Having Court Case On Inherited Land. by Asquare84(op): 6:42pm On Jan 16, 2025
I need the opinion of property lawyers here. My late father bought a land in 1992, with hand written sales agreement. however our father died last four years ago and the person that sold the land to us is also late.

Fast forward to last two years someone came and put a pillars around the land and put a big notice board with an inscription 'Land for Sale'

We finally took the case to court, and we noticed that the same land grabber is clamming that they bought the land from the same person that sold the land to our father, although we have witness which are the children of the man that sold the land to our late father and other people that bought the land together with my father.

Now, in court the defence team is claiming that we abandoned the land for more than 15 years, that is why they are laying claim to the land.

Is there any law in Nigerian that said you can claim a land that is inhabited in the bush and it becomes yours ?

Note: the said land is in the bush and no developments is there presently and the land grabber only put pillars on the land.

Secondly, should in case we win the case, can I claim damages for trespassing in to our land and wasting our time and resources on court case.

The land is in our rural town.

Nairaland please I need enlightenment.

Someone is currently building on my mother's inherited land at the moment. The Baale lured one of her nephews at village into selling the land behind her back; just to make sure a family member has a hand in the deal. They gave him a token out of #3m. And dem don sell their Mama own tey tey o. But the werey nephew don japa.

As e be now, e be like say otilọ...coz the buyer is not ready to repurchase from the rightful owner and none of us is ready to go through land wahala.

I don't take post like this seriously.

You are worried about a property but went to search for an image of a blind judge or impartial judiciary, downloaded the image as if that is your problem.

I have said it severally, Seun is gradually loosing it with these paid posters coming up with sensational post to gather engagement on this forum.

Stop it Seun.

Re: Having Court Case On Inherited Land. by concho(m):
Ah, poor lad,

Thy tale is one that brings both sorrow and a wry smile to my face, for it awakens memories of my own tale as a humble supervisor in the service of Mr. Ekong.

Being the son of a humble merchant, and unlike those of you whose fathers left treasures for , I had no inheritance awaiting me. Thus, necessity compelled me to seek sustenance under Mr. Ekong, a man known far and wide for his unprincipled dealings in lands not his own (Land grabbing)

It was my lot to oversee the clearing of a plot he had newly acquired in our neighborhood. From the haste with which he sought to develop the land and the price paid for it, it was plain to me that his bargain was as unsound as the ground beneath. Yet, I dared not refuse, for my livelihood depended upon this work—and more so, my foolish desire to appease then-girlfriend Nkechi, whose chief occupation seemed to be the art of draining my purse.

On the second day of this ill-fated task, a curious sight befell me. A bus came speeding toward the site, its intent as uncertain as the fate of a gambler’s coin. At first, I feared its brakes had failed. As I turned to warn the laborers, I found, to my astonishment, that they had vanished like morning dew under the sun’s gaze.

And then, lo, the bus came to a halt, disgorging nine towering men clad in military garb, their bearing as fierce as warriors preparing for battle. Aye, it seemed as though the heavens themselves had declared war upon our humble site.

But this tale is long, and time is short. I shall leave the rest for another day, if it please thee to hear it……

Possession is a major factor in land disputes. That's what they are trying to do by putting pillars and a sign since there's no evidence of possession by anyone.

The person that sold to your dad should have some form of evidence that the land was his. Even if its by community allocation.

Yes there is a law that states that.

But the person can lay claim to the land if he or she stays in that land for 10 to 12 years without him being disturbed on the land.

Before property lawyers comes in to give their professional advise. I don't think there's any law that states that a purchased landed property must be occupied by the buyer within a certain years. It's possible for the sellers of land to put a clause to the agreement when buying that the buyer must quickly commence construction at so so time or atimes, they would tell the seller to fence the land or erect short fence all over the land sold to him immediately. That's just within the agreement and not binding in the law court.

Incase you win the case which ofcourse I think you will win. Quickly commence farming by engaging some locals to be working as farmers on the land. Engage that Land cos eyes is already set on it.....Don't leave it idle.....

Buying and selling of land itself is a crime against the earth and the creator.

The pathetic creatures "humans" are the only creation guilty of this crime. The creator have the earth to all earthly creation for free.

Humans are curse and pollution to the planet and will be wipe off by nature soon.
Re: Having Court Case On Inherited Land. by Geonigga(m): 8:06pm On Jan 16, 2025
It is only applicable when the defendant has a valid title to the land ab initio and not a trespasser per se infact a case of a trespasser invading into someone else land is an exception to that rule. I have an ongoing case in that same issue and we have filed and adopted our addresses the court has adjourned for judgment. A case of trespass is an exception to the applicability of status of limitation.
