As an estate surveyor by education, there is no land without an owner,is an age long principle. The only body that has the right to reclaim the land is govt and because there is simply no deterrent in the system,a thief would boldly go to court and fight the innocent. What a country! |

A possessory right no matter how long it is can not translate to ownership. That is to say that a mere possession can not make you the owner of the land, you must validly acquire the land first and that is the law NothingDoMe: |

Is the land properly documented? Was there an agreement between seller and buyer? If yes, you shouldn't worry too much. If no, you shouldn't worry too much - provided you can prove title to the land. |

Geonigga:Definitely. I repeat, it is a major factor in land disputes. I also advised him to look for documentation that confers title to the previous ower. Without a title, the possesor stands a greater chance of winning. |

Asquare84:According to Nigerian law, particularly the Land Use Act of 1978, land can be considered abandoned and potentially reclaimed by the state government after a period of 12 years of non-use, as this timeframe constitutes "adverse possession" under Nigerian law, allowing someone to claim ownership of abandoned land through continuous occupation. Key points to remember: Land ownership in Nigeria: The Land Use Act vests all land ownership with the state government, meaning individuals only hold "right of occupancy" for a specified period, typically not exceeding 99 years. Adverse possession: If someone occupies abandoned land openly, exclusively, and continuously for 12 years, they may be able to claim ownership through adverse possession. Legal complexities: While 12 years is the standard for adverse possession, navigating land reclamation through this process can be complex due to potential disputes and legal challenges. |

Abee79:What they do is that they are trying to bribe the children of the person that sold the land to us to come and testify in court that it was their father that sold the land to them too. |
| Re: Having Court Case On Inherited Land. by NothingDoMe: 8:24pm On Jan 16, 2025 |
Asquare84:Since it's a communal land then no wahala. You can get backing from the community that the land was allocated to the previous owner who then sold to your late dad. |

Carndidlaydid:Believe me, it is only a certified idiot that will limit or assume that the issue of land dispute is restricted to a region in Nigeria. On a communal level, we have had Uguleri and Amuleri, Ife and Modakeke amongst others. On an individual level, we have had brothers killing themselves over land inheritance and not to talk of women being denied in some cases . I will no longer doubt those who often times refer to you as an idiot. Thanks for the confirmation. |
