Good one from the judiciary. NBC has been muzzling the press for long. Lai and those involved should hide their face in shame! |

Long awaited. Many times they impose illegal fines without fair hearing . An organisation that is headed by a political nominee of the ruling party ,which is also controlled by the ministry of information, should never be given such powers without recourse to the court of law. That can only lead to tyranny and suppression of press freedom. |

The judgement cannot stand. NBC has the total power to sanction any broadcast station. However if the station feels the sanction isn't right, they can sue the NBC to appeal the sanction. But saying the NBC can't sanction is total bullshit Likewise saying the NCC can't sanction MTN and others.. |

It doesn't make sense, that arbitrary fine flying up and down for no reason. Like the one that Bayo Onanuga has to complain to NBC to sanction ChannelTV for allowing its station to be use to commit treason, whereas what Datti said is within his constitutional right to freedom of speech and expression. Funnily, you fine the station but you didn't sue the person you claimed said wrong thing. Nonsense! |
| Re: Court Invalidates NBC's powers to Impose Sanctions, Fines On Broadcast Stations by Nobody: 1:21pm On May 10, 2023 |
lhordspy:You are wrong... Because when you want to abuse power is when the judiciary is allowed to get involved When VIO feels they have power and wish to extort you even when you have all your documents complete then you have the right to sue. Incase you're thinking of using datti on channels tv just throw it away. Because channels didnt tell datti to utter those words They should go after datti instead of channels |

So the judge is also saying that if a doctor for example commits a professional offence, MDCN, the constitutionally recognised regulatory agency saddled with the responsibility to discipline doctors should sue the doctor to court. Na waah. |

lhordspy:You are wrong. Didn't you see where the judge said it's the concentration of too much power in an agency being the same person who will say a station committed an offense and then imposed the fine? The reason why the FRSC now uses mobile courts is because of a court ruling such as this. If the police caught armed robbers, do you know they take the suspects to court for trial before a sentence is imposed? |

Universities, therefore, have no right to rusticate you without recourse to court judgements. Cultists right now...

Rayban25:Thank God you typed this. Court cases should be means for seeking review of sanctions by media houses not an intervention place for the regulatory body. If VIO impounded my vehicle and i am not certified. I take them to court. But if VIO is to take me to court before sanctioning me for doing what is wrong. Then there is problem. It is an open-invitation to misconduct. |

TheAdvocate:Lol. It is the court trying to have more powers, brother. NBC is a regulatory body. That is its main work. If anybody is not satisfy with the sanctions, then go and tender your argument as the court. Not the other way round. |

happney65:Even if NBC can sanction, what is the brainer there. You sanction a station for allowing its broadcasting to air programme inimical to the peace of the nation but never for once sue the person that made words or issue you sanction the broadcasting station. Is there any sense in that? Meaning that sanction or fine is bias. Taking for example, you fine ChannelTV for allowing Datti to make words that can trigger unrest in the nation but you leave Datti to go Scot free. If truly what Datti said was against any known law, he should have been taken to court also. Most of their fines is tantamount to shaving one head and leave the other. Shame! |

fergie001:But the customs, the road safety, the quarantine and the rest have the power to impose fines when people break their laws? How constitutional is the EFCC power break into people's home and privacy and cart people away like contraband goods in the name of sting ? So now, the NMA, the NBA , the ICAN when their respective members break rules attached to operation and membership of the their bodies. |

I am not a fan of NBC. However, I think this judge interpretation of the law get K leg. Even in western countries ministries and and agencies impose fines. If the company feels the fine is unjust, they can go to court for the court to arbitrate. May be this is just fake news. otherwise going by the logic you can not be issued with parking or driving violations unless you go to court. "Between 1990 and 2004, the Federal Communications Commission (FCC) issued fines totaling $2.5 million to radio licensees for airing material it deemed indecent from The Howard Stern Show, the highest amount of any American radio show." https://en.wikipedia.org/wiki/Federal_Communications_Commission_fines_of_The_Howard_Stern_Show "The federal banking agencies, including the Office of the Comptroller of the Currency and the Federal Reserve Board of Governors, also have the authority to impose civil penalties for violations of U.S. sanctions laws and regulations." https://iclg.com/practice-areas/sanctions/usa#:~:text=The%20federal%20banking%20agencies%2C%20including,U.S.%20sanctions%20laws%20and%20regulations. |

lhordspy:The court is not fully taking away their right. What they mean is that their sanctions must be reviewed first so that they dont think they can have monopoly of madness to just do as they like. I gave you an example of datti and channels tv. That fine was uncalled for..but because it dosent affect you or your camp you're now displeased...no be so oo |
| Re: Court Invalidates NBC's powers to Impose Sanctions, Fines On Broadcast Stations by tempest01(m): 1:32pm On May 10, 2023 |
lhordspy:You are wrong. The media is secured by the constitution as a powerful check to government. Any backyard law to stifle the media without a trial by court is null. If the NBC feels that the media has broken the law, they should let the judge decide. Dishing out fines because the truth is not pleasing is an aberration to free speech and anyone can draw up any trivial reason to fine the media and control narratives. |

lhordspy:The NBC cannot be a judge, jury and executioner in matters that they're a party in. Even LASTMA, Road safety etc takes people to court when they voilate rules before impounding vehicles. |
