Criminal: deliberately intended to defame in other to hurt you.

Civil: recklessly defame you, in which, he is ignorant that, the recklessly speech can hurt you.

Criminal defamation will land one in prison for years while civil defamation comes with charges/damages only.

It becomes criminal when the police/prosecution adjudged it can lead to public disorder. The Supreme court accusations can, as considered in this case by the police, can lead to public disorder.
