How it ends is immaterial to the obvious fact that Buhari has ignored court orders and can ignore this court order.

Buhari is a complete failure, so I have no faith in his abilities on ANYTHING.

Chill and let us see how it ends
Then we can now say if it is immaterial or not

Nope.

Buhari has set a precedent. Supreme court orders can be flouted.

Chill or React, nothing changes that reality.

Not feasible,I agree.
But in real sense what's the feasibility after spending huge money to bring in this new note.
Are we to abandon the real motive behind this cash policy all of a sudden.
We are in it already, let's just move with it to the very end,I thought we all agreed this will help in making the elections more fairer, why are we backing out.

This won't stop vote buying on elections day bro. The politicians have unhindered access to these new notes. What is causing all these problems is the rush and it's the CBN fault.

At bolded, the CBN didn't consult with Nigerians before embarking on such Draconian policy. The masses are suffering. We all know what they are doing is just some power play.

The court, and in this case the Supreme Court, has power and jurisdiction to adjudicate on any matter, whether monetary policy of the CBN or any policy of the Government, so far the policy or the action of Government touches on any person or Authority who reasonably believe their right or interest is affected.

There is no institution or agency of government that is so independent to the extent that its functions or activities are not subject to judicial review.

The CBN is a creation of the law, so it is subject to the jurisdiction of the court of law. Because the CBN is "answerable" to the President is the reason why the President/Federal Government was sued through the Office of the Attorney General of the Federation in this suit.

And because it was some State Governments that sued, that is why the Supreme Court is the right place to go straight. It is the law that disputes between the State Government and the Federal Government can only be entertained by the Supreme Court. No lower court has jurisdiction over such suit.

Going to the Supreme Court straight is not an exercise in futility. May I even ask you, which court has the temerity to declare the proceedings or order of the Supreme Court an exercise in futility?
oga don't 4get these are arms of government, the judiciary have their limitations.all the same I am waiting for the presidency to respond to such judgement.

The problem now is will CBN direct commercial Banks to reload ATMs with old naira? Will Buhari comply with the directives or they will apply for stay of execution pending the hearing and determination of the suit?
The old naira is still among us. It will continue to be in use. Which court will they apply for stay of execution? ECOWAS court?? grin

I am surprised how a case can be moved to the supreme Court without first going to the federal high court and appeal court
Hmm! Do you actually read other people's comments before commenting?? That mofo has been corrected that a case between the states and FG doesn't go through those courts but straight to Supreme court.

Nothing can curb election malpractices in a country like ours,we are Just doing our best to reduce it to the barest. to me personally I think if we are to enter the real new phase after the disasters of buhari, then this should be it.

Concerning the CBN not consulting Nigerians before embarking on such severe policy.
This is not the first time we are facing such and I'll all my length and width of existence, I've not seem the government reporting to Nigerians before taking moves like this.

Children of hate will tell you that the judgement of the high court is superior to that of Supreme Court.
Crazy people.
Some of them have said it already. They're saying the order of the FCT High Court has to be vacated first before the Supreme Court injunction can be obeyed. Some are even saying that the Supreme Court has no power over CBN and matters of monetary policy. So many ignorant people speaking so confidently.

Are you actually thinking thru ur anus?😲😲 So high court injuction supercedes SC injuction?? Are you kidding me?? Those 3 governors acted wisely by taking the matter on behalf of the states. That's why it went straight to SC. If this nonsensical policy is not affecting you, it's affecting me and my family members. You should not fool yourself that the person being targeted hasn't gotten close to enough of the new naira notes.

The supreme court judgement was not even referring to the office of the president. The judgement was directed to the office of the CBN and the hat is emefiele.
Emefiele cannot even use the president to cover in this case.
Emefiele has no choice but to answer to the supreme court with powers to ask for his arrest for disobeying the highest court of jurisprudence backed by the constitution
The best is for him to head to the same court but obey first

Remember DSS is praying he disobeys

The judiciary has no limitation as far as adjudicating over matters of disputes between parties are concerned, including between Government and Government. In fact, that's the very essence of separation of power. It is to ensure checks and balances amongst the arms of government.

Na today to them start to disregard court order?
baralatie:
Ok
It means the judgement will be copied to the CBN,office of the president, minister of finance and the bankers union .
So it also means that the CBN governor will needd to issue a fr ah directive to all the banks
Then the CBN will need to assembly it's legal team to go to the supreme court on this issue first before another directive can be given

Now if the Emefiele disregards the supreme court ...........the supreme court can automatically ask for his arrest

I dey look DSS and NASS with very sharp crocodile mouth and shark teeth

Unfortunately it is the CBN that will issue directive on wether to obey the supreme court or disobey the supreme court .This judgement has nothing to do with Mr President

Now if a bank follows the earlier directive from the cbn(S it is now that directive has been halted).Do you know the magnitude of 'wahala ' the cbn will be involved when it is brought to the knowledge of the supreme court.
Now imagine if the supreme court now ask for emefieles arrest.do you think DSS will turn a blind eye?

But this is not a question of law nor fact, and thus the supreme court order is not worth the paper it is written on.

The Supreme court simply does not have the power to extend the deadline unless the validity of said deadline is being questioned as a mater of law or fact. The FG has acted well within their constitutional right.

Three state governors are trying to tell the FG how to rule the country, but they dont, ipso facto and ispo jure, have a locus standi in the matter. Entertaining the suit in of itself is a failure by the Supreme Court

In a situation where the masses are dying from the policy of the FG, they can actually be taken to court, and this is what the states did. If FG policies counteracts the smooth running if the states, states can take them to court. Wike took FG to court via VAT matters. SC didn't reject it.

The supreme court can ask but cannot enforce anyone's arrest. All federal law enforcement, security agencies, and armed forces are under the executive branch. Anyone that goes rogue is simply risking their career for nothing, cos many seem to have forgotten that PMB na retired General

The CBN will likely just ignore the Supreme court order and there is nothing they can do about it. The banks can also simply refuse to accept all cash deposits till further notice.

Anyone still accepting old notes after the deadline does so at their own peril
Stop talking as if you are not living in Nigeria. Buhari is not always in control of two institutions at a time. Is it the same DSS that attempted to arrest Emefiele before court rescued him?? Do you think that Buhari is in control of EFCC? Abeg get your facts well. DSS are just waiting patiently for any order if arrest from SC since no other court can give him a counter injuction.

The national assembly recently gave the CBN the independence to regulate the fiscal space via the CBN act. This is like going to the supreme court to stop the actions of the Efcc chairman, even though he's not independent.
If you want to challenge the CBN policy, you go to the federal high court. Stop quoting rubbish.
