CHICAGO STATE UNIVERSITY: US COURT SAYS IT HAS JURISDICTION IN ATIKU VS TINUBU CASE

The United States District Court for the Northern District of Illinois, Eastern Division, says it has jurisdiction in the case instituted by the Peoples Democratic Party (PDP) Presidential candidate, Atiku Abubakar, to compel Chicago State University (CSU) to produce critical documents relating to Bola Ahmed Tinubu.
Tinubu who is currently the President of Nigeria contested the February 25 Presidential election on the platform of the All Progressives Congress (APC).
Atiku’s application was spurred by an earlier case in Nigeria precisely on November 9, 2022, several months before the Presidential elections, in which one Mr. Mike Enahoro-Ebah, described as a “Human Rights Defender and Public Interest Litigator” in Abuja, Nigeria, commenced proceedings against Mr. Tinubu by filing a “Direct Criminal Complaint” in the Chief Magistrate Court of the Federal Capital Territory (FCT).

In his complaint, Mr. Enahoro-Ebah alleged that Mr. Tinubu submitted an “Affidavit of Personal Particulars” to INEC in June 2022 as part of a required filing to run for President that included a forged CSU diploma dated June 22, 1979 and other information that is inconsistent with the CSU documents.

According to court papers filed by Atiku in the US court dated August 2, 2023, to support the allegations, “Mr. Enahoro-Ebah stated that after Mr. Tinubu made his INEC filing, Mr. Enahoro-Ebah obtained a subpoena from the Circuit Court of Cook County, dated August 11, 2022, and served it on CSU. In response to the subpoena, CSU’s Registrar, Mr. Caleb Westberg, sent a letter dated September 22, 2022, to Mr. Enahoro-Ebah’s Chicago counsel, Mr. Matthew J. Kowals, advising Mr. Kowals that “[t]he enclosed documentation is all the records we have for Bola E. Tinubu.

“According to the complaint, the documents that accompanied Mr. Westberg’s letter included a CSU diploma issued to Mr. Tinubu on June 27, 1979. The June 27 diploma allegedly produced by CSU to Mr. Kowals, and the June 22 diploma allegedly submitted by Mr. Tinubu to INEC, are very different documents. In addition to the different dates, the documents have different seals, fonts, and language.

The June 22 diploma has grammatical errors that the June 27 diploma does not have. They are also signed by different persons who are ostensibly officials of CSU. The June 22 diploma has three signatures, one of which purports to be the signature of Dr. Elnora Daniel as President of CSU. The other two signatures on the June 22 diploma are illegible.

“By contrast, the June 27 diploma only has two signatures. They purport to be the signatures of Dr. Daniel, again as the President of CSU, and Dr. Niva Lubin as the Chairperson of the Board of Trustees. Compare

“In his complaint, Mr. Enahoro-Ebah asserts that the June 27 diploma produced by CSU to Mr. Kowals is authentic, and that the June 22 diploma submitted by Mr. Tinubu to INEC is a forgery. However, Applicant’s staff have recently conducted further research into the names of CSU officials with legible signatures on the two diplomas: Dr. Daniel (whose signature appears on both the June 22 and June 27 diplomas) and Dr. Lubin (whose signature appears only on the June 27 diploma).

According to public records, Dr. Daniel and Dr. Lubin did not join CSU until the late 1990s—around two decades after CSU supposedly awarded the June 22 diploma and/or the June 27 diploma to Mr. Tinubu.
Applicant’s research therefore calls into question the authenticity of both the June 22 and the June 27 diplomas.
In his complaint, Mr. Enahoro-Ebah alleged the following additional discrepancies between the information provided by Mr. Tinubu to INEC and the documents produced by CSU to Mr. Enahoro-Ebah:
“According to documents produced by CSU, the “Bola Tinubu” who attended CSU was a U.S. citizen, while in the information provided to INEC, Mr. Tinubu states that he has always been solely a Nigerian citizen and has never acquired the citizenship of any other country. According to the documents produced by CSU, the “Bola Tinubu” who attended CSU was born in 1954, while according to the information provided to the INEC, Mr. Tinubu was born in 1952.

