Hence let him go and proof his case in court, let him provide an evidence to proof his allegations. In a sane country, that would be a welcomed development but in Nigeria where herd mentality and zombie attitude prevail, they labelled it an assault on free speech. People should realize that your freedom (all kinds of freedom whether of speech or association) stops immediately you infringe on other people's freedom. You can not blatantly lie against a fellow citizen and called that freedom of speech/expression. |

Judolisco:I have not read the book, in fact I no go school so I no know book. But going by your statement alone, there seems to be a miscarriage of justice already. Baba s within his legal rights to sue Mr. Farotimi - in fact, Mr. Farotimi should be sued for all he is worth. However, the moment a defendant is being held in jail over a bailable offense (like you said), then it seems as if the defendant's story about the Baba is being played out already. |

HitRun:It becomes criminal when the police/prosecution adjudged it can lead to public disorder. The Supreme court accusations can, as considered in this case by the police, can lead to public disorder. |

DrMrsAdeniran:Obidients you mean. Nigerians know he made allegations and he should prove them in court. Watch Jiti Ogunyes brilliant summation on channels tonight. He basically said the arrest and charges are in order and it is up to Dele to prove his allegations. 2 very important points he made: it is up to the person defamed to chose whether he goes the route or civil or criminal defamation and that If you chose civil and during the course of the case, you die, that is the end of the case. However with criminal the case continues even if you die so for a 95yr old man it makes sense to go the criminal route. He gave the example of a civil defamation case by Awolowo against concord newspapers that died as soon as Awolowo died. Which means if you institute a civil case you won’t be able to clear you name if you die in the course of the case. For a 95yr old lawyer who clearly understands the law and the process and determined to preserve his legacy, criminal defamation was the logical recourse. Secondly he said he was shocked that a lawyer would make these sort of weighty allegations and that having done so he must prove as lawyers are trained to be circumspect. Finally he said having made allegations against the Supreme Court, the attorney general of both Lagos and the federation are within their remit to bring seperate charges for defaming the courts. |

If he had appeared in court when he was summoned he would have been granted bail but instead was granting interviews in Lagos boasting that he would not attend and he waited for the court to issue a bench warrant. Please see what a bench warrant is. No bail for bench warrant.
