Bayero and his cotravellers should just pack their load and cover their faces in shame because everything is working against them both the law and letters. Someone had said it on this forum that FHC doesn't have jurisdiction to entertain the case in the first place because issue of tradition institution is solely within the purview of the SHC. Ganduje, Bayero and Presidency lost this gallantly. |

The government should have appealed the ruling. It is the court of appeal that will say whether the federal high court has jurisdiction over the matter. It is when the issue of jurisdiction is handled that they will now go back to the proper court for another pronouncement. |

Bunnatex:In law,even if court rules in error, it must obey until superior court sets aside the judgement. In this matter, the first court to rule on the matter is federal high Court. Under normal circumstances, Kano state govt and Sanusi are supposed to obey, and vacate that order first, in a superior court, which is appeal court and not state high court . Meanwhile, the opinion of OP is also wrong, because Bayero went to court to get exparte order, for his fundamental human rights that wanted to breach by state govt, meanwhile, the last time I checked, any court can entertain fundamental human rights in Nigeria. |

The only flaw in this lawyer's analysis is that one of the orders has a forged signature on the first page.. this on its own is a criminal offence that the office should have started arresting people by now.. but this is Nigeria |

Fiscus105:You are wrong in your Conclusion! As the Author said, you cant build something on nothing! Chieftaincy Matters are matters[b] exclusively for State Courts[/b], not Federal Court. So, The Federal Court lacks Jurisdiction and whatever Order it gives, was given in error, null and void (though l agree that you have to go to Court to vacate the nonsense order). The other Party just went shopping for a Judge that will do their bidding, they didnt find one in the whole of Kano State or even Nigeria as a whole and had to go and meet a Judge who was on vacation (Leave of Work!) in the United States, he did not RESUME Duties but allegedly just wrote out the Order! Now, The Governor has signed the Order re-stating Sanusi, abolishing the Five Emirates created by Gandollar, at 5pm. That makes it State Law at 5pm. The Chicago Judge gave his own Order by 11pm Nigerian time, on a matter that is already cast in stone, by the Legislators and the State Executive. So, it was an exercise in futility but what we are seeing, is one side trying to use "Federal Security Power" to abuse the Constitution... and this is why it is very imperative we have State Police. If anyone is to blame for this hullaballoo, it is Gandollar, he ruled and abused Tradition, as if he would be Governor forever. looking back at how he vindictively harassed Emire Sanusi, l think the Chickens have come home to roost. Bayero should take his cross and move aside, what goes round will eventually come around. Who knows what will happen in four years time, as long as the Constitution still empowers a Governor to remove a 1st Class King? |

Fiscus105:A Federal High Court does NOT jurisdiction over Chieftancy matters. This resides with the state High Court. Secondly, Liman orders was to maintain status-quo. The status-quo as at the point of issuance of the order was Bayero had been removed by a state law and Sanusi was already appointed as the New Emir. |
