LP/Obidients don’t want Tinubu to become the president until the petition is done with. Same LP/Obidients are now saying Otti must be swear in irrespective of the judgement because there’s room for appeal.

Otti doesnt need to be a party as far as the entire abia and kano lp were sued.it was a pre primary matter contemplated against the party not candidates.
Again,the guy may not be an interloper as that portion of the electoral act was silent on who can sue.but the case must be brought 14 days after occurrence not after primaries which means any party member has the locus.the guy self may have been an aspirant additionally

Not only that the court lacks jurisdiction.

This is a pre-election matter and according to section 285 of the constitution, all pre-election matter must be filed within 14 days of the event.
This case was filed on the 11th day of May, 2023. Alex Otti emerged as the gubernatorial candidate of labour party for Abia State during the primaries held in June 2022

From a mere look, the case is status bared but the judge who is notorious in bribe taking, must have collected money to give this kangaroo judgement having been previously suspended by the NJC in 2016

There’s a breaking news that a Kano High Court (of all courts) has nullified the candidature of Abia State Governor-elect, Mr Alex Otti to which some elements of dark forces are already celebrating and jubilating; erroneously so due to deep seated ignorance and illiteracy.

Let us try to examine that Judgment and how much or how long it can stand the test of time.

First things first, this kangaroo judgment will not stop the inauguration of Alex Otti, all they need to do is file an Appeal at the Appeal Court and the case is settled until he takes oath of office. If the Appeal Court agrees with the High Court (very unlikely), Alex Otti still has the option to Appeal at the Supreme Court. So in all, Alex Otti will be Governor of Abia State for at least 6 months.

With that stated, let’s now check the merits of the case.

The first thing to consider is when did Labour Party conduct their primaries in Abia State and when was the Kano case filed? Labour Party conducted their gubernatorial primaries in Abia in May, 2022. Almost one year later on 11th of May, 2023, somebody is filing a case against the primary. What this means is that the case was “Statute Barred” from the beginning having been filed outside 14 days window period for anyone aggrieved by the outcome of a primary election to seek redress in court.

The next question to ask is who filed the case? Does he have the locus or file the case or he’s just a meddlesome interloper? In the Electoral Act 2022, only a candidate in an election can challenge the outcome of the process in court. Any other being that does so is a meddlesome interloper.

The last thing that would be considered is if Kano High Court had jurisdiction to entertain the case in the first place.

If anything, this judgment will end up getting the judge who gave the ruling banned or sanctioned.

Sometimes you just can’t help but question the mental capacity of those who celebrate and rejoice in this kind of thing. They must be terribly mentally shallow.
An invalidated outcome lacking due process, has no jurisdiction, null & void ab initio.

The law is the law, submit your register thirty days prior, any story is forever a nullity, never existed.

How many days has an aggrieved party to file for redress in court after the conduct of a party primary?

By the Electoral Act 2022, does a party chairman, or an ex party chairman at that, have the locus to challenge the outcome of a primary election he did not contest in?
The petitioner didn’t challenge primary..

He challenged Otti’s candidacy as a whole. Before you contest primary, you need to first become a candidate from your party right, registered by INEC?

He’s candidature is what he challenged! 30days already elapse before his name was registered with INEC!

There is a just cause for that to happen.... No Appeal Court Judge will stay in his way.

For Rivers, it was their Congresses/Convention when there was a previous Court order to that effect, the Stay wasn't granted and they went ahead.

Firstly, Haruna Ibrahim, the ex-chairman is not challenging the outcome of the primary BUT the ineligibility of the candidate 'for the election' . They are two different things.
It's a pre-election matter right? It should have been filed before the general election. Truth be told, the case is DOA. Kaase Aondoakaa SAN also filled a similar case against Fr Alia but it was thrown out because it was status barred. Status barred because it was filled outside of the stipulated time for such matters.

I’m sure you have heard that the judge has denied issuing any such judgment.

The case you are citing was in Zamfara in 2019. And it was INEC that refused to accept APC candidates in Zamfara because they conducted their primaries outside the INEC Timetable. The court simply agreed with INEC.

Again it happened in Rivers after the Court agreed with Magnus Abe tendency of Rivers APC that they were excluded from the Primaries of APC in Rivers.

But these two cases were filed within 14 days of the occurrence of those events.

In Abia case, this individual woke up after 1 year to file the case. Who does that?

And that’s even asides the fact that the facts of the case are not the same.
