A judge criticising the EFCC for not arresting the respondent FIRST, and applying for warrant later.

The only good points he made (in a sane society) were that the EFCC did not show him enough reason to believe their case had merit, and to a lesser extent that they didn’t give enough identification to specify the Godwin Emefiele they wanted.
Although one can then ask if he wasn’t sure of the Emefiele involved why then was he referencing seeing him on TV with the President, but that would be petty. Lol

That judge was focused more on staying out of trouble than delivering justice.
The third point actually doesn’t make sense outside Nigerian political environment . It sounded more like a judge is encouraging illegality . I had to read it over and over again . The point the man made there doesn’t align with his conclusion at the end of the paragraph .

The man probably has children in Private universities and abroad whom he intends to see through school before leaving active service . He just use style wash him hand off case wey fit end him career

As the Supreme Court has held that INEC is not mandated to electronically transmit results from the PUs to the IREV, you have to say that Obi’s petition, on the ground, has no merit now.

However, Obi’s strongest case is the fact that INEC’s website has Obi leading in Rivers as against what was declared by the Returning Officer. But with Rivers being the only state with that anomaly (so far), I seriously doubt whether the PEPT and/or the Supreme Court would invalidate the entire election because of one state

I don't think so as well. Like I mentioned to BlueRayDick yesterday, using anything on IREV is dead on arrival because it either cannot be proven or difficult to prove.

The EC8A forms will definitely tally with what INEC announced. That's where the manipulations took place.

INEC is saying they are not bound by the electoral act to upload results to IREV. Whatever they may have said contrary to the provisions of the act is immaterial.

And that was exactly what Obi's team requested for (to inspect the BVAS) before filing their petition, so if they have the CTCs of the results, I don't see a problem for them.

None of Obi's prayers is hinged on over-voting, and I doubt that they are citing the IREV as a source of proof for their case.

And let's agree that INEC is not bound to electronically transmit results from the polling units, but the fundamental problem of what is recorded on the EC8A forms and stored in the BVAS also contradicts what is on the IREV and what is on the IREV also contradicts what INEC announced in some instances.

So if Obi's team have their original polling unit results, and CTCs of the BVAS information, I believe they've got no problem.


All of this aside sef, this judgement is confusing to me. Why exactly is INEC not bounded to upload the results to IREV when they literally said this? What is on the IREV should naturally correspond with what is in on the BVAS.

First we must differentiate the Osun case with the presidential. Osun was a case of over-voting and not manipulation. Over-voting can only be solved using the voters register. APC came with an INEC report without even witnesses.

The INEC report was derived from the INEC server which was incomplete as at the time the report was made. The court has made it clear that BVAS is the primary source of data for voters registration and accreditation.

For results transmission, INEC is free to choose which ever way they want to transmit results.

The question A, is what process did INEC choose?

The case at the PEPT is that of result manipulations. The primary source to be used to determine the actual results will not be the form EC8A, but the process to having the EC8A.

Question B is what is the process?

Question C - Was there any violation of the process?

The reason PO's team requested for the CTCs was not to prove that he won, but rather to prove that the results were manipulated.

The INEC Process
The process chosen by INEC to transmit results is through manual collation via form EC8A. Every process should have a control without the control, the process cannot come to a logical conclusion. The control put in place by INEC is the BVAS upload and IREV. The BVAS upload and IREV failed and INEC announced a winner. That's a gross violation of the process and a suggestion that INEC colluded with the winner to manipulate results in their favour.

PO's team have already stated that they are challenging the process as well as the results.

If INEC can produce the original result sheet, coupled with the results being uploaded on the IREV, Obi’s Attorneys would make the argument that there was manipulation of the vote by either INEC or APC. Of course, the onus would be on INEC to prove that final results on its server are authentic and not the result of a hack
