“The appointment of Egbetokun, which took effect from 31st October 2023, would have ordinarily ended upon his attainment of 60 years of age on 4th September 2024.

“However, before his retirement age, the Police Act was amended to allow the occupant of the office to remain and complete the original four-year term granted under Section 7(6) of the Act, notwithstanding the fact that he has attained the age of 60,” Fagbemi stated.
Very convenient. The amendment was done in 2024 and even though the provisions favored some officers of the force, the main idea seems to be to ensure that the IGP finishes his tenure.

Additionally, human rights activist and former presidential candidate Omoyele Sowore, who also described Egbetokun’s continued stay in office as illegal, was arrested and charged with cybercrimes.
Critics getting arrested is the proof of a banana republic. But to be fair, the IGP's continued stay in office is not illegal. It's approved by the amended Police Act of 2024. Those that deserve the anger are those who approved it in the first place.

It's a public office and should follow the public service rules!

In developed world, retirement is a thing of celebration and time for relaxation. No more work stress etc. But it seems the Nigerian directors and heads of civil service positions do little or no work in office. So they are already relaxing and wouldn't want to retire

Everyone should go at 60. It’s the best way for the system to progress. I will never support all these politically motivated tenure extension that violates public service career progression.

I'm not a lawyer, but one of the traits of a good law is that it doesn't take retrospect or retroactive effect. The law would have taken effect on any IGP coming after Kayode Egbetokun. Let's look at this scenario, a man has being charged to court for stealing N1 Billion naira. The law under which the man was charged specifies 4 years imprisonment on conviction. In course of trying this man, the NASS amended the law and it was assented into law by the president. The law stipulated that any person that is found of stealing N1 Billion will be sentence to death by hanging on conviction. The question now is 'can this man be charged and sentenced to death under the new law'?

I'm not a lawyer but even if there was amendments, the current igp shouldn't have benefited from it because he was an igp before and after the amendments so he shouldn't have benefited from the amendments as his appointment wasn't based on the amendments.

Tinubu and fagbemi doesn't care about the fact that the amended Police Act contradicts the Service Act’s provision that public servants must retire after 35 years of service or at 60 years of age, whichever comes first.

What of those that retired when they turn 60 or when they've served up to 35 years?

Any police that has less than 4 years to retire should not be made an IG.
