Wallade:Mobilization are in various stages, it's both internal or external mobilizations. The internal is done by the school with your consent (because you need to submit you statements of result, age declaration or certificate, Jamb admissions letter/ regularization as the case maybe) then the institutions will send your name to NYSC to checked of you're qualified for scheme or exempted using your date of birth and date graduation as a yardstick. It is at your external mobilizations where you will be notified either you're qualified for the scheme or not. If you ever served, you will see people of 40 to 50 years serving, do you think all them forged their ages? |

**The NBA Should Be Ashamed Of Its Lawsuit Against Kenny Ogungbe Over His NYSC Certificate** As Founder of Naija Lives Matter NGO, and a member of the Nigerian Bar since 1986 (though I now practice mostly in the USA since 1997), I must publicly express my outrage and disappointment at the irresponsible actions of the Nigerian Bar Association in suing Chief Kenny Ogungbe, one of the most accomplished entertainment moguls our nation has ever seen, for his commendable and VOLUNTARY action of going back to do his NYSC (National Youth Service Corps for college graduates in Nigeria), over 30 years after returning from the United Kingdom. If they wanted to go after the Minister, why victimize Kenny Ogungbe who just did his patriotic duty, even if it’s 30 years after the fact, without being compelled by anyone to do it? Why is the NBA not happy focusing on the minister and the government ? In a nation with a myriad of problems, including serious issues in the judiciary as publicly identified by top legal luminaries in the profession like Femi Falana SAN, Olisa Agbakoba SAN, and Olanipekun SAN, which include corruption in the judiciary and lack of good welfare for our judges and magistrates, it is most disappointing that the NBA could not find a more worthy suit to file other than against a business mogul to invalidate an NYSC certificate he spent 12 months earning, when he had absolutely no compulsion to do it but for the love of country. It is most shocking that rather than commending Chief Kenny Ogungbe for his laudable example, even if they have issues with the powers of the minister to issue a certificate, our totally underwhelming and irresponsible NBA decided that their time, as representatives of ALL lawyers in Nigeria and the legal profession, is better served by suing Kenny Ogungbe along with the Minister for obtaining NYSC certificates after giving one year of practically FREE service to the nation. Nigeria has been a very strange place in the last few years, but we are fast getting to ridiculous levels when we can no longer count on a body like the NBA to tackle very serious and weighty issues in our nation. So, instead of pioneering creative and aggressive efforts to clean up our very tarnished judicial system, our NBA of Lawyers chose to entertain us by seeking the court to punish entertainment executives Kenny Ogungbe for his selfless national service, even if it’s 30 years belated, when this eminent personality could have just moved on? The underwhelming hubris and levity of this NBA is fast becoming legendary. To be clear, if the NBA wants to petition for the minister to be removed for not having done youth service before becoming minister or for incompetence on this issue and other issues, then let them pursue that and leave the innocent executive alone. Adding Kenny Ogungbe to the lawsuit is just entertainment and unnecessary theater that is unbecoming of a supposedly serious organization as the NBA. Now these gentleman will need to go pay lawyers to defend him since is a serious business man who is not likely to just ignore the NBA’s childish tantrums since it’s now a matter in court. What a shame and a waste of their time and resources. The NBA should have considered and realized that taking a personality like Kenny Ogungbe to court over an issue that should really be between them and the govt is just giving him free publicity and making him more popular when the NBA has more urgent and consequential things to spend its resources on. The NBA used to be a source of pride to all of us lawyers when serious personalities like Akeredolu SAN, Olisa Agbakoba SAN, Alao Aka-Bashorun SAN were in the lead, focusing on relevant and impactful agitation for law and justice in Nigeria. I simply do not recognize the NBA I knew in my observation of these current bunch of unserious people It’s not like there are no serious issues demanding their attention as an organization of Lawyers. After all, how come this lackluster NBA leadership did not sue the government for allowing ministers like Beta Edu to pay government money into their accounts as we all saw with her and several ministers recently, and with proof that this has even been going on before Tinubu came into power? How come they have not sued the government to remove the embattled looting minister of humanitarian affairs? How come the NBA did not sue the Chairman of INEC for changing the electoral goal posts about using bvas for elections after it publicly announced and reassured Nigerians it would . They kept mum, and played deaf and dumb when the nation was almost going up in flames over the disappointing actions of INEC when their voice should have been the loudest. Yet, it’s NYSC certificate issuance that has now got them excited l? What a shame . Another worthy example of a suit they could have filed: How come they are not suing the President for unilaterally moving some government departments back to Lagos when there is a federal law mandating all ministries to be in Abuja? (FYI: I SUPPORT the executive move by President Bola Tinubu because it made sense in context, but it is still a challengeable executive order and the NBA should get the court to test the legality of those executive orders as part of their function to prevent any arm of government from overreaching. While the thinking behind the orders may be good, I personally think the president should have gone to the representatives of the people (NASS) to pass an enabling law allowing him to do it since there is an existing law for all federal government agencies to be in Abuja. If this executive overreach is not challenged now, who knows what the government will do tomorrow, and that action may not be beneficial.) I have long been on record as saying that the primary cause of our present predicament in Nigeria is the LACK OF RESPECT FOR THE RULE OF LAW and Accountability in our leaders and institutions, including one like the NBA. This singular reason is why corruption thrived in our nation. We should be a nation of laws, and the NBA is supposed to be our champion in the meaningful pursuit of that, not in this public pandering brand of going after mundane things like the NYSC certificate given to a man who actually rendered the service. Seriously, did these unthinking NBA executives even ask themselves: How exactly would the nation benefit if the NYSC cancels Kenny Ogungbe’s certificate? It’s a FREE one-year national service, during which participants are given allowances that are less than $30 a month for 12 months to provide free labor to the government and companies participating in it. So, is discouraging people from providing that much-needed service helping our nation or going to hurt it? Seriously. I am personally embarrassed that with all the mess going on in our nation, the NBA cannot find something or someone to sue other than business executives who CHOSE to go back and serve their nation without being paid any significant amount of money for doing so. It’s not every war a serious organization fights, even if the minister was wrong to have issued a certificate in the first place (I make no comment on the legal issues themselves because it’s irrelevant to this piece). If they want to go after the minister then they should go do it but leave innocent executive ls alone Yes, the NBA’s action is not being serious here and I am glad the courts have now opened the door for another serious association of lawyers to emerge. This current NBA executive is just a disappointment all around. The quality of lawyers has consistently dipped over the years on its watch; the judiciary is in decline under its watch; and it is riddled with corruption, including allegations of rigging elections. So maybe those demanding an alternative association do have justification for not wanting to be part of this decrepit association. I know if I were still practicing in Nigeria, I would not want to be associated with it if I had a choice. I call on all current NBA executives to resign and give room for serious-minded executives who are ready to tackle the weighty issues facing the nation and the legal profession. Wallade:Did you participate in NYSC? If you did ,what year? who files your application for service with NYSC? Okay, your School through the office of Dean, Students Affairs upload the names of all graduated Students called "Senate Lists" to the NYSC Portal..Graduates fresh or old who are ready for NYSC will also go to the NYSC Portal armed with their Matric Nos to register for Mobilization..a very important Column in that Mobilization registration online form is "Year of graduation",recall that your Institution had already uploaded your details to the Portal including your Jamb Registration no which has a Date of Birth & year of graduation..Their System calculates your Date of Birth & Year of Graduation before you can be mobilized..Those whose ages are more than 30 after inputting their Year of Graduation will automatically be told to collect their certificate of Excemption in their Schools..I know these because I registered for Mobilization myself..the key word is D.O.G. |