“According to the documents produced by CSU, the “Bola Tinubu” who applied to CSU submitted a prior transcript from Southwest College that identified “Bola Tinubu” as “female.” According to the documents produced by CSU, the “Bola Tinubu” who attended CSU claimed that s/he had graduated from Government College, Lagos, in 1970, while in the information provided to INEC, Mr. Tinubu makes no mention of having attended Government College.

Pursuant to the above, Atiku, by and through his counsel, applied to the Court for an order granting him leave to compel CSU to release and verify the authenticity of documents purportedly issued to Tinubu by the university.
Going by available court papers, the Court has established that it has jurisdiction over this matter in accordance with US laws which “authorizes any “interested person” to request that a United States District Court order the discovery of documents and testimony for use in a foreign proceeding from persons that “reside[] or [are] found” within its District.”
The court said Atiku has satisfied all statutory requirements as he is an “interested person”; and the respondent, CSU, is a public university established and existing under the laws of Illinois, with its principal campus and offices in Chicago.
Having met all requirements, the court said it will not hesitate to grant the prayers of Atiku.

A Federal High Court, Abuja, on Tuesday, dismissed a certificate forgery suit filed by the Action Alliance (AA) against Sen. Bola Tinubu, presidential candidate of the All Progressives Congress (APC).

Justice Obiora Egwuatu, in a judgement, held that the suit instituted by AA was statute-barred, having not been commenced within the mandatory 14 days provided for under the 1999 Constitution (as amended by the Fourth Alteration Act).

Justice Egwuatu said that the suit had become academic and grossly incompetent, hence, the court lacked the requisite jurisdiction to entertain it or grant the reliefs sought by the plaintiff.

The judge, who said that the plaintiff lacked locus standing to file the suit, also held that it acted like a busybody, having interfered in the internal affairs of another party.

He consequently dismissed the suit for constituting an abuse of the court process.

The News Agency of Nigeria (NAN) reports that the AA, in a suit marked: FHC/ABJ/CS/954/2022, had sued the Independent National Electoral Commission (INEC), APC and Sen. Bola Ahmed Tinubu as 1st to 3rd defendants respectively.

In a writ of summons dated and filed on June 21 by its lawyer, U.O. Ukairo, AA sought a court declaration that the claim of the 3rd defendant (Tinubu) that he attended Government College, Ibadan and the University of Chicago on his INEC FORM CF 001 in 1999 which he presented to the 1st defendant (INEC) was false.

It also sought a declaration that the false information on the APC presidential candidate’s “INEC FORM CF 001 wherein he claims to have been awarded a Bachelor of Science Degree in Economics by the University of Chicago is a forged certificate.”

It further sought a declaration that in view of Section 137(1)(j) of the 1999 Constitution, Tinubu, having in 1999 presented a forged certificate to INEC in INEC FORM CF 001 which he submitted as a candidate in the 1999 general elections for the post of the Governor of Lagos State was not qualified to contest for the office of president of the Federal Republic of Nigeria.

The party, which urged the court to declare that the submission of Tinubu’s name to the electoral umpire by the APC (2nd defendant) as its 2023 presidential candidate is null and void and of no effect, prayed for an order of perpetual injunction restraining INEC from publishing his name as a candidate in the general elections.
AA also sought an order of perpetual injunction restraining INEC from listing APC as a political party in the ballot for the conduct of the 2023 presidential election to be conducted by INEC.

But in a preliminary objection dated Nov 1 and filed on Nov. 2 by the APC and Tinubu’s legal team led by Lateef Fagbemi, SAN, they argued that the court lacked jurisdiction to entertain the suit.

They, therefore, urged the court to strike out the suit in its entirety.

They said that the originating process was fundamentally and incurably defective.

