The only reason the Appeal Court recognize Rt Hon Amaewhule team his because Gov Fubara choose the part of peace and refuse to follow up the case as expected ...and the Court cannot adjudicate on evidence not presented. The way I see it, a third party might take the case to Court on the issue of breach of Constitutional provisions. Me I don't have problem with brothers quarrelling but after quarrelling they should make peace .. I don't understand why Rt Hon Amaewhule group like tackling the Governor .. don't he knows he can be the next Governor if Gov Fubara performed well .. but they have scattered everything now.

If the latter is true, the court should not only sack them but they should be sent to jail for a very long time.

For the gullible ones criticizing the decision of the Rivers State House of Assembly to declare vacant the seats of four of its members who were earlier suspend from the house, It is my prayer that you understand the clarification below.

Recall that after the Hallowed Chambers of the Rivers State House of Assembly was set ablaze on the night breaking into 30th October 2023, purportedly to stop the Assembly from holding plenary session , the Assembly still sat in the early hours of the same October 30, 2023 within the Assembly Complex and suspended four of its members suspected to have masterminded and carried out the burning of hallowed chambers , and also issued an impeachment notice on Gov Sim Fubara.

Recalled also that after the peace parley that was held at the instance of President Bola Tinubu , the House immediately withdrew its impeachment notice on the Governor and also recalled the four suspended Members, yet they obstinately refused to attend sittings of the House after their suspension was lifted , without any excuse.

Against the peace accord signed at the instance of President Tinubu to restore peace and stability, Gov Fubara made a U-Turn to commission the suspended lawmakers to form a parallel assembly and provided an accommodation for them inside Government House, which both the Federal High Court and the Appeal Court have in different terms declared that they Never Existed .

Consequently and in line with constitutional provisions , the Rivers State House of Assembly at its 56th Legislative Sitting of the Second Session held on Tuesday, October 15, 2024 declared vacant the seats of the four assembly members, namely Hon. Edison Ogerenye Ehie, Hon. Victor Oko Jombo, Hon. Adolphus Timothy Oruibienimigha and Hon. Sokari Goodboy Sokari, representing Ahoada East II, Bonny, Opobo/Nkoro and Ahoada West Constituency respectively.

The decision of the State Assembly followed the continued refusal or failure of the four to attend and participate in Legislative meetings of the House, without cogent permission for a period amounting in aggregate, to more than one-third of the total number of days the House met in the First Session of the Tenth Assembly and for also being absent in the past fifty -six legislative sittings of the Second Session.

The motion for their expulsion from the Assembly was moved by the House Leader, Hon. Major Jack and co-sponsored by 25 other Members.

The House voted in the affirmative that the seats of the 4 Members be declared vacant, and the Independent National Electoral Commission be notified to conduct by-elections to fill the vacancies.

The House also agreed to give Gov Fubara a second chance to uphold the Rule of Law by representing the Rivers State 2024 budget .

Do not be surprised when the Supreme court gives he judgmentots expected that it's obeyed as soon as possible otherwise the enforcers of the law will step in and whatever happens afterwards let no person say more.

The house has made a move already. Well I am not a lawyer and don't know the implications.
They were in rush to make a statement but that was a wrong move and a joke taken too far. They should have waited till next week Friday to make a move when there will be no opportunity to appeal the case any more. They are just jesters in the hand of Wike. The same Wike that told the world that he doesn't know when they defected to APC, as they didn't tell him when they do so. Liar!

I guess let's all wait till the Supreme Court gives it judgment then we will know what will happen afterwards. The enforcers of that judgment will step in and do their own.

Which of the Supreme Court are you referring to because I don't know any case against them that is in the Supreme Court because there's was never an appeal that was against them except you're referring to the High Court in Rivers State and they don't have any case in Appeal Court in Rivers State.
All their cases as it concerns them and Rivers State Government and Governor is in the Federal High Court, and Appeal Court just summurised theirs

Your story wasn't detailed at all. You never added that after the peace panel with Mr. President, asking all parties to go and withdrew all court cases, that SIM went to withdraw his but the 26 recalcitrant lawmakers did not withdrew theirs but went through the back door to shop for judgement after he has withdrew what should have aided his case against them.
Now, one would be tempted to ask, who was truthful to the peace accord. That was the genesis of what angered Fubara, as he was out for peace but Wike's camp was looking for ways of playing God.

