You might have to go back to the background of the story the op is making reference to.
The woman left her cohabiting husband house with about 4children, got married to another man that works under the man as a pastor of a branch of the church, he changed the children names to the new husband's name, and she is putting up culture as a defence

You realise many high courts do not have jurisdiction to some traditional issues?

That is what is good for your culture according to your elders(ancestors), some culture do not see it in the same manner.
In Yoruba culture, the family (man) will make him responsible for the child well being, by extension, the mother of the child, meaning if you don't have the capacity, don't try to impregnate a lady.
Either ways, it's to prevent a similar occurrence, albeit, in different form
