ABACHA v. FRN (2014) LPELR-22014(SC)

"The word "forfeiture" means" the divestiture of property without compensation. The loss of a right, privilege, or property because of a crime, breach of obligation, or neglect of duty." - OLUKAYODE ARIWOOLA, JSC (CJN)
I am bringing this up as regards the $460,000 forfeited by Bola Ahmed Tinubu to the US government.

Festus Kenyamo and co have been arguing that a forfeiture does not imply that a crime was committed.

They've always maintained that BAT's forfeiture isn't linked to any criminal conviction.

Let the legal fireworks begin already!!

"The word "forfeiture" means" the divestiture of property without compensation. The loss of a right, privilege, or property because of a crime, breach of obligation, or neglect of duty." - OLUKAYODE ARIWOOLA, JSC (CJN)

Neglect of duty is not a criminal offense or criminal conviction. The CJC gave three distinct instances that can lead to forfeiture. In Tinubu’s case, the forfeiture was as a result of neglect of duty and it was even a civil case. Forfeiture of property as a result of neglect of duty in a civil case is not a criminal conviction.

Possession of property or funds illegally obtained is a crime.

Neglect of duty. Can’t you read?

Neglect of duty can arise in different cases. Breach of professional ethics, violation of contract agreements etc. These are civil cases that are settled by court. They are not criminal matters and doesn’t lead to criminal conviction.

So, what exactly is your point? Forfeiture is definitely a punishment under civil matters when negligent of duty is established. Does that make it a criminal conviction, NO!

I'm referring to the topic in discussion and not the words you extracted from it. Can one forfeit such a large amount of money that 'rightly' and 'legally' belongs to the person without him or her commiting any crime?

The reason for the forfeiture is drug related. Therefore his property is being forfeited for a crime. I am privileged to have a copy of the US court ruling having worked with Obi’s legal team. I will bring out a quote from it “The investigation disclosed through interviews with Agbele that Akande returned to Nigeria in mid 1990; however, before he left, he instructed Aghele to serve as a source of WHITE HEROINE for Lee Andrew Edwards.According to DEA investigators, Agbele sold white heroin to Edwards on numerous occasions…Stewart Avenue is known as a drop-off point for packages from Nigeria that contain white heroin. This investigation has disclosed the identity of other individuals, including relatives, who have worked for Akande with various duties in the distribution organization. One of these Individuals has been identified by the investigation as Bola Tinubu” Pages 5 & 8 of the United States District Court’s Ruling. In the case of Tinubu, his money is being forfeited for crime as we have seen above.

But to cure your delusion, a "plea bargain" led to the forfeiture. Please don't disgrace yourself further.

And before you ask me another delusional question about Plea bargain, see below.

Your love for Thiefñúbû is making you think backwards...

Baba hand nor clean in the past..

He was associated with Chicago Drug Barons that Laundered money through his account...

Let's just pray that because this incident happened more than 25 years ago, the Constitution and Judiciary can turn a blind eye to it ...

If not Drugnubu would be disqualified and declared unfit to run for president..

His only hope now, is that clause in the Constitution that states that :

" If the incident of dishonesty happened within the last 10 years"

This would be thiefñúbû's saving grace..
