listening to the entirety of this video I can tell you that the man talking demonstrates a lack of procedural knowledge of his own immigration laws. his statements are based on administrative directives, and I suspect are being done publicly to appease the xenophobic public that their GNU is working. Now follow the below points when it comes to case law that deals with immigration in South Africa.

1. It was likely that Chidinma's original status would be likely revoked on the grounds of her mother's fraudulent activity. No surprise there.

2. The individual in this video also confirms that the father of this girl was present at her birth and participated in the registration of her birth confirming that she was born in South Africa, was registered at birth and has been noted as the child of this particular individual regardless of his status at that point in time.

3. It would then follow that upon the revocation of Chidinma's status She would fall into several categories which could qualify her for Citizenship or at the least permanent residence. The fact that she will be deemed stateless, She would then fall under the status of her father depending if his legal status was not acquired under the same fraudulent circumstance as the mother and if at the time of her birth Retro active laws would apply prior to 2013 when children of permanent residents became automatic citizens or automatic permanent residents and could apply for South African citizenship upon reaching the age of majora.

4. The part where Hhe mentioned about not being "outside" of the country for more than 90 days at a time is the dumbest thing I have ever heard in terms of all the cases I have ever seen. It is not applicable in this particular circumstance and is probably throwing shade on the fact that she wants to head out to compete in the Miss Nigeria pageant.

Post 2013 that was not the case my friend. There are several cases in their high courts that are actually challenging the retroactivity of the law for children born prior to this time period.

Trust me on that one.

If an administrative directive is against the constitution it is deemed unconstitutional and cannot apply.