Besides, the defendants said that the suit disclosed no reasonable cause of action against them, especially the 3rd defendant (Tinubu), among other arguments.

An Abuja-based lawyer, Mike Enahoro-Ebah, has sued the All Progressives Congress (APC)’s presidential candidate, Asiwaju Bola Ahmed Tinubu, over allegations bordering on certificate forgery, falsification of age and lying on oath.

Enahoro-Ebah sued Tinubu in three separate direct criminal complaints filed at the Chief Magistrate’s Court, Wuse Zone 6, Abuja.




While the legal practitioner is the complainant, Tinubu is the sole defendant in the cases marked: CR/121/2022, CR/122/2022 and CR/123/2022 respectively.

The suits, dated November 9 and filed on November 10, 2022 by the lawyer himself were brought pursuant to sections 88(1), 89(3), 109(a), 110(c) and 115(1)(b) and 119 of the Administration of Criminal Justice Act (ACJA), 2015; under the inherent jurisdiction and powers of the court secured by Section 6(6)(a) of the Nigerian Constitution,1999 (as amended).

Enahoro-Eba alleged that documents obtained from the Chicago State University by his attorney in the United States, Matthew J. Kolwals through a subpoena in 22-L-007289, contained information that contradict the material information provided by Tinubu in his sworn Form EC-9 Affidavit In Support of Personal Particulars submitted to INEC on June 17, 2022.


In case number: CR/121/2022, Enahoro-Ebah alleged that Tinubu presented “a forged Chicago State University certificate to INEC with intent that it may be acted upon as genuine, thereby committed the offence of forgery contrary to Sections 362(a), 363 and 364 of the Penal Code Act, Cap. 532, Laws of the Federal Capital Territory, Abuja.”

Enahoro-Eba alleged that the copy of the Chicago State University Certificate released by the school “is radically different” from the copy attached to Tinubu’s sworn Form EC-9 submitted to INEC on June 17.

According to him, a direct comparison of both certificates reveal different dates of issue by the university (June 22, 1979 and June 27, 1979); different university logo on both certificates; different grammatical construction on faces of the certificates, different signatures, among others.

He said in support of the defendant’s undergraduate admission application form submitted to Chicago State University in 1977, was a transcript from Southwest College, Chicago, bearing the name, “Tinubu Bola A” which belongs to a female student, contrary to Form EC-9 submitted to INEC which indicated that Tinubu is a man.

The lawyer further alleged that the Tinubu that attended the university indicated in his undergraduate admission application form that he graduated from Government College, Lagos in 1970, while the defendant in his Form EC-9 submitted to INEC provided no information as to his attendance of the said Government College, Lagos, among other allegations.


No date has been fixed for hearing.

Certificate forgery suit against Tinubu dismissed

LAGOS — A Federal High Court sitting in Lagos, yesterday, dismissed the suit seeking to compel the Inspector-General of Police to commence investigation into the alleged certificate forgery case, started in 1999 by late Chief Gani Fawehinmi, against former governor of Lagos State, Asiwaju Ahmed Tinubu.


Ruling on an application by Dr. Adegbola Dominic, a medical doctor and Lagos resident, Justice Saliu Saidu held that by Order 34 Rule 4 of the Federal High Court Civil Procedure Rule, the applicant failed to satisfy the mandatory requirement that such an application must be filed within three months of the detection of the alleged fraudulent action.




The judge said since the application was not brought within the stipulated time, as mandated by the rules of the court, it was bound to fail.

Citing series of authorities in support of his ruling, Justice Saidu held that the applicant went to sleep since 2007 when the toga of immunity could no longer shield Tinubu, and suddenly came up to exercise his right, now that the matter was statue barred.

He said: “There is need to comply with stipulated rules of the court. This matter is grossly out of time and prayer sought cannot be granted.”

His complaint was in respect of the contents contained in the Independent National Electoral Commission Form F001 and affidavit concerning lost certificate, allegedly sworn to by Tinubu during the governorship elections.

