Stop distributing your ignorance. He said so because even non-lawyers - let alone a whole SAN - know that defamation is a civil violation. But just to prove/confirm Farotimi's overall assessment that Nigeria's justice system is run by criminals, they had to smuggle "criminal" behind defamation to give the police the pretext to abduct him. Nigeria keeps showing how backward it is and continues to be after so many years of its flag independence. There's nowhere in civilized societies that defamation is a criminal offense. The complainant, Afe Babalola, an attorney, ought to know better. If you feel you are defamed by spoken word (slander) or publication (libel), your only recourse is to sue the slanderer. But to use the terrorist arm of the government to intimidate citizens is despicable, and that's what Nigeria is known for. It's their only stock in trade, and Nigerians keep wondering why they rank so low in the comity of nations. The world sees how you act like animal and still wants to be respected. It does NOT happen that way...you're treated the way people see you. |

Thundafireseun:Under Nigerian law, libel is a tort, meaning the victim can sue in civil court for damages. This typically involves written or published statements that harm a person's reputation. Dele Farotimi in his book claimed to have sued Afe Babalola for libel but the case was buried or prevented from.procceeding somehow. Now that Afe Babalola is claiming libel from Dele's publication, the ideal thing is for him to approach the Courts. But it appears Afe Babalola has something to fear that discourages him from suing Dele Farotimi and he is choosing to use the Nigeria Police to do a hatchet job. You can see the case of Falana and VeryDarkMan that Falana chose to sue VDM in a Court of Law rather than using the Police to attack VDM. Falana clearly stated that he believed libel should not be criminalized under any guise. Afe Babalola should have done exactly what Falana did, which is the honourable thing to do if he feels aggrieved by Dele Farotimi's publication. |

The writer is based in Lagos, his office is based in Lagos, the lawyer that supposedly read the book did at the airport in Lagos. I did not have the patience of reading the entire write up though. The offence (if seen as such) is bailable. The suspect ought to have been granted bail (even administrative from the police) or could it be the same power play for which Farotimi is now being hounded? |

hardbody:Jurisdiction can be anywhere based on the theory of effect. The book was written in English Language and distributed all over Nigeria. Afe Babalola lives in Ekiti. His business and family are in Ekiti. The effect of the defamation affected him in Ekiti, his business in Ekiti and even his family in Ekiti. Ekiti state judiciary has absolute jurisdiction to hear the case. |

In the wisdom of the Ogunwumiju JSC, he stated on page 116 particularly at paragraph A as follows: My Lords, I need to re-emphasize that defamation is both a tort and a crime*. Are you aware that his legal team, anticipating the possibility of his remand, could have preemptively filed a bail application during the proceedings? Per information available, they didnt. I also strongly believe that he was not caught off guard by these developments. In fact, I would not be surprised if the actions taken against him are unfolding in alignment with a strategy or narrative he had anticipated or orchestrated.
