The communication and voters education department of INEC need to partner with the Nigerian Orientation Agency for serious voters education and sensitisation moving forward.

Firstly, When you look at most of the post-presidential election issues we are having now. It boarders on ignorance about how things work and general fallacy, misinformation, misunderstanding and misconception about the electoral process. We witnessed how on election day, people were ignorantly celebrating polling unit results, got lost in the little wins, forgetting different polling unit results are to be taken to the ward level, which are then collated, to be transferred to the state for state collation.. Then to the National collation centre.

One of the spokesperson of Labour party, Kenneth Okonkwo after the winner was declared, took to his social media page, ignorantly alleged that the results were manipulated because Labour party won Aso rock polling unit (probably one out of dozen of polling unit there), he also said they won some state governors polling unit. So it means they are the actually winner of the election. Very funny.

Secondly , on the result electronic transmission issue. Over the past few days, we have seen politicians and some ignorant celebrities misleading their followers about the electronic transmission of results. To make the matter clear and straight; it is not a must for INEC to use the electronic transmission for result. INEC is at liberty to use any means or method for result transmission. There is nothing like Electronic transmission of result in the Electoral act 2022.

The provision of Section 60(5) of the Electoral Act, 2022 has provided for the transfer of election results including the total number of the accredited voters from the polling unit.

It states: The presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the Commission.

It means: The law already gave the polling unit’s presiding officers the authority and backing of the law to transfer election results, the outcomes of the ballot in their respective polling units in a way that INEC would specify. You can never hold INEC in court with the issues experienced during the trasmission of the results. It has no legal backing, INEC is not at liberty or compelled to transmit results electronically. It is by choice.

Thirdly , if you look at most issues raised by the opposition parties, especially the loud Labour party. They are not challenging the main result of the election, they are only challenging the issues relating to the result transmission; the process. It is them versus INEC. Which means any decision or judgement to be taken by the court, which will favour the petitioner will have to be outright cancellation of the presidential election.

There is no where in the world where presidential election was nullified based on trifling grievances , minor glitches, administrative error, unavoidable irregularities experienced from the process. No where in the world will you cancel an election, where over 400bn tax payers money was used to execute the election because of petty de-minimis glitches arising from the electronic transmission of results. It is classified under deminimis- practical law .

Fourthly , it is very clear the labour party is just trying to gaslight and blow the whole issue out of proportion. Few days left to file petition at the tribunal, Labour party is yet formally file their petition to challenge the election. Instead, they are busy heating up the matter on social media, wailing about how their mandate was stolen without giving clean-clear reasons, threatening protest, chasing shadows in disguise of carrying out a "digital forensic and physical inspection of BVAS". For what actually? To seek more evidence?

Presently, there are over 160,000 polling unit results already uploaded on INEC portal out of the over 176,000 polling unit. That is a whooping 94% result uploaded . We have not seen anybody disputing any of the results there. Labour party had over 150,000 pollling unit agents for the presidential election. Having 150k agents means you have situation report room and independent collation centre for your party to collate the result themselves as reported by the agents in their respective assigned polling unit. The 150k polling agents should have been able compare their results by now with the 160k polling unit uploaded results on the INEC portal. If the election was truly rigged, Labour party should be in possession of thousands of evidence by now to take to court instead of disturbing INEC about inspecting BVAS and server.

i dont even need to be a lawyer to know the whole thing just doesn't make sense. Logically, Since you have to satisfied the rule of law totally in proving your case as a petitioner. If labour party is so sure that the election was rigged, and they have enough evidence in their possession to win the case. Then file your petition at the tribunal, serve the papers to the respondent/respondents and prepare for court. Why chasing shadows around?

I'm proud of you. You've analyzed the whole stuff logically and legally.

Section 60(5) of the Electoral Act gives INEC the discretion to transmit the election in a manner they think is the best.

In the whole of the Electoral Act 2022 and the CFRN 1999 (The Primary Laws governing Electoral matters), there's no mention of electronic voting / transmission or mandatory electronic transmission.

The opposition are basing their claim on an administrative promise/ guideline which cannot displace the discretion vested on INEC by the Electoral Act to transmit the Election in a manner most appropriate to them.

INEC is like a seller and the law mandates him to deliver goods bought to consumers in a way he thinks is the best. INEC the seller promises on its own that it is likely to deliver through a pick up van but on the day of the delivery, INEC delivers through a motorcycle. The court cannot cancel the delivery because the mode of delivery was INEC's business and not contained in any Law that will be quoted in court. It's as simple as ABC.


Section 135 of the Electoral Act also states that an election shall not be invalidated/ cancelled even if there was not total compliance with the Act. As long as there is substantial compliance with the act and the non-compliance does not affect the results substantially, then the election remains valid. INEC strictly complied with the act as there was no provision for electronic transmission.

2023 Election is the fairest elections in Nigeria's history.

Thank you. Labour party is fighting a lost battle. Infact any judgement coming out of Court that will favour labour party will have to be 'total cancellation' and nothing more.

And where in the world will you nullify an election that falls under deminimus rule? Never ever. It never happened anywhere. It will never happen. You cannot nullify an election based on administrative issue and trifling glitches.

PDP already realised this. Reason they pulled out. Labour party should go ahead and file a petition if they are confident.

They should stop crying and trying to bully the judiciary without even filing a petition yet.

Labour party should halt the noise, desist for chasing clout and take a bold step to a file a petition. Time is going.

1. Do you have access to all the BVAS Presidential results for each PU for labor party?

2. Do you have access to the results from your agents in each PU?

3. If the answer to 1 and 2 is yes, can you still say you won the election?

Any journalist that can find a way to ask obituary these 3 questions will EXPOSE the fraud as the liar and criminal that he is.
