how did all this highest bider judges always reason self, pre election mater? How did the judges want the guy to know that his party Logo will not be on the ballot paper, was it not on election day that many candidate discover that their party lago was missing in Senate, house of rep, house of assembly ballot paper. All these highest bider judges stop all these their nonsense judgement o.

I will advise you to read well and research thoroughly before coming online to make yourself look dull.
To school you, LP candidates are losing out in states or places where court or legal cases are instituted against the outcome of the last election. If there's no such legal case(s) against LP candidates in Kaduna, you do not expect the court to dismiss or void the election of anyone,since there's no complaint or any court injuction to that effect. By the way, you did not only appear weak and dull, you also sounded watery.

Pre-Election matters are a set of events which arise during primaries, sponsorship, nomination and/or submission of names of Candidates, etc. To approach the Court for any redress wrt Pre-Election issues, the suit must be filed not more than 14 days after the cause of action.

Sponsorship and nomination are strictly pre-election matters. It has always been that way.

In the Electoral Act 2010, here reproduced; it is clearly stated thus:

Section 87(10):
Notwithstanding the provisions of the Act or rules of a political party, an aspirant who complains that any of the provisions of this Act and the guidelines of a political party has not been complied with in the
selection or nomination of a candidate of a political party for election, may apply to the Federal High Court or the High Court of a State, for redress.

The Supreme Court also re-echoed this in their many judgements: Tarzoor v Ortom, Eze v PDP, Emenike v PDP, Lado v CPC, Shinkafi v Yari, PDP v Sylva, and so on.

This did not readily change in substance in the amended 2022 EA (now in S84(14):

Notwithstanding the provisions of this Act or rules of a political party, an aspirant who complains that any of the provisions of this Act and the guidelines of a political party have not been complied with in the selection or nomination of a candidate of a political party for election, may apply to the Federal High Court for redress.

The key word here is AN ASPIRANT. Only a person who participated in the Primary has the required locus to challenge same.

You know politicians plan ahead
In the Electoral Act 2010, any person can challenge a Party Candidate with respect to entering false information on Form CF001 or even forged or falsified documents as the case may be.

S31(5): Any person who has reasonable grounds to believe that any information given by a candidate in the affidavit or any document submitted by that candidate is false may file a suit at the Federal High Court, High Court of a State or Federal Capital Territory against such person seeking a declaration that the information contained in the affidavit is false

It is under this Section that Douye Diri & the PDP approached the Court to eventually sack then Gov-Elect, David Lyon, this did not go down well with some.

However, the lawmakers led by their Principal Officers (Chief of which is Gbajabiamila) sensing that this will be a big problem going forward for reasons you and I know, ensured that during the Electoral Act Amendment, certain sections of the Act needed to be tweaked.

S31(5) became S29(5) of the Electoral Act 2022:
Any aspirant who participated in the primaries of his political party who has reasonable grounds to believe that any information given by his political party’s candidate in the affidavit or any document submitted by that candidate in relation to his constitutional requirements to contest the election is false, may file a suit at the Federal High Court against that candidate seeking a declaration that the information contained in the affidavit is false.

I still find it ludicrous that you seek public office whether Senate, House of Reps, Gov, Dep Gov or even President and yet hide critical educational documents which ordinarily should be public documents. All you need is SSCE, no big degree sef! During the amendment, I saw it and was complaining, unfortunately, it ends here on nairaland.

To add to this, the tribunal is different. It is sui generis, a special Court of its own. Issues of forged documents or any other matter that touches on the Constitutional eligibility requirements of that Candidate can be filed.

To the issue in the topic I believe the reportage here is a bit confusing.

To the best of my knowledge, Labour Party had no Candidate for the Lagos Central Senatorial District in February. Dabiri was trying to justify why he was the LP Candidate, his case is like Olumide the actor who everyone thought was the Surulere Candidate. Only an aspirant and/or his Party who participated in the election can go to the tribunal.

Dabiri was trying to justify why he is a member of the LP, the tribunal is the wrong place to do that. This case was rightly dismissed and he is lucky he did not get a fine.

The issue of omission of party symbol is grave and ordinarily the Senatorial election should have been cancelled IF and only IF Dabiri/LP participated in the election.
