duro4chang:No. This judgement won’t affect Obi because he participated in the primary election monitored by INEC. This judgement stated that Ngozi is not a LP member as at the time the primary election was held. I think his name was swapped with someone’s who participated and won the primary. |

shortgun:Did you read the reason he was sacked? The Tribunal ruled that as at 28 may 2022 that the primary was held, Ngozi was not a member and didn’t participate in the primary election. You all should start asking Aburi and co how come his name was submitted to Inec and not the real winner of the primary. |

FalseProphet1:Most LP party candidates are going. Ngozi isn't reclaiming anything back. The law is explicit about party membership and sponsorship in an election. It is parties that sponsor candidates in elections. How is one a member of a party when their names aren't in the party register which should be submitted to INEC 30 days before any primary election as prescribed by law? |

seanfer:All matters that has to do with how candidates are nominated by political parties for elections are treated as pre election matters . nomination of a candidate; double nomination of a candidate; disqualification of a candidate; wrongful substitution of a successful candidate’s name by the electoral body; wrongful omission of a successful candidate’s name by the electoral body; complaints about the conduct of primaries, and false declaration on oath about particulars of a candidate. Only aspirants of the same political party have local stadi to challenge outcomes of nomination processes in court within 14 days from the day the event occurred; members of other political parties are considered as persona non Grata. Kindly note that these are not my personal opinions but the position of the law. |

seanfer:I am not wrong, the electoral act is very clear on who have constitutional right to challenge nomination processes by political parties. Elumelu in PDP doesn't have the constitutional right to challenge how labour party nominates it's candidates no matter how flawed the processes are. Only an aspirant who must have participated in the party primary can seek redress in the high court not even the tribunal cos all pre election matters goes to the high court. |

shortgun:Elumelu was not contesting the party nomination of Ngozi... What he is contesting is that Ngozi didn't participate in the primary election so how come LP forward his name to INEC and therefore votes that belong to him should become void and the court rule in his favour. |

It's not his business how labour party chooses to nominate it's candidate...this is the position of the law. The case will be dismissed and thrown out by the court of appeal 1. the tribunal lacks jurisdiction over all pre election matters. 2. Elumelu lacks locus standi 3. time permitted for filling of such cases in the high which is 14 days have long elapsed |
