donforeign:You and your destiny just picked up a self-inflicted curse. Who curses me is cursed! You need help! Proverbs 26:2 “As the bird by wandering, as the swallow by flying, so the curse causeless shall not come.” The curse you released cannot find a destination in me so it returns to you! By this experience you enter into from today you will learn in a hard way to not curse! |

I am not a legal luminary so I might be wrong. I thought the best way supposed to be for Afe Babalola to sue him to court for defamation, and the two will meet in court for that. Why this arrest as if he is just a common criminal. |

casualobserver:...well from what Dele has published online in Nivember about the matter..I think Dele can prove many things..that's why Afe had to move him to Ekiti....where he could dictate to the governor and courts....just as Dele accused him of doing in lagos at the times the crimes he committed happened. If he really is worth his salt..He Afe should have dragged Dele to court in Lagos.... Justice kekere ekun is on US banned in the US now over shady dealings and wrong judgements ... I will see if the ekiti judges they want to use will be willing to damage their reputation to that level too...cos it may get there. |

gidgiddy:No nuclear will fall on Nigerian than the one that is already fallen on Ipob. Kanu is in the zoological garden in Nigeria while ekpa is in the zoological garden in Finland. Which nuclear is more than that already fallen on Ipob? We are on Nairaland to keep telling oncoming Igbo generation that ipob is an infectious disease that must not be allowed to spread to them. That's why they are left to leave in isolation in the bushes with wild animals cannibalizing their victims. Ipob is a disaster that must not be allowed to spoil oncoming Igbo generation |

I don't like that law, I think it should be just be lawsuits first and jail later if they fail to pay up, but since it's the law in Nigeria that the rich have been using against the poor. Davido used it to lock a man up recently and the idiots supporting the loud mouth Farotimi here liked it then. Afe Babalola should also look into a civil lawsuit and take him to the cleaners. I hate that Farotimi, his face disgusts me, you can tell that either his wife or mother one is ibo, there's no traces of Omoluabi in him. |

mrvitalis:Our Judges have become Tools of Oppression and Corruption...exactly as Dele Farotimi said. Remanding someone in Prison, within 24hrs of being abducted from his Office in Lagos, to Ekiti State? Does that not indicate that all these was "pre-arranged"? Was it not in this Nigeria that Underage Hunger Protesters were kept in Prison for three Months, before being charged to Court? That Name, Babalola, is very notorious within Nigeria of the Babangida era. And to think htis Old man says he has "Schools" where he is training Students? Are his Students not seeing what he is doing now? What are they supposed to learn from it? The Nigerian Bar Association, the IGP and the Nigerian Judicial Council, NGOs and all Nigerians of goodwill, must resist this IMPUNITY from Ekiti State. |

casualobserver:Is abducting someone like a "Mafia Gun-hand", from Lagos, to Ekiti State, at Gun Point, what you call "Pressing Charges"? Some of you appear to be product of his University in Ekiti, the way you reason. ![]() If Babalola was "erudite", he should have just have instituted a Civil Suit in a Court, instead of all these intimidation. Erudite SAN's, even newly qualified Lawyers know that Defamation or Libel falls under Tort, it is not a Criminal offense and the Police have No-hand in it. Body of Benchers need to disrobe this man, he has brought opprobrium to their Name. |

smallsmall:First of all I saw the video he was arrested not manhandled Secondly if you were properly educated, the 1st thing expected of an educated person is to look for and read the charges. I posted them in in this thread because I know there are many educated ignorant people like you. If you had actually read the charges. He is charged under multiple sections of the criminal code. The next thing an educated person would be to google the criminal code and see what these sections related to. I also read the sections of the criminal code and indeed defamation can be civil and criminal. A simple google search could have told you that. Afe Babalola became a SAN when they didn’t dish out SANs Willy nilly just like I was educated in an era when our transcripts (not degree certificates) of gained us admission to Ivy League universities abroad without need for any further cverification, certificates or English proficiency exams. Where my education started is where yours ended. The hallmark of an educated person is in how he thinks and processes information e.g getting his facts before he talks. You learn this if you are properly educated or you would never get good grades if that was not embedded in you. Regurgitating for exams to get a certificate does not mean the school has passed through you, all it means it you passed through a school and remembered facts on the day of the test. Education is not passing exams, education is a critical thinking process which you and many of your ilk on Nairaland display a lack everyday! Education is not a sham after all Next time you see any of my posts, know you are dealing with someone who has his facts before he posts and come correct or you will be taken to the cleaners. For those of you who like to post falsehoods, Read section 375 well! defamation is a CRIMINAL offense whether you do so knowingly or not. The only difference is you knowlingly defame the punishment is 2 years in prison while if it is unknowingly it is 1 yr. Posting on social media can be regarded as publishing so be guided Feel free to verify: https://lawsofnigeria.placng.org/laws/C38.pdf Finally, when you publish a book that defames and that book is read in Ekiti, you can be sued in Ekiti. If Afe Babalola lives in Ekiti, and reads (or others read) the book in Ekiti, he can report the criminal activity to the Ekiti police! He is not obliged to come and report you to the Lagos police because you live in Lagos. For the same reason the US charges Nigerian looters in Us courts for money laundering when the actual looting occurred in Nigeria. Defamation occurs in the jurisdiction where the book is read just like money laundering occurs where the money is received. That’s why Afe Babalola is a respected SAN and Dele is an unwashed nobody trying to cash in and make a name for himself in his old age on a movement birthed by ignorant imbeciles and chartalans!

