That's not what the act says in section 149. The section says any action taken by an INEC official “in pursuance of the the constitution or of the electoral act “ remains valid unless a court sets it aside .

The question is what the REC did, is it in pursuance of the provisions of the electoral act or the constitution ? Which section of the electoral act or constitution empowers a REC to declare results ?

The section 65 of the act empowers the Returning officer to be the one to declare election results and not the Resident Electoral Commisioner (REC) .
Read the first line of that section again. It practically says notwithstanding any provision of this act and then goes on to say any act by any official is valid unless vacated by the court.

That section shouldn’t have found its way into the electoral law.

That's not ho u interpret such statements na haba. If u are picking a phrase out of a complete sentence to interpret it in a way that favours ur argument, then there's practically no need for the electoral law itself . U have to look at the whole sentence and understand what the sentence is saying.

I can tell u that if the case gets to the supreme court, the position of Senator Abbo and the rest of APC people clinging on to that section 149 will not stand. The law empowers Returning officer to declare election results ad that is what has been happening till Adamawa happened. It makes no sense that the law that empowers Returning officer to declare result will somehow allow just anybody working with INEC to usurp the power of the returning officer.

You do know the Federal High Court in Abuja ruled on this yesterday stopping INEC from reversing the announcement made by the REC citing this exact same section.

It’s even more annoying that it was a Senator that raised that clause meaning they knew the exact reason why the clause was there. It was for this kind of scenario.

Like I said before, our lawmakers are crooks.

Video cassette tape that would get caught in the video head requiring delicate extraction. In extreme cases where tape got damaged or cut cello tape is your best friend.

We used to clean video head with cotton wool and methylated spirit or perfume. We even started changing video heads either from previous devices or 2nd hand from the electrician.
We also lost the cover screws for the VHS long before we retired it.

Did you ever use broomstick to keep the PS disc spinning? We used to do that to play games on faulty consoles and we felt like desperados until one day I entered a room and they were playing PS Konami on only the electronic panel. No plastic cover in sight.

Binani was losing by 30k votes in March and was losing by 1200 extra votes when the declaration was made.

Na only God know where una go go from here because if it stands, we have no electoral process anymore.


All I need to do is strong-arm INEC to appoint Izzou and Nezzjnr to positions in my state, then get them to declare results in my favour, even if I got zero votes

Then tell GloriousGbola and Itsrm to go to court 😎

Notice he hasn't been arrested, INEC only temporarily suspended him from office. He did what he did knowing that he would get away with it, and the looser would have to go seek redress at the court.

Just read that INEC would announce Adamawa result on Thursday, plenty drama go shele in the coming days all thanks to the useless Yakubu led INEC...

Buhari should never have signed that new electoral act into law. He should’ve insisted on them rectifying all these blunders.

I’m interested in the bold part of ur statement . Who is the Returning officer in the Adamawa governorship election ? What happened to him ? Is he dead or critically ill ?

On what basis did the REC announce the results in his stead ?

I don’t u understand in Adamawa on sunday . The RO is usually a professor(most likely a Vice Chancellor ) who will be appointed by INEC solely for the election process . The on the other hand is a staff of INEC heading their Adamawa office . It’s only the RO that can announce the results cos that’s what he’s appointed to do . That’s the reason u see INEC suspending the REC cos he’s their staff who acted out of line .

That section 149 angle will be thrashed at the Supreme Court , but before then I doubt the governor will leave office based on the illegally declared result , in fact if Finitri ends up winning after dilation is done; INEC will most likely give him certificate of return cos that’s the right thing to do.

That Federal high court judgement will not stand . The only thing that will make INEC hand over certificate of return to Binani is if she is announced winner after collation is completed by INEC .

Let’s wait for the official figures on Thursday and see who will eventually win the election .

It was a good idea yes but that draft was rushed with a lot of loopholes which these lawmakers intentionally put there for their own gain.

Buhari rejected that bill twice telling them to go and work on the bill and remove all those controversial inputs but it seems somehow there are plenty loopholes available to be exploited in the law.

This is why I smile when I see emergency feminists painting her as the poster child for their "movement". One part of me actually wants the illegal declaration of result to stand so I can check the number of hypocrites on my timeline. grin.... I want to watch them celebrate the illegality and then later watch them blame all our political woes as a nation on the fact that women are not allowed enough opportunity to hold political offices.
