You that is a professor but so daft. Territory indeed. Your papa territory abi? Lmao. Every Nigerian and state has equal rights in Nigeria. No Special Status. Abuja had a Minister dafty who is appointed by the President. He acts as assistant to the President because essentially the President this the Governor of Abuja. Abuja is the 37th state in Nigeria. It is just called the FCT to show it is the capital. Nothing more! Abuja is not more special than Ebonyi apoda.
Be talking nonsense. Abuja does not have a governor, no state assembly. Which kind state be that one? Abuja is FG property my friend

it is not about who the governor of Abuja is but about what the constitution says. The constitution says Abuja is a state.
So someone who didn't get 25% will come and appoint an administrator where he was rejected?

Obi was rejected in the core North, would it be proper for him to rule over them? If your answer is yes, then it means Tinubu has the right to appoint an administrator in Abuja even though he failed to get 25% of the votes there because Abuja belongs to Nigeria and Nigerians have spoken with one voice that he should lead us for the next 4 years.

This part of the laws is very clear sir. It's a matter that has been settled long ago. I'm a die hard obident and I was out till 3am on election day so I wish it were true but unfortunately, you don't need 25% in FCT to be declared the winner.
This is not about die hard or die soft, the section of the law must interpreted. My dear be ready to vote again in the next 21 days for a Presidential Election rerun as stipulated by the 2022 electoral act.

Section 299 of the constitution says that for the purpose of interpretation of the Constitution, the FCT is regarded as a State.

The implication is that:

The FCT is a State but given a name.

Since the FCT is given a name by the drafts men, it won't be right to say 37 states.

However, the name is 36 States and the FCT. It simply means 37 states.

The court has affirmed that position and the constitution is clear.

Yes it is a state no doubt.
But its the only state that was stated in the constitution.
The could have said 37states.
But it said 36 states and the FCT.

Meaning FCT MUST BE INCLUDED

stop arguing with yourself. Presently, you are at the denial stage. You will come to term soon. What the constitution is saying is that whenever there's an issue, the FCT should be interpreted as a state. No magic. If you can loose a state and win the election, you can loose FCT and win the election.

Question: What does the law say about not winning up to 25% of the vote in FCT in Nigeria presidential election

Interpretation: According to the Nigerian Constitution, a presidential candidate must win both a majority of the total votes cast in the election and at least 25% of the votes in at least two-thirds of Nigeria's 36 states and the Federal Capital Territory (FCT) to be elected as President of Nigeria.

If a presidential candidate does not win up to 25% of the vote in the FCT, but meets the other requirements, they will not be eligible to become the President of Nigeria. The same applies if they do not meet the requirement of winning at least 25% of the vote in at least two-thirds of Nigeria's 36 states.
Very true.

The word "AND" Is a coordinating conjunction.

If Abuja is treated like a state, there won't be any need to single it out.

Let's take a closer look.

Section 134 (2) says: “A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election: (a) he has the highest number of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

If winning Abuja is not necessary, the text would have stopped at...

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation.

Being regarded as a state does not confer on it the status of a State. Does FCT have legislators? Does it have a governor? Can it enact a law to govern it?
Stop being half-baked in English.

Easy with the insults, this is why they keep abusing us online. Small thing you attack and insult people you don't even know. Now listen,
Firstly, if the constitution required each candidate to get 25% in FCT, it means that the constitution is being partial by seeing the votes cast in Yobe, and Lagos and Borno and Kwara as Less than the votes cast in the FCT and that's not democracy, our constitution will not support such. It simply means your votes in FCT carries more weight than the votes in other areas.

Secondly, the whole essence of that part of the constitution is for the winner to have National spread and acceptability. The constitution cannot say that someone who won in the entire 36 States but failed to win FCT cannot be president, it's common sense.

Lastly there are several areas in the constitution that mentions the phrase "36 States AND the FCT" for example in the appointment of Ministers, etc so since there is no Gov for the FCT that's why you have an FCT Minister that acts "like" a Gov for the FCT.

Ps : Another reason the constitution cannot be interpreted that way is because it can create and endless loop of re-doing elections over and over again, because you will have to conduct the whole election all over and if the same thing happens and only Obi in this case gets 25% in Abuja, then you have to repeat again and again and again, does that make any sense?

The constitution is very clear that 25% must be had in the FCT if not it wouldn't have had to single it out. English is not supposed to be this hard.
