My Landlord Gave Me A Fraudulent Quit Notice by NotoriousBiggyS: 12:17pm On Apr 06
rented this apartment at ikorodu last year June 1st. It a room and parlor self contaim at 200k yearly. Early this year the caretaker who is also the agent in charge of the house on behalf of the landlord brought am increments notice letter to us the tenant. And increments of additional 50k of which Most of the tenant argued with him .
Fast-forward to today, this caretaker brought quit notice to all the tenant in the building.
What baffles and annoyed me in is what is stated in the quit notice, they backdated the date which the quit notice was issued to us to October 30th 2023, which is supposed to be today April 5th 2024. That we are to quit the house by this 30th of this month.

My rent is yet to expire as my rent is to be due on 1st of June 2024. Please lawyers and legal practitioners in the house advice me on which legal action I should take against this unscrupulous landlord. Attached is the copy of the quit notice and also my house rent receipt . Thank you very much and I will be reading your advice comments

I don't think you should accept the quit notice when you observed the wrong date..

On a second thought, I don't see you winning this, go meet the landlord and add the 50k, your peace is paramount except if the house don tire you already

Your mistake is to accept that dubious paper in form of quit notice.

Instead of you to add N50k to your rent and move on with your life, you want to go the long way.

At the end of the day, lawyer is not free and you will still have to leave the building then pay tenant and agreement for a new place. Total will be atleast N150k.
That is extra N50k for 3 years.

And who told u that they wont increase your rent at the new place.


Be wise.

Did you acknowledged the receipt of the quit notice?
Did you and your landlord have a contract/agreement?
But be advised, your landlord owns the property so go negotiate with him like a man. Maybe 20-30k increment after your first year is not bad although the inconveniences is not convenient compared to getting a new apartment

I advise you meet a lawyer for counseling. Tenancy isn't slavery and tenants shouldn't be treated like slaves. You have a right. If you have received the notice, fine. Meet a lawyer now who will go to magistrate court to make it known the fraudulent nature of the written notice, and also obtain a counter notice from the court

Lawyer up. He is trying to circumvent the mandatory 6 months notice to quit for a yearly tenant.

Return the quit notice and ask them to put the proper date on it . Did you acknowledge receiving the letter , if not just get a lawyer to force him to collect it .

Gather all tenants approach mediation center at your local government, the landlord will be summoned for such fraudulent act

Return the mail via a registered mail like GIG or DHL include a letter where in you will state that the agent should address the date of the quit to match the exact date not cunningly back date.

Do you have a signed tenancy agreement? What does it say regarding quit notice?
You will conveniently get 6 months minimum if the fellow decides to go to court but.....

Whie you look for an alternative..whic agaim will cost you much more in moving, in paying ridiculous agreements and commissions and caution fess...best option just negotiate and pay

I think by law you have 2 years before any increment in Lagos state but not sure.
If at that the quit notice is wrong and an act of wickedness.
Just try and negotiate with him or involve mediation in any local government around you for a settlement.

Pls be sincere I hope you're not a violent type because I can't understand why backdating quit notice if there's nothing wrong.

I know you are still a kid but when you are grown and achieved something in life, you will understand that settling is not an act of cowardice sometimes, infact you will get to know that peace of mind is non negotiable

Landlords give tenants quit notice after every 2years so that they can have new tenants, collect more money and caution fees.

They're known for fighting landlord and taking them to court with the hope that the law will grant them long time to stay in the apartment without paying rent .