You have no business with my year of exemption. I have worked with these documents in several private organizations, even till date. You can register for mobilization but the question was: who filed your documents with NYSC? You just answered the simple question - "Okay, your School through the office of Dean, Students Affairs upload the names of all graduated Students called "Senate Lists" to the NYSC Portal" Your additional information is noted anyway. Do you even know why the filing has to be done by your higher institution or Alma Mater? |

I have worked with these documents in several private organizations, even till date.[/b] Normal,NYSC certificate of National Service & Certificate of Excemption carry equal weight.Some who graduated before 30 & opted to make themselves available for service after 30 are doing so because they would never be issued a Certificate of excemption if their record shows they graduated before the age of 30 otherwise most of such people would preferred to get the cert. of excemption. You can register for mobilization, but the question was: who filed your documents with NYSC? Wallade:Nothing concerns NYSC with the year your school decides to mobilize you. They're only interested in the age you filled in your JAMB and date of graduation. Check the age you filled for JAMB and the exact date of your graduation (for my Alma mater, graduation date is always written on the certificate) and judge it yourself. Some schools that have backlogs of students to mobilize always have the problem of mobilizing some students after one or two years after graduation. They're still qualified to serve based on their graduation date, not the year they were mobilized. I was mobilized two months after graduation. But I had to differ to travel after the 3 weeks camp. Foreign trained guys who turned in for NYSC years after graduation are eligible. The key determinant is the age at graduation, not the current age. |
