If you ever go to court, and court sets you free, but government asks the same court to suspend their decision, keep you jail for months or years while the appeal at the Supreme court, you will understand where Kanu is coming from

If Kanu is convicted today in court and sent to jail, will Kanu be able to ask court to suspend that decision while he appeals to the Supreme court? Or will he beging his sentence and appeal from jail?

That is known as judicial rascality

Kanu's legal team sought a separate high court ruling challenging his rendition back to Nigeria as being illegal without recourse to international procedures and laws.

The FG appealled up to the supreme court which decided that Kanu should continue his trial .


No court had acquitted and discharged Kanu.

This is not about Igbos alone, it is the evidence of the rot in the Nigerian judicial system. It has happened several times especially when the government has a special interest in the case

What Kanu is asking is where has it happened that a person is set free by a court, you ask that same court to temporarily keep the person it already freed, in jail, while you appeal at a higher court? How can any person ask a court to suspend its own judgement so they can appeal elsewhere?

I have never heard of such judicial rascality in my life, and I'm sure no Law student has either

Is the Appeal court above the Supreme court?

You can not be selective in which judgement to abide to.

The supreme court has ruled that Kanu's case mist continue and that is final.

There's already a Supreme Court ruling that has put aside the original High Court ruling that ordered Kanu to be released from DSS custody and returned to Kenya over the rendition carried out by the Nigerian government.

The High Court ruling that ordered Kanu's rendition as illegal is separate from that in which he is standing trial for Treason and terrorism charges.

At no point has any court in Nigeria acquitted and discharged Kanu for his existing treasonable felon and terrorism case.

The Supreme Court overturned the separate high court ruling declaring Kanu's rendition illegal and declared that Kanu should continue to face his criminal case that has been pending for years.

No court in Nigeria has acquitted and discharged Kanu for his criminal case and the Supreme court has since set aside the parallel High Court ruling declaring his rendition illegal.

Then order of the appeal court wasn't carried out for even a minute... The one year lapse he was held on which court order is that..?

How will they carry out the order of the appeal court when FG appealed immediately?

It happens everyday all over the world.

Either party who got a ruling they do not like, can ask that same court to hold the ruling or maintain the statusquo whil they appeal.

It is up to that court to agree or not to agreed.

Some courts even without either party asking, hold their ruling and give either side a number of days to appeal that ruling and if after the expiration of those days if no appeal is done, the ruling become final.