While his still on detentions. Attention has been drawn to this book. And many has read intact in the fastest form of the book. If the judiciary is not corrupt a San will not be arresting a man without a civil sue. If a case is not considered a criminal offense by the SAN and his criminal institutions why will you kidnap a person in the name of arrest. Let it be on record that Dele F. Is not the only person who has on written paper labeled the Afe Babalola as a man who has criminally damaged our legal system. I am also one person who has said. It. So I am expecting my own arrest too. What is bad is bad. Which evidence is more to be looking for when there is no law suit, other than arrest him Yes there are suits for defamation of character if you feel your image is damaged the legal system will look at it and then you get a settle but for Dele to approach it. It means. It is way worst than the normal Nigerian know. |

casualobserver:I just discovered that many so called educated people on this platform are educated illiterates. See the way they are disseminating posters just because the heading says Criminal Code Act. Truly many went to school but never allowed school to go through them. Nigeria as a country have two Acts that governs its administration when it comes to dealing with cases. We have the Criminal Code Act (CCA) and Penal Code Act (PCA) while the CCA governs the southern states and PCA governs the northern states. An offence committed in the southern state cannot be tried using PCA, the same way an offence committed in the northern state cannot be tried using CCA. Dele Farotimi is being sued with CCA because Ekiti state is one of the southern state. If he is sued with PCA, the case will fail yakata. I hope you have grasped the difference? Meanwhile, a case of defamation is a misdemeanor, meaning minor case and a civil case and not a criminal case as you people are disseminating around. The only person that can be sue for criminal act is Afe Babalola while Dele Farotimi can only be sue for defamation of character, for alleging Baba Afe Babalola 'wrongly'. Besides, it is now left for Mr. Dele Farotimi to substantiate his claims in court by bringing evidence to ventilate his claims. For now, the case can swing to any direction but I am of the opinion that Dele Farotimi cannot just published such heavy claims without a pint of Intel, one should not even surprised if Dele Farotimi was once contacted for such bribing bribing of the justices of the supreme court. Let us keep in tab and see how thing unfolds but I am sure many hiding messes would be unearthed in this case. Who would have know that Wole Olanipekun could be a challenge to bribe an EFCC prosecutor, Offem Uket until he was axed by EFCC for receiving bribe from him to give to judges.

zoedew:If you have taken time to read the article, you would have known that it will take miracle for a defamation to amount to criminality, as it must have caused public unrest, as Afe Babalola himself opined that the defendant can claim he wrote/published such damaging information for public interest. You guys should try and be reading before disseminating information or link. In this note, I am cog sure you didn't read it. |

IfnobeGod20:Wrong! I read and understood every bit of the article. It actually stokes up learned discourse on the matter not insults and hasty conclusion you ended up with in your response. Well, the matter is now in court and its determination will help our criminal law justice system going forward. That is my focus. By the way, legal minds know that it will take an arm and a leg to prove the criminal allegations Dele makes in his book! |
| Re: Dele Farotimi Remanded In Prison Custody For Allegedly Defaming Afe Babalola by IfnobeGod20(m): 8:38pm On Dec 05, 2024 |
zoedew:If you read it and you still came up with such submission, it connotes you're a slow learner. From the submission made in that link by Afe Babalola, for a defamation to criminal in nature it must have caused distortion of public peace and he also said a defendant can hide on the premise that he wrote what he wrote for the benefit of public interest. You can now go back and counter this argument I advanced and I will quote verbatim the words for you from the link. Besides, if during tendering of witnesses, Dele Farotimi now brought in those Baba Afe Babalola had sent to bribe the justices as witnesses, what do you think would happen? Remember it was the same way Wole Olanipekun bribed EFCC prosecutor, Offem Uket to corrupt judge. As the news is everywhere.

zoedew:Surely in this country we are learning so many things that defer logic and constitutional principles for a long time and that is why our judiciary is rated very low amongst comity of nations. That's the reason Nigerian judiciary is ranked very low in obedience to the rule of law https://www.google.com/url?sa=t&source=web&rct=j&opi=89978449&url=https://worldjusticeproject.org/sites/default/files/documents/Nigeria.pdf&ved=2ahUKEwinh43mk5OKAxVeQUEAHaRNIgYQFnoECBYQAQ&usg=AOvVaw2PlUAAwp1--xRK82E_JKRX Even in perception poll results Nigerian judiciary is rated very low too. https://www.google.com/url?sa=t&source=web&rct=j&opi=89978449&url=https://www.noi-polls.com/post/nigerian-judicial-system-perception-poll-result&ved=2ahUKEwinh43mk5OKAxVeQUEAHaRNIgYQFnoECDoQAQ&usg=AOvVaw3_dU2jQ49y3sLWtN5LUmuF So it is never a new thing that we have been learning and relearning how our judiciary have been going against the written laws. |