In a 15-paragraph affidavit of verifying facts, the applicant deposed that Tinubu claimed to have attended St. Paul’s School, Aroloya, Lagos, and that he also allegedly claimed to have attended Government College, Ibadan, between 1965 and 1968, a claim which the authorities and Old Boys Association of Government College, Ibadan, were said to have described as untrue.

According to The Africa Report, Keyamo, who is now the Spokesman for the Tinubu Campaign Organisation, had in the case with suit number ID/639M/99, dragged all 41 members of the House before Justice C.O Segun of the Lagos State High Court.

The Minister of State for Labour and Employment, Festus Keyamo, in 1999, sued the Lagos State House of Assembly for clearing then Governor Bola Tinubu of allegations of certificate forgery and perjury.

According to The Africa Report, Keyamo, who is now the Spokesman for the Tinubu Campaign Organisation, had in the case with suit number ID/639M/99, dragged all 41 members of the House before Justice C.O Segun of the Lagos State High Court.


He had argued that the court should determine that only the chief judge could investigate Tinubu for certificate forgery.

Earlier, Gani Fawehinmi had accused Tinubu of forging his school certificates and sought an order from the court compelling the police to investigate him. The court ruled that because Tinubu enjoyed immunity at the time, only the Lagos State House of Assembly could investigate him.

The Assembly subsequently investigated him and within a week, he was cleared of all wrongdoing.


Dissatisfied with the resolution of the Lagos Assembly, Keyamo, who was a protégé of Fawehinmi sued all the members of the state legislature for clearing Tinubu.

In the origination motion, Keyamo noted that Tinubu had in the forms he submitted to the Independent National Electoral Commission (INEC), stated that he attended Government College, Ibadan, from 1965 to 1968 and then proceeded to Richard Daley College, Chicago, Illinois, USA, from 1969 to 1971 before completing his studies at the Chicago State University in 1979 but that the certificates were lost.

Keyamo recalled that based on the allegations that the certificates were forged, the Lagos State House of Assembly set up a five-member panel that investigated Tinubu for only four days and could not have done a thorough job.

He added that the Assembly lacked the constitutional power to investigate perjury and its findings were thus null and void.

He, therefore, sought four reliefs including a declaration by the court that “the final report submitted by the said five-man panel on Monday, September 27, 1999, to the defendants which in its totality cleared the Governor of Lagos State, Senator Bola Ahmed Tinubu of allegations of forgery and perjury is null and void and of no effect.”

However, the court struck out the matter because it was not supported by an affidavit. Keyamo took the case to the Court of Appeal where he lost again and then to the Supreme Court where he was finally defeated.

In his response to The Africa Report, however, Keyamo said he only challenged the right of the Lagos Assembly to clear Tinubu and not the actual findings of the report.

FLASHBACK: How Late Gani Fawehinmi Sued Tinubu For Lying Under Oath He Attended Government College Ibadan, University Of Chicago

Tinubu had made the claim of loss of certificates in his filings with the Independent National Electoral Commission (INEC) in 1999 and 2003 when he ran for governor of Lagos State.

On October 7, 1999, the late human rights lawyer, Gani Fawehinmi (SAN) filed an order at the Federal High Court, Lagos to compel security operatives to investigate criminal allegations which he made against the then governor of Lagos State, Bola Tinubu.

Tinubu had made the claim of loss of certificates in his filings with the Independent National Electoral Commission (INEC) in 1999 and 2003 when he ran for governor of Lagos State.




He however stated in 1999 that he attended St Paul Children’s Home School, Ibadan, from 1958 to 1964 and Government College, Ibadan (GCI) from1965 to 1968 before proceeding to Richard Daley College, Chicago, from 1969 to 1971 and the University of Chicago.

Fawehinmi in the court documents had filed an order of mandamus praying the court to compel security operatives to investigate the allegations against Tinubu who had earlier been cleared by the Lagos House of Assembly.


