Caution fee is supposed to be refunded if nothing spoils. Sometimes, things spoil more than what the caution fee can cover. So, as long as the tenant maintained the house, meaning d tenant spent money despite you holding the caution fee; it has to be refunded.

Ask lawyers, nothing would happen as long as the landlord took caution fee. It would av been better such was not taken.

I do not get why refunding caution would be an issue. Tenants are always shocked when I refund their cautions in full. As long as you did not do any damage to the apartment, I am OK. Even wallpaper and 3D wall is OK and any modification as long as you leave the modifications without trying to take them off the walls damaging it.
