Caretaker Chairmen is very unconstitutional. That is why everyone incoming governor removes the LGA Chairmen in place even though they were elected because the outgoing governor only did the election of bringing them properly just some few months to the end of his tenure. That has been the practice. Theres hardly any governor who does it right.

You seem not to have followed the issue from the beginning and what led to their social media decamping.

Yes, it's a noise.

We frown at illegalities on one hand, and embrace other illegalities at the other hand.

Typical.

▶ The power to install Caretaker Local Government existed in the state laws during the time of Wike as well, and he used it
▶ The lawmakers who decamped from PDP to APC did attempt to deprive the Fubara Government of that same power by amending the laws but ultimately failed in their plot.

So, if the lawmakers themselves acknowledged by their attempt that such a provision is contained in River State Law, what is it that you are trying to argue here? undecided

I have not been able to see the actual law to ascertain whether it is constitutional or not myself but if you had kindly displayed it here so I too can see what you mean when you claim it is unconstitutional. undecided

∆ It's not about Wike or peculiar to Rivers State..most Governors do this.
And that's my point...they should stop the deliberate illegalities too
Most Governors do it yet it is unconstitutional? How did you go about determining it unconstitutional though. Did you simply read just the national Constitution without equally examining the state level law that bestows the disputed power on the governor in question? I have myself only seen what is contained in the National Constitution but I have not seen the wording of the state level law in the case of , say, River's State to decide if it is in fact unconstitutional or not. Do you by any chance have access to the information that you are able to share? undecided

What does Section 7 of the 1999 Constitution provide for?

I read section 7, and then I also read section 8 as well and came to a rethink of what the meaning of the word guaranteed may mean in section 7. That is why I said it would make sense to probably also see what the law makers in states like Rivers have in their books. lipsrsealed

Is the attached file by any chance the River"s State Constitution? undecided

Any action that is inconsistent with the provisions of the 1999 Constitution of the Federal Republic of Nigeria, either by State or LG is unconstitutional.

I agree...the question is, why should a governor or why do Governors deliberately fail to conduct electionshuh

Whyhuh
1. They dip their hands in the LG allocated funds.
2. They appoint their core loyalists to run shows in the LGs.
3. They maintain absolute grassroot supports when they control the LGs

Note: When you hear Wike shout about his structures, it's actually the grassroot supports, being manned by the LG Chairmen, that's why Fubara refused to conduct LG elections so he can rip out Wike's men and stamp his authority on the grassroots, through the Local govt councils, it's politics, and every politician would do the same.

Yes, Samuel Nwanosike the most vocal of them all, did 1 year as caretaker chairman and has done 2 tenures of 3yrs each, amounting to 7yrs as Ikwerre LG Chairman, yet he still needs extension.

Obarilomate Ollor of Eleme LG, did 1 year as caretaker Chairman and 3 yrs as elected chairman, he was billed to go for 2nd tenure if not for this their problems,
and some other ones I can't remember their names in the riverine areas, most of the outgone chairmen did 1yr as caretaker under Wike, b4 being elected.

The issue is not about the former chairmen not wanting to go home, it's solely about who controls the soul of the grassroot supports, which is found only in the Local govt systems, as foot soldiers.

It's purely politics, and the odds favour Sim Fubara as the Executive Governor of Rivers State.

So you are saying those Muslims who kill those who they claim to blaspheme Mohammed are in the right because they acted out of the Sharia Constitution in their States and because it's a State law and constitution, it supercedes the law and constitution of the FRN?
Is that what you're saying?

For me, I never liked his desperation and disloyalty towards his former political parties.

Then conduct elections before such tenure expires!!!

FGN mobilises INEC for elections, and they are somewhat independent, well funded to act as at when due.

State Government should do same for state electoral commissions...fund them adequately for them to conduct elections as at when due.

You can't say it's constitutional on one hand and you refused to give the SIEC the needed fund to conduct elections ..while at the same time appointing caretaker chairmen. These are also unconstitutional.
Wether dey conduct elect ir not dies not stop tenure expiration..After ur tenure expire tge givt will manage dey vacancies either by careraker etc
Not u chaurman of LG guving govt condition on how it willbe abd decuding ur own fate .

Even sa gov wike cannot extend tenyre by 30mins talkless of lg chairman

I have just told you, it doesn't matter what it says...if it's not consistent with 1999 constitution, it's unconstitutional.
As simple as that.

The Governor setting up a caretaker committee to oversee the affairs of local government, irrespective of whatever led to this action, is unconstitutional.

Not only in Rivers State...any State in Nigeria , where you have caretaker chairmen is unconstitutional

I know it is politics for sure. The problem is the people of River's State may have even had their constitutional right violated in all of this by their own local government councilmen as well as their governors. This revelation ought to have the people wanting answers not just from the LG officers but their lawmakers, past and present. undecided

There is only one constitution in Nigeria. Perhaps you mean law. It doesn't matter because any law inconsistent with the constitution is null and void, to the extent of its inconsistency. The Nigerian constitution does not recognize caretaker chairmen.

There is a National Constitution that supersedes all other, yes. But the National Constitution, section 8 in particular, which kind of undermines the guaranteed claim used in section 7. So, definitely, the State Constitution needs to be examined in this case. undecided

There is no state constitution. Get that simple fact into your head. The constitution cannot give powers that will undermine it. Any law contravening it is void. Simple.
