Let's face it, every genuine lover of Tinubu is happy with the decision of the Court of Appeal. The tribunal sitting at first instance used the BVAS to determine over-voting.


The main decision of the Court of Appeal that differs from the tribunal that entertained the matter at first instance is that:

There is no over-voting if total votes in a polling unit is lower than the voter's register even if it is higher than what the BVAS accredited.

The BVAS is secondary in proving over-voting, while the voters register is primary. That's the law according to the court of appeal.

In Law, Courts are binded by precedents. The Court of Appeal and those lower than the court of appeal will from now on use voter's register to determine over-voting.

All the synchronization of the BVAS and whatnot are irrelevant. Obi and Atiku have failed.

I am also celebrating.

After wike vs Peterside in river state election issue I don't seem.to trust our judiciary ..Adeleke might still.lose in the supreme Court cos u can't seem to trust our judicial system ..people buy judgement ...peter side won at the tribunal , won at appeal.
.wife finally won at supreme Court...what can you deduce from this? We have a long way to go

Yes, over voting on both sides but Inec had said all their results had not been fully uploaded as at the time the case was filed at the tribunal. Even till now, over a month after the Presidential elecrions had been held, only 94% of results have hit the irev portal so far. If you're loved in your domain as a politician, people would overwhelming vote you and thats what happened to adeleke. You can't say because Adeleke won massively in all the Ede LGAs, people overvoted for adeleke as against oyetola.

I heard you. The fact that the apc was the ruling party and fully on ground in osun as claimed but still lost all seats to the dancing governor's party was a proof of his victory and popularity in the state. It's amazing to note that same people at the federal working with adeleke and against Tinubu weren't those who cleared the state, senate and assembly seats for the pdp. It was same osun people who did that. Where was the apc in the state when all these happened?

For now and pending the determination of the case by Supreme Court, base on decision of Court of Appeal in respect of Osun Guber Tussle on Friday, it will continue to be a reference point for all the Lawyers that are currently handling Election Petition Tribunal matters across all the 36 States and FCT that information on the BIVAS MACHINE (being primary source) is the Primary Data and while transmitted information from the BIVAS Machine itself to backend Server (secondary source) are the secondary data. And whenever the information on the Backend Server (secondary source) are appear to be controversial, information on the BIVAS Machine which is primary source shall be AUTHENTIC.
It's not a matter of Law, but common sense!
