phantom:Let me make it easier for you to understand. Fubara sent the CTC list to the state House of Assembly led by "factional Speaker," Victor Jumbo, on Tuesday. If it happens that the 27 lawmakers triumph in court, it would be deemed that all the actions of this current assembly led by Jumbo is a nullity. This includes the confirmed CTC list, commissioners and other appointments. Like I told you, there is a FHC Order from Justice Omotosho's court recognizing Amaewhule's assembly. This is the law by virtue of Section 272 (3) CFRN 1999 as amended which hold that it is "only" the FHC that can determine whether or not the seat of a State House of Assembly member is vacant. This order has not been vacated. It is still subsisting. The judgement that derecognized Amaewhule's assembly emanated from a State High Court which lacks jurisdiction by virtue of the subject matter. I say all these to say that the matter still tie big wrapper. The matter go reach Supreme Court. |

It is the perogative of the governor to appoint commissioners. The house cannot sack any commissioner. It is a legislative function. Even the caretaker committee, he can appoint without the house. Can they impeach him? Yes. But on a serious basis of misappropriation. Only on that sir! ZIAZI: |

phantom:go and look at those appeals being heard. Some are between the LG Chairmen and the State Government. They are appealing against the settings aside of the LG amendment law that was passed by the HOA. |

ZIAZI:A state can only domesticate what the National.Assembly has passed into law and the NASS can't pass into law any bill which provisions runs contrary to the constitution. There's no provision for tenure elongation in the 1999 Constitution as amended and the NASS has never even contemplated anything like that. So where is the Amaehwule and his 26 co-travellers getting the thing they're domesticating? |

It’s baffling where some of these “data boys” are getting their information about court rulings because the appeal case is far from over. As of today, Martin Amaewhule's lawyer, Ken Njemanze SAN, withdrew the second prayer of one of his applications. He then requested permission from the court to file a new application tomorrow, Friday, June 21, 2024. Sammie Somiari SAN, the counsel for the 1st Respondent (RT. Comr Victor Oko Jumbo), insisted that if Amaewhule's lawyer is allowed to file a new application tomorrow, the court must also give him time to respond. The appeal case still has a long way to go, but these leaders won’t tell their “data boys” the truth. Instead, they deceive them with lies, claiming the court will rule tomorrow. This shows why being in the opposition isn’t an easy game at all. |

oyichi:The same court that ruled that failed to realize that CTC is also illegal and alien to the Nigerian Constitution. If the Hon. Amaehwule and 26 others are reinstated, then those former LGAC chairman will be reinstated pending when the governor truly intends to do the election and if the Court in Abuja goes in favour of the Attorney General/FG for LG autonomy and preventing States Electoral body not conducting elections then INEC will be funded to do such days by the FG. |

bixton:How is that possible? A court has said that the elongation law is hereby squashed. What is difficult to understand. If the lawmakers come back, that law IS NOT COMING BACK WITH THEM. As for the legality of the CTC, you can as well challenge that in court. |

phantom:It would be a waste of court process to do such as it stands now. The FG will not be sending forth LG funds to States having CTC in place. They all will have to conduct proper elections. |
