There is no way the Nigerian constitution will give Abuja which is not even as big as many states so much power to decide who is elected president. It's you that lacks logic and soundness of mind.

The Constitution stipulates 25% from two-thirds of the 36 States and the FCT.
It simply means a winner must have 25% in 24States of the federation. It could be 25% in 23 States plus 25% in FCT or 25% in any 24 states without 25% in FCT. Either way, it is still correct. Why then the fuss about the legitimacy of Tinubu as the rightful winner of the 2023 Presidential election. 🤷‍♂️🤷‍♂️

The latest evidence arose from another scrutiny of the Supreme Court ruling in the case between Muhammadu Buhari, the then candidate of the All Nigeria Peoples Party (ANPP), and Olusegun Obasanjo, the then Peoples Democratic Party’s (PDP) candidate, on Friday, July 15, 2005, by Mr. Dokun Ojomo.

According to Mr. Ojomo, in the ruling, the apex court had upheld that presidential candidates must win 25 per cent of all votes cast in 24 states, as well as the Federal Capital Territory, Abuja.

Commenting on the outcome of the 2003 Presidential Election Petition Tribunal (PEPT) and the 25% in FCT saga, Ojomo wrote:

“After the 2003 elections, Buhari called for the cancellation of the election since Obasanjo failed to win in FCT but it was resolved that winning the FCT is not mandatory but having 25% in FCT is very mandatory.

There are orphans, widows , falsely accused people seeking genuine justice at court.

As a judge, you wake up in the morning and prepare hard to adjudicate on the matters of those who actually need justice. Those who may die in prison. Those who need bail immediately because of health challenges.

Then the senior lawyers who call their cases before younger lawyers begin to mention cases on the cause list that have no meaning and are frivolous.

The indigent of society that really need justice cannot hire the services of senior lawyers who will call their cases first in court and consume more time. The senior lawyers on the other hand know that it is very dumb to even contemplate to bring such cases to court but because of the money and nuisance value of the case, they institute it in court.

If you have an idea of how many life/death cases that are not given attention because of these irrelevant political nuisance suits, you'd support the court to jail some of these troublemakers.

It's super simple. The FCT is not normally considered to be a state as it has no governor and no assembly. However the constitution for the purposes of federal elections chooses to treat it as a state so it is added specially.

Nigeria has no electoral college meaning each vote has the same importance and carries the same weight as other votes.


The issue has already being well considered in the past by the SC. Its just LP are hard headed and believe that they can achieve anything even illegalities through sheer strength of will.

Why must you have 25% in FCT if you already have won 2/3 of 36 states. The 25% in FCT only applies if you don’t win 2/3 of the 36 states. Tinubu won 2/3 of the 36 states so he was rightfully declared your president.

That's why the CFRN 1999 provides for an Election Petition Tribunal. They set aside expert judges to entertain election matters while other judges remain in their courts and entertain the cases of the common man.

Those who drafted the constitution knew that if a special tribunal was not created for election losers who are politicians with wealth and followers, there would be no time for other cases apart from political cases.

Anything you're not satisfied with should be brought by the party with locus standi to the election petition tribunal.
