Please Help!!! A Bank Marketer (not Bank) Arrested My Brother Over A Loan by concho(op): 6:44am On Aug 13, 2023

Good morning Friends,
Sorry I’m coming up with this on a Sunday morning .

My brother has been very sick since January after his warehouse got vandalized and couldn’t offset a bank Loan.

He was diagnosed of hepatitis B and his condition got from better to worse

I knew the debt was part of what was eating him up , So I promised him that will do what ever is within my power to offset the debt just to save his sanity and health

I called the lady ( loaning officer) that aided him in the loan process and requested for restructuring since it’s a commercial bank (Sterling bank)

I explained the critical nature of my brother’s sickness to her and my brother’s inability to repay the loans

She said “No” to restructuring and started laying curses on my brother with threats.
She later called to inform me that she has taken the case to a Deity in her village ( Over a bank loan)

Fast forward to last night , She came with armed police men on tricycle and beat up my brother , chained him and took him away .

I immediately put a call across to Sterling bank to know if they authorized or came for the arrest on Saturday evening and they said “No”

They said that they don’t have a hand in the arrest and they don’t operate that way

Please friends , how do I go about this huh

My brother is still in detention and the woman is still threatening to jail him

Seems like she gave him the loan from her own pocket....that's why she is pained that he failed to upset the loan.

And i think what she did is against the bank rules... giving out loan to a customer using your bank name...it might put her in trouble too.

Just try to see her and iron out things....

Did he use himself as a collateral? That was an illegal sharp loan from a customer account and the banker was the guarantor. The customer is threatening and on the banker for his/her money.

I would have suggest you contact a lawyer and sue her for kidnapping.But justice is expensive here in Nigeria.

Get a lawyer, go to the bank and make a formal petition. Join the lady's name in the suit. Trust me the bank will be the one to pay you at the end. Owing is not a criminal case; it's a civil case. Be like say the lady don work for LAPO before. It's an illegal arrest!

Give full info.
What was ur brother selling? What was in d warehouse? Wasn't it insured? How much did he borrow? What purpose? When? When was the warehouse vandalised? How much of the loan has he repaid?
Taking such extreme measure against ur brother tells me there is something u ve not told us.
As for advise, u said u already called the bank and they told u they don't do such. So go back to them and ask them y they did so in this case.

No one, whether bank or marketer, has a right to put someone in jail for legitimately owing money. Being a debtor is a civil issue and not a criminal issue.

What you can do is make sure the lady loses her job by blaming his predicament on Sterling bank, forget the lady. If you make the right public noises, Sterling would be forced to warn the lady and she will stop with her harassment. You can still engage a lawyer if you want to as what the lady and police have done is illegal.

But their is an exception, if your brother issued a dud cheque to either the lady or the bank, he has commited a criminal offence. You need to determine that before you proceed.

I have one question for you. Are you sure,you even have sense at all? So,because he too a loan,he should be kidnapped abi? Even your federal government dey take loan too.. Its not a crime.. And even if he couldn't pay back in time,then we have the collateral to make the payment easier,rather than kidnapping him with armed men ..Why will that bank thief give out a loan without collateral? She was in doing some illegal stuff in the bank. As such,if this case is goes beyond this,she will definitely loose her job.. And the op brother might get the upper hand in this case.. Op take the case up immediately.. The woman go beg tire. You have to be spiritually strong too. Seek for spiritual back up for you and your brother, then take the case up..

That bank staff loaned bank money to your brother without authorization.

Get a lawyer and see to your brother being bailed then begin legal action against the bank staff and the police.

That loan is a civil transaction.
1. Petition that Banker direct to her head office.
2. Get your brother out on bail. The police have absolutely no business being debt recovery agents.
3. Sue that lady and the police for enforcement of fundamental human rights. Claim damages.

I think Op added sickness to the post to garner pity from readers,his brother might not even be sick.
Also Nigerians have bad culture of not wanting to pay back loans, whether rich or poor,which is bad and selfish.
Nevertheless where's your humanity. Do you know circumstances of life can make a man unable to meet up with loan payment?

The banker will lose her job. She probably cut corners and didn't follow the bank rules to give out that loan. Your brother must have begged her so much for her to have given the loan to him. Now your brother will make her lose her job.
