouldn’t go to court, Judges don’t know anything about the case except you have money to spend on the Police IPO, the judge will send you to jail for remind with one flimsy excuse from the IPO.
