You dont need to fight your employer. The office is a war zone dont make it worse. If the hr is saying you can't work, it hurts but if you go the way of tribunal, you may win but you wont like yourself. You can only do that when you know you will not return to that work. Your peace of mind is more important than creating a hostile environment for yourself. Why use the hammer to kill an ant? Allow it slide.

However, when in this case, HR not only threaten disciplinary, but serves disciplinary with a clear rider. ... could lead to termination, then the kids gloves are off. HR has entered wavulence zone!
In between, ACAS is way off from actual employment Tribunal.
Well, who wants to be without a job or worse still with dismissal record!

When you filled for your visa renewal, have you received a response from the home office .......

No need to panic..... It would all get resolved........ And your pay would be reinstated..........

What's category of visa did you have ........

Did your employer sponsor your visa ........

Thanks Bro for those helpful insights. You are right about their unending promotional content and marketing gimmicks. Lol at the last paragraph. It's not even just about getting a job, the question is will their course offer as much knowledge as it ought to?

People learn differently so for some people when the pay for bootcamps, they learn better are able to practice and bag jobs. But the thing is you can actually make the transition your self by studying your self. Youtube is one of the most underated resources that most people are sleep on. Say for example if a bank teller want to transition to business analysis. You can search youtube for videos that give an overview on business analysis. Then then there are lots of reseource that go even deeper into it. If you discipline and spend your time. what you get would be an equivalent of 2 or 3 bootcamps. Simplilearn is one youtube channel that has several great materials on this and other areas. After understanding the landscape, you can go a step further and search for virtual internships to garner practical experience. Forage is on good resource for virtual internship and it take less than 5 mins to register. You get to work on live projects from fortune 500 companies(Deloitte, GE, TATA, KPMG) and can even reference this on you resume. The most important thing is get the experience and skillset. And you can do this without paying a penny by just investing time, internet connection and research, research research!!! From your room you can get experience. Especially if one is not an Omo babalowo.

For interviews, there are lots of materials youtube that can guide you in answering questions in your subject area especially using the STAR method. Record your self during interviews so you can know how well you perform. Take note of the questions you were asked, and research after the interview how to answer optimally. You can even use CHatgpt to get good answers and relate it to your experience. Searching for jobs is a job on its own. With grit and perserverance you will get what you looking for.

Something similar happened to someone I know few months ago. HR was adamant that the person didn't have a valid visa even though all necessary documents and guidance were sent to HR to show that the person made an in-time application. The company assumed that since they didn't give te person COS that the person was in the wrong whereas the person was on a non-point-based visa. HR said that they had to remove the person from their payroll even though the company was in the wrong. There was a compliance/disciplinary meeting called and the company still went ahead with the payroll scrub.

Long story short, the company finally carried out checks which came back after about 4 weeks and they had to pay the person for all the time that "they" weren't allowed to work. No apologies were offered probably due to the fact that they didn't want to admit that they were wrong. The person still works with the company but planning an exit already. Note: this was an employee that had already worked 5 straight years with the organisation and who shouldn't have been treated so unfairly.

My advice - get all the govt guidelines and every necessary document to them to run their checks. Each check is valid for 6 months and must be carried out every 6 months until the visa is issued or refused. If you're part of a union, get your union rep to advise you and attend the meeting with you. If not, you can get a well-versed immigration lawyer to go with you.
Try to be as professional as possible in all your communications with the company to ensure that the error is cleared up and that no bridges are burnt.
Worst case scenario, you can always go to the employment tribunal to get compensation for the unfair dismissal if they go ahead with their threat of dismissal. Think about this hard and long to be sure that you want to toe this path or you just wanna leave without any drama in the hopes that your application will be decided soon and you get another job - I say this because many people would rather not toe this line due to their personal reservations.

A claim of unfair dismissal, could only be undertaken, if you have been in employment over 2 years.........