“AN ORDER OF MANDAMUS compelling the respondents whether, by themselves, their agents, servants, privies or otherwise however to investigate the applicant’s complaint of false statements on oath and false declarations made under oath by Mr Bola Tinubu as contained in the two documents, that is: Independent National Electoral Commission Form CF001 declared and verified under Oath by Mr Bola Ahmed Tinubu (now Governor of Lagos State) before the Commissioner for Oaths at the High Court Registry, Ikeja on December 28, 1998,” the court document had read.

“And Affidavit entitled; Affidavit in respect of Lost Certificates sworn to by Mr Bola Ahmed Tinubu (now Governor of Lagos State) before the Commissioner for Oath at the High Court Registry, Ikeja on December 29, 1998.”


The Federal High court in its judgement however ruled that Tinubu as then sitting governor could not be tried as he enjoyed immunity from prosecution. The Appeal Court also upheld the judgement of the lower court.

The late legal luminary then headed to the Supreme Court and the apex court ruled that though Tinubu enjoyed immunity from prosecution, he could be investigated by the police over the allegation and tried after his tenure.

However, 15 years after his tenure as the governor of Lagos state, the Nigeria Police Force has refused to charge him as ruled by the Supreme Court.

In 2013, one Dr. Dominic Adegbola filed an unsuccessful application seeking to reopen the suit.

The late Adegbola had sought an order compelling the Inspector-General of Police (IGP) to commence an investigation into the alleged case of certificate forgery.

Dismissing the application, Justice Saliu Saidu held that, by Order 34, Rule 4 of the Federal High Court Civil Procedure Rules, the applicant failed to satisfy the mandatory requirements of the law.

Justice Saidu also held that such an application should have been filed before the court within three months when the alleged fraudulent act was detected.

According to the judge, since the application was not brought within the stipulated time, as mandated by the rules of court, it was bound to “hit the rocks”.

Though Tinubu later presented a certificate indicating he attended Chicago State University but SaharaReporters learnt that had never been the issue in contention as raised by the late legal luminary, Fawehinmi.

The issue raised by the late lawyer was about what he (Tinubu) filled in the INEC form F001 he submitted to the electoral body as his academic qualifications in 1998 which included the claim that he attended the University of Chicago and not Chicago State University.

The University of Chicago is a private research university in Chicago, Illinois while on the other hand, Chicago State University is a predominantly Black, public university in Chicago, Illinois that is not highly regarded.

Also challenged was what he filled in the INEC form that he attended St. Paul’s School Aroloya, Lagos for his primary education, which does not exist; University of Chicago; Government College, Ibadan between 1965 and 1968, which the authorities and Old Boys Association of Government College, Ibadan debunked.

Tinubu and the certificate scandal that refuses to die

IF there is anything that the presidential candidate of the All Progressives Congress, APC, would want to die down at this critical moment, it is the certificate scandal that has dogged his political career for more than two decades.




Though he survived the scandal when it first reared its ugly head in 1999 even as the then Speaker of the House of Representatives, Salisu Buhari, accused of the same scam, lost his plum office, it has refused to go away.

Tinubu survived the scandal then because the same gladiators who forced Buhari to resign on July 22, 1999, exactly 49 days after he clinched the coveted seat of the House of Representatives Speaker, turned around to save his neck from the political guillotine. And what was the case against Tinubu? Like Salisu Buhari who claimed to have attended University of Toronto in Canada and graduated with a degree in Business Administration, when he did not, shortly after he was sworn in as governor of Lagos State on May 29, 1999, there were allegations that Tinubu had perjured and forged the credentials that qualified him to run for the governorship election.

The allegations were contained in a petition dated August 12, 1999, written by Alhaji Jameed Seriki and Dr. Waliu Balogun-Smith. They alleged a discrepancy in Tinubu’s age since the profile published during his inauguration stated that he was born in 1952 and the age on his transcript at the Chicago State University claimed that he was born in 1954.