Na so one NLander come drop definition of affidavit but as the definition is complete the NLanders acceptance of it is incomplete and impartial.

An affidavit can't stand on its own and can't be used that way in any Court even if it's a kangaroo court.

a third party ...as you say....cannot start & meet the time left to bury this issue again.....I am happy you recognise that Appeal court does not have pleadings of evidences to rely on from Fubara.....law is not emotions..........once the supreme court give its pronouncement on this matter that Recognises Amewhule, it is final....The Defection issue cannot overturn the pronouncement of the supreme court again because the pro-wike Lawmakers has Joined the 26 lawmakers in the suit decided by the Appeal court...fubara will have no option now, than to work with pro-Wike assembly...and you knows what that means.....Ugochinyere cannot save fubara...he can only keep making mockery of unschooled fubara followers by feeding their ears with myths & tales from moonlight, what they want to hear against the reality

Let me ask you a question. Do anyone go to court to swear affidavit for the sake of just doing it for fun? I thought you go to court to swear on affidavit for a purpose to serve as cover in the event the original wasn't available.
An affidavict can't stand on its own.
Let me use the issue of those who has misplaced their birth certificates or original school certificates and opt for something like Statement of Result to use in place.

When you do the Age Declaration and stating it's contents in place of the Birth Certificate, then it's proper that you get an affidavit affirming it's intention and purpose.

Likewise if you misplace your original school certificate and you want to use Statement of Result in place, it's proper you get an affidavit affirming your intention and purpose.

I know over the years we have been doing some of these things abnormally.

But you see this particular issue that involves politics, will guide us when the judge assigned gives it verdict if at all there's any case to be spoken of any the Supreme Court.

that case has been abridged and since this Particular case Last Thursday specifically Mentioned Amawhule as speaker of RSHOA and the 26 others as Members of the RSHOA and further the Apeal court Restrict Fubara from stoping Amaewhule and 26 others from Carying out their Legislative duties.....as it stands, this is the Highest Order by the Appeal court about Rivers.....you see when you now turn around to Listen to Ugochinyere, your ears will catch virus and you wont hear normal again...read the Judgement here bro. its your problem when you chose what to believe no one has the time to be going round the table when you cant comprehend judgement written in Black and white...

The appellate court firmly upheld the January 22 judgment of the Federal High Court, delivered by Justice James Omotosho, which nullified the 2024 N800 million Rivers State budget of renewed hope on the grounds that it was not presented before members of the State Assembly as required by law. The Appeal court admonished Governor Fubara for not adhering to the rule of law in his actions.

The Appeal court held that Governor Fubara’s decision to present the 2024 Rivers State Appropriation Bill to only four out of 31 members of the Assembly constituted a gross violation of the 1999 Constitution, as amended.

With all these problems here and there, even if he eventually finished his term as a Gov., he won't have much achievement to his name like his predecessor.

Any Gov. who doesn't have the support of the State Assembly don't always end well administrative wise.

Even if he wants to keep fighting Wike, he should look for a way to settle with the Members of the Assembly.

As the matter be so, Amaewhule led Assembly is the recognized House in Rivers State according to the law of the land.

a third party ...as you say....cannot start & meet the time left to bury this issue again.....I am happy you recognise that Appeal court does not have pleadings of evidences to rely on from Fubara.....law is not emotions..........once the supreme court give its pronouncement on this matter that Recognises Amewhule, it is final....The Defection issue cannot overturn the pronouncement of the supreme court again because the pro-wike Lawmakers has Joined the 26 lawmakers in the suit decided by the Appeal court...fubara will have no option now, than to work with pro-Wike assembly...and you knows what that means.....Ugochinyere cannot save fubara...he can only keep making mockery of unschooled fubara followers by feeding their ears with myths & tales from moonlight, what they want to hear against the reality
It is not good for politics not to keep a gentleman agreement, and this goes both ways.

How sure are you that it will be granted.

Wike is Abuja landlord and same Appeal court are to grant the stay of Execution which I doubt.

The court will not grant the stay of Execution and the Governor will lose the Apoeal.

Politics is not your mate
The moment you file a case at the supreme court invariably one of the relief will be for stay of execution.

Wike in 2015, lost at the tribunal, Appeal court and only won at the Supreme court. Why didn't he vacate his seat at the tribunal or appeal court level because of the ruling in favour of Dakuku Peterside of the APC?