They also alleged that he did not attend Government College, Ibadan, as was stated in his profile and INEC FORM CF.001, and the University of Chicago as claimed in INEC FORM CF and an affidavit sworn to at the Ikeja High Court of Justice on December 29, 1998. Unlike Buhari who had no constitutional bulwark to shield him, by this time, Tinubu was already the governor and so enjoyed immunity, courtesy of Section 308 of the 1999 Constitution.

The onus, therefore, fell on the Lagos State House of Assembly dominated by the Alliance for Democracy, AD, to investigate him and take punitive action if he was deemed to have committed acts constituting gross misconduct.

[b]Of course, that was not going to happen. So, despite the fact that following a motion moved by Tajudeen Jaiyeola Agoro, who represented Lagos Mainland Constituency, the then Speaker, Dr. Olorunimbe Mamora, on Tuesday, September 21, 1999, set up a five-man ad hoc committee comprising Babajide Omoworare (Chairman), Thomas Ayodele Fadeyi, Adeniyi Akinmade, Ibrahim Gbola Gbabijo and Saliu Olaitan Mustapha, to investigate the allegations, Tinubu survived the scare.

But the questions were not answered. In 1999, he claimed to have attended Saint Paul Aroloya Children Home School, Ibadan between 1958 and 1964 and Government College, Ibadan between 1965 and 1969. The petitioners claimed that he did not. So, the question is simple.


Did he or did he not? And because the monster that was Tinubu’s certificate scandal was not exorcised, it has reared its ugly head once again 23 years after and it will not go away because the man in the eye of the storm has refused to clear the air. He believes that he will successfully ride the storm.

That may well be true. In any other country other than Nigeria, Tinubu would have voluntarily thrown in the towel like Salisu Buhari did in 1999 or be forced to do so. Tinubu submitted an affidavit to the Independent National Electoral Commission, INEC, claiming his degree certificate was carted away by the Nigerian Army during a raid. But in doing so, he left the fields for primary and secondary school education blank, meaning he didn’t acquire those certificates even as he claimed to have obtained a degree in business and administration in 1979. Refusing to provide the information as required by law has further aroused public indignation.

While Tinubu is keeping mum on the matter, his surrogates are speaking up, but even in doing so, they have refused to address the real issue. On Tuesday, human rights activist, Dr. Tunji Abayomi, said Tinubu graduated from the University of Chicago in flying colours and was the overall best graduating student in accounting.


“Let me say here that in his working career, Tinubu has served as an accountant in various companies, including Arthur Andersen, Haskins and Sells, Deloitte and Douche, GTE Service Corporation, America’s largest communication and utility company and auditor and later treasurer at Mobil Oil Producing Unlimited,” Abayomi wrote on his Facebook wall. “He was once a distinguished Senator of the Federal Republic of Nigeria, a NADECO chieftain and major financier alongside Pa Alfred Rewane and Governor, Lagos State,” the senior lawyer who has supported Tinubu’s presidential ambition to the hilt wrote.

The same day, Imo State governor, Hope Uzodimma, introduced a rather ludicrous slant to the whole saga when he blamed what he called the inefficiency of INEC’s server for the mess. “In 1999, Tinubu contested elections and became the governor of Lagos. In 2003, he contested election for a second term. He ran and won as a senator in the country. Were records keeping efficient, and INEC server functional, he wouldn’t need to do fresh submission (of documents),” Uzodimma said. Nigerians have been scratching their heads, trying to make meaning out of his harebrained submission.


In the 23 years since this scandal blew open, Tinubu has done everything humanly possible to squash it. Ironically, the only thing he has refused to do is the easiest: produce the certificates or provide proof that he attended those schools and shame his detractors. Like his political soul mate, President Muhammadu Buhari, who would rather hire dozens of Senior Advocates of Nigeria, SANs, to defend him in court than show Nigerians his WAEC certificate, Tinubu has wilfully refused to assuage the anxiety of Nigerians.
